MINUTES OF THE CITY COUNCIL MEETING
February 2, 1977, 7:30 P.M.

A meeting of the City Council of the City of Rexburg, Idaho, Madison County, was held
on Wednesday, the 2nd of February, at the hour of 7:30 P.M. at the City Hall. Present were the
following:
Mayor: John C. Porter
Councilman: Morgan Garner
Norman Holman
Nile Boyle
Warren Porter
Councilwoman: Darlene Blackburn
Absent: Councilman Barton Jensen
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
RE: MINUTES APPROVED
Minutes of the January 5th meeting were read and discussed. Councilwoman Darlene
Blackburn moved the minutes be approved as corrected. Councilman Nile Boyle seconded.

RE: DELL KLINGLER APPOINTED TO SAFETY COUNCIL
Mayor Porter suggested the appointment of Dell Klingler, County Commissioner, to the
safety council as a representative of the County. Councilman Nile Boyle moved the
appointment be made and it was seconded by Councilman Morgan Garner.

RE: REPORT ON ATTENDANCE AT UTAH POWER HEARING '°"`
Mayor Porter reported on his attendance at the hearing of Utah Power & Light representing
the City, Discussion.
RE: REQUEST FOR ZONING CHANGE
Mayor Porter read a letter from Wes Lawrence requesting a zone change of Block 3 Lot 4
of the Klingler Addition. They wish to have the property changed from 1~2 to R-3 so they
may build an apartment house for the elderly. All agreed to turn the request over to the
planning board.
RE: VILLAGE GREEN TRAILER COURT REQUESTS GARBAGE PICKUP
Mayor Porter read a letter from Reed Baker of the Village Green Trailer Court West of
Rexburg. They wish to have the city pick up their garbage. After discussion, it was agreed
that the City would put an 8 yd bin their and pick up garbage once a week. They would be
charged a se t fee of ,1,50.00 per month.
RE: VARIANCE AND PLANS OKAYED ON KEN BIRD 4 PLEX
Ken Bird presented plans for a 4 plex. He would have to have a 10 foot variance to build
the 4 plea. Councilman Morgan Garner moved the variance be granted and the plans
accepted. Councilman Nile Boyle seconded.

RE: MORGAN GARNER CHECKING STREETS THAT NEED REPAIR
Mayor Porter advised Councilman Morgan Garner to check the streets needing repair. To
survey. Discussion.
RE: FEDERAL FUNDS FOR FLOOD DISCUSSED
Money discussion. Federal Funds flood related.
RE: KSRE WANTS TO BROADCAST LIVE THE COUNCIL MEETINGS
Mayor Porter advised that the College radio station KSRE wants to broadcast live the
council meetings. After discussion it was agreed that the Mayor discourage them.
RE: CHAMBER OF COMMERCE WISH TO CELEBRATE THE ANNIVERSARY OF THE FLOOD
Mayor Porter reported that the Chamber of Commerce wish to celebrate the anniversary of the
flood. The Council will go on record as supporting the Chamber on what ever they decide.
WATER ORDINANCE PASSED BY THE CITY OF IDAHO FALLS
Discussion on water ordinance passed by the City of Idaho Falls.
RE: PLANS DISCUSSED ON FIRE STATION
Mayor Porter reports that plans are being finished for the fire station. The award was
given January 11th and they have until April 11th to have the plans completed. The
bid opening will be March 29th and the award given the 1st or 2nd of April.
RE: BID OPENING ON POLICE CARS
Bid opening on Police cars. Taylor Chev., Malibu $5,098.00; Stones Town & County, Dodge
Monico $4,984.00; Rexburg Ford LTD 2 $5,271.65; Erickson Pontiac LeMans $5,073.00 or a
Catalina $5,920.00. Councilman Warren Porter moved the bids be turned over to the Chief
of Police to check the specifications. Nile seconded.

RE: COMPLAINTS ON BUILDING
Discussion on complaints Big O Tire building right to the street. Anderson Lumber
Building out to the road.
COUNCILMAN MOVES BILL BE APPROVED
Councilman Nile Boyle moved the bills be approved for payment. Councilman Norman Holman
seconded.

Councilman Nile Boyle moved the meeting be adjourned. Councilman Morgan Garner seconded.

RE: 7:30 P. M. HEARING ON TRI COUNTY ANNEXATION
The meeting was brought to order by Mayor John C. Porter. Also present were Councilmen,
Nile Boyle, Warren Porter, Morgan Garner, and Barton Jensen, and Councilwoman Darlene
Blackburn.
In the absence of any protesters, the Tri County property was approved and may be annexed
to the City of Rexburg. Councilman Barton Jensen moved the necessary ordinance be drawn
up. Councilwoman Darlene Blackburn seconded. It should be zoned Industrial.
