MINUTES OF THE REGULAR CITY COUNCIL
MEETING,OF THE CITY OF REXBURG, IDAHO
A meeting of the City Council of the City of Rexburg, Idaho, Madison County, was
held on Wednesday, the 5th day of January, at the hour of 7:30 P.M. at the city hall
at which meeting there were present and answering roll call, the. following:

Absent: Norman Holman

City Clerk, Afton Anderson
RE: MINUTES READ AND APPROVED
Minutes of the December 1 and December 15th meetings were read. Councilman Nile Boyle
moved the minutes be approved as corrected. Councilman Warren Porter seconded.

RE: APPLICATION FOR NEW FIRE DISTRICT
Mayor Porter reports. Application was made for urban development funding last October
in the amount of $385,950.00 to build a fire station. The county voted to have a
new fire district. They must all be housed in the same building. The grant was
accepted. Four or five years ago the city had contracted to build a new fire station.
Plans were made then. We have sent them in to be up dated. The plans must be ready
in 90 days.
RE: BIDS FOR FRONT END LOADER
Bids were opened on a front end loader. Low bids were by John Deere and Western Equip -
ment. The bids were: Folder Equipment, Clark 2 1/2 yd $49,650, 3 yd $55,000; Snake
River Equipment, used Huff $58,000; Idaho Equipment, Fiat $65,562; Western Road Machine,
Trojan 2 1/2 yd $37,800; Arnold Machines, Huff 3 yd$50,351, small $41,977; Elliot Ind.,
John Deer $36,000 and smaller at $30,100; G & K Caise 2 1/2 yd $36,000. 3 yd $48,000.
Councilman Morgan Garner feels the cat should be the way to go. We should go with the
larger machine. Discussion on army surplus equipment.
RE: MACHINE ELLIOTTS BID WAS OVERBID
Representative of Elliots in Idaho Falls stated that the machine they bid was overbid.
Councilman Barton Jensen moved eve check on 2 1/2 yd new one. See if we can get another-
one to use meantime. Warren Porter will investigate. Councilman Morgan Garner and the
Mayor will decide. Councilman Nile Boyle seconded.
RE: HEARING ON RIGBY MORRELL ZONING CHANGE

8:00 Hearing on Rigby-Morrell zoning change. Mr. Crapo representing. The plans have
been presented with a 300' buffer on the East side of the property and a smaller com-
mercial zone. Petitions were presented that were. signed in November of 1976. There
would be no problem of water and sewer as they are already available. Mr. Crapo asked
that the council, if unable to grant change now, merely table until after planning
has been completed. Mayor Porter explained that there are a lot of commercial properties
now within the city limits and he does not want to change any zoning until the planners
get through with their study. There has been another grant for study awarded this week.
IRE: CITY WATER AND SEWER EXTENTION FOR WELDON STODDARD PROPERTY DENIED
Weldon Stoddard asks to have city water and sewer service to his property for develop-
ment, also for the city to participate on cost. Mayor Porter said they could not hook
on to the city system without being annexed. There would also have to be some updating
of our sewer sytem before an additional subdivision of that size could be put on the
city lagoons.
IRE: MOTION MOVED AND ADOPTED
"Be it resolved that any person, firm or corporation desiring to construct over a
four plex in the city of Rexburg must present for approval of the City Council a
preliminary plat and building plan, which must remain on file with the city clerk
so the Building Inspector can refer to the plan during construction and require
that the construction complies with the plans. Seconded by Norman Holman, Council-
man. On roll call all councilmen present voted "aye"."
Councilman Nile Boyle, presented the proceeding motion and moved its adoption.
RE: WESTERN DEVELOPMENT REQUEST ZONE CHANGE
Western Development have purchased a piece of property on lst North which is zoned
residential. They want permission to put a trailer on that lot and operate their
business from there for one year. Mr. Lynn Davenport read a letter from the⢠residents
in the area that do not want anymore camrnercial property there. Nir. Davenport is
reluctantly against them using the property for commercial use even temporarily a.s
they bought, the property knowing it was zoned residential. The council turned down
the request.
RE: PROPOSED ROUTES FOR. NEW SEWER LINES
John Millar showed maps of proposed routes for new sewer lines for North 2nd East.
They want to put this on an LID. Mary Smith, City Attorney, suggested consolidating
this with other projects to go on one LID. Councilwoman Darlene Blackburn moved we
begin proceedings to develop LID. Councilman Barton Jensen seconded.

COMMITTEE REORGANIZED
Mayor Porter advised that as of the 1st of the year the committees will be reorganized.
Warren Porter has been the councilman over parks and recreation. Mayor Porter appointed
him to take over the Finance and Irrigation Committee and appointed Councilman Norman.
Holman to take over the Parks and Recreation Committee. Councilman Morgan Garner
moved the appointments be made. Councilman Barton Jensen seconced.

RE: CITY LOADER WAS HIT BY A TRAIN
Mayor Porter reported that the city loader was hit by a

Mayor Porter reported that plans had been drawn up for a dog pound. Blue prints were
given to contractors 30 days prior to Manwarings, Zollingers, Western Development,
Bonneville Western and E & L Const. The only bids submitted were Bonneville Western
with a bid of $46,743 and E & L Const. with a bid. of $15,'377. Councilman Barton
Jensen moved the low bid of E & L Const. be accepted. Councilwoman Darlene Blackburn
seconded.

DISCUSSION OF FIRE AT CITY DUMP ON NORTH 5th WEST
RE: CHRISTMAS LIGHTS DISCUSSION
Mayor Porter reported on the Christmas lights. Utah Power & Light will run wires with
utility plugs for the Christmas lights if the city authorizes them to do so. We could
then have our employees put them up without the big expense of having electricans put
them to install utility plugs for Christmas lights. Councilman Morgan Garner seconded.

Councilman Morgan Garner moved the bills be approved for payment. Councilman Nile Boyle
seconded.

RE: RENT PART OF OLD SHOP FOR STORAGE
Mayor Porter reported that Brunson Electric wants to rent part of the old shop for
storage. Councilman Morgan Garner moved that the Mayor work up an agreement.
Councilman Barton Jensen seconded.

The regular meeting of the City Council of the City of Rexburg, Idaho, Madison County,
was held on Wednesday, December 15th, at the hour of 7:30 P. M. at the city hall at

Mayor Porter read the minutes of the-_pubiic hearing held by the Planning Board December
9th. This was the first of two hearings on HUD grants. The next hearing is on December
28th. The planning board studied the proposal for the Rigby-Morrell property. There
were approximately 30 people present to protest the zoning change. After due consider-
ation the planning board voted to recommend that the council turn down the zoni.x-g
change.
Tri-County and Robinson hearing granted a continuance. This was an annexation.
RE: COMMERCIAL PROPERTY FOR A CERTAIN USE ONLY

It was brought to the attention of the Mayor arslCouncil that the plans for the Shannon
Motel property has been changed. At the time that the property was annexed, the owners
asked that it be zoned Commercial so they could rebuild their motel. They have now
decided to put in a shopping center. Councilman Barton Jensen suggested that the city
ordinance on zoning should be changed so that Commercial property could be restricted
for a certain use. This would prevent some of the problems the city has run into.
RE: PLANNERS ARE NOW HERE IN REXBURG
Mayor Porter said the planners are here in Rexburg now. Boing Computer Services study
and recommendations. We can then ask for implementation grants and development programs,
by the middle of next summer.
