All Aye RE: RENT PART OF OLD SHOP FOR STORAGE Mayor Porter reported that Brunson Electric wants to rent part of the old shop for storage. Porter MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO STATE OF IDAHO) County of Madison(SS City of Rexburg) The regular meeting of the City Council of the City of Rexburg, Idaho, Madison County, was held on Wednesday, December 15th, at the hour of 7:30 P. M. at the city hall at which meeting there were present and answering roll call, the following: Mayor: Councilwoman: Councilman: Also Present: RE: MINUTES OF PUBLIC HEARING READ John C. Porter Darlene Blackburn Norman Holman Morgan Garner Barton Jensen Nile Boyle Warren Porter Mary Smith, City Attorney Afton Anderson, City Clerk Mayor Porter read the minutes of the._publc hearing held by the Planning Board December 9th. This was the first of two hearings on HUD grants. The next hearing is on December 28th. The planning board studied the proposal for the Rigby-Morrell property. There were approximately 30 people present to protest the zoning change. After due consider- ation the planning board voted to recommend that the council turn down the zoni,Bg change. Tri-County and Robinson hearing granted a continuance. This was an annexation. RE: COMMERCIAL PROPERTY FOR A CERTAIN USE ONLY ~I ~I It was brought to the attention of the Mayor arslCouncil that the plans for the Shannon Motel property has been changed. At the time that the property was annexed, the owners asked that it be zoned Commercial so they could rebuild their motel. They have now decided to put in a shopping center. Councilman Barton Jensen suggested that the city ordinance on zoning should be changed so that Commercial property could be restricted for a certain use. This would prevent some of the problems the city has run into. RE: PLANNERS ARE NOW HERE IN REXBURG Mayor Porter said the planners are here in Rexburg now. All Aye DISCUSSION FOR ADDITIONAL WATER AND SEWER LINES DISCUSSION FOR SEWER LAGOONS IMPROVEMENT FOR SUGAR CITY AND REXBURG RE: DEBRIS PICKED UP TWICE A WEEK There will still be debris being picked up by the city crews twice a week. They must call and make arrangements for pickup at the shop. RE: PLANNERS ARE NOW HERE IN REXBURG Mayor Porter said the planners are here in Rexburg now. We can then ask for implementa- tion grants and development programs. They are making a comprehensive plan for Madison County. Mayor Porter asked how many present are against the zoning change. The majority of hands were held up. Bruce Parker was surprised to hem its had been for sale as he had been in the market and could not find one. Opposed. Doug Smith. Feels there would be no safety for their children with a shopping center there. Opposed. Arthur L Porter, Opposed, wishes to keep a quiet neighborhood. Frank Bates. has lived near a shopping center before and is very opposed to living by one again. Mark Tingey, is a realtor and feels the lots would be a sell out in no time as lots are bare to find. Opposed. Reed Baker. would have roads on 3 sides. Opposed. He bought his home whenit was residential and wishes it to stay that way. Ruth Sanders. has fought the freeway, now with a motel on one side, a freeway on the other, they definetaly do not want a a shopping center on the other side. Mike Kennedy. The feeling of the people are against the shopping center. There are only 2 areas left that are strong R-1; this area and up on the hill. They very strongly feel this area should be left:R~a and let the commercial stay downtown. He asks the council to turn down the proposal. Larry Saunders. Opposed. Roger Hoopes asks that the council protect the R-1 zones. Opposed. Barton Jensen. One reason for zoning is to protect the property owners there first. The Council has always voted as to the wishes of the people. Councilman Barton Jensen moved that as the majority of people are against the zoning change, the request be denied. Nile Boyle seconded. All Aye RE: GARY BROCK WANTS TO BUILD STUDENT HOUSING Gary Brock wants to build student housing. It is in an R-2 zone and must be changed to R-3. Mayor Porter stated that it would have to be turned over to the planning board first. RE: FORSGREN AND PERKINS BUSINESS John Millar of Forsgren and Perkins has business to take up with the council. Clark Brothers that is doing the construction of the other bridges, has bid $26,459 to tear out the old bridge. and headgate and put in new. Councilman Nile Boyle moved we accept the bid. Councilwoman Darlene Blackburn seconded. ~~ RE: ORDINANCE 574 City Attorney Mary Smith read interim Ordinance 574~in full AN INTERIM ORDINANCE APPROPRATING SUFFICIENT FUNDS FOR PAYMENT OF EXPENSES AND SALARIES BY THE CITY OF REXBURG, IDAHO FOR 1977. PRIOR TO THE PASSAGE AND APPROVAL OF THE ANNUAL APPROPRIATION ORDINANCE; PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by Councilman Nile Boyle and seconded by Councilman Warren Porter that the rules requiring ordinances of a general and permanent nature to be fully and distinctly read on three different occasions be dispensed with and that said Ordinance be numbered 575 and be read in full and at length and placed upon its final passage. Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon roll call upon said motion was as follows: Those Voting Aye: Darlene Blackburn Barton Jensen Morgan Garner Norman Holman Nile Boyle Warren Porter Those Voting Nay: None The Mayor thereupon declared that the motion, having been passed by not less than three-fourths of the Council, have been duly carried, Ordinance No. 574 was then read by the Clerk in full and at length. RE: WORKING ON BUDGET Department heads are working on the budget, we may have special meetings next month to get the budget passed. RE: SPRINKLERS FOR PENNYS PROPERTY Keith Peterson asked the city to put a 6" main to the Penny Property for sprinklers. Councilman Morgan Garner so moved. Councilman Darlene Dlackburn seconded. All Aye RE: UNLOADING PROBLEM AT BOISE CASCADE It has been reported that Boise Cascade has been unloading their trucks on main street present a traffic hazard. There was one accident there already. Mayor Porter said he would send the police down to warn them that they would have to unload somewhere else besides the middle of the street.
