Mayor Porter advised that the next planning board meeting will be September 9th; they
can make their recommendation then. Councilman Barton Jensen moved the public hearing
be set for September 15th which would be the next council meeting after the planning
board meeting. Councilman Morgan Garner seconded.

RE: HEARING SCHEDULE SAME TIME AS DAUM INDUSTRIES
Jim Hamilton asked the council to schedule a hearing for the same time for the Daum
Industries proposed shopping center west of the golf course. Councilman George Catmull
moved that the hearing on this shopping center be scheduled for September 15th to
coincide with the other hearing. Councilman Barton Jensen seconded.

RE: NEW PLANS FOR THE GROUNDS AROUND JUNIOR HIGH SCHOOL
The School Board has submitted a new plan to the council for the gounds around the
Junior High School. The street, (lst West, between Main and 1st North) has
previously been closed on a temporary agreement between the city and the school district.
The Hilton property has been sold to Roger Ferguson. It lies in the center of the school
property and Mr. Ferguson wishes to trade it for another piece of property owned by the
school. The school district owns the red brick house right next to Roger Ferguson's
home on West Main. A trade of property has been requested by Mr. Ferguson. The council
took no action on the problem.
RE: FDAA SENDING MAN TO HELP WITH LOAN APPLICATIONS
Mayor Porter reported that FDAA is sending a man from Washington D. C, to help with the
loan application. This loan would take care of our LID bond sale and also for revenue
loss from the tax base loss.
RE: JERRY BRIAN GIVEN A $100 BONUS
Councilman Nile Boyle moved that Jerry Brian be given a $100 bonus for one month only.
Councilman Barton Jensen seconded.

A meeting of the City Council of the City of Rexburg, Idaho, Madison County was held on
Wednesday, the 1st of September, at the hour of 7:30 P. M. at the City Hall at which
meeting there were present and answering roll call, the following:

RE: MINUTES READ AND APPROVED
Minutes of the August 18th meeting were read by City Clerk, Afton Anderson, Councilman
Barton Jensen moved the minutes be approved as corrected. Councilman Nile Boyle seconded.
RE: REQUEST TO BUILD OUTSIDE ENTRANCE
Irving Woodmansee requested a variance to build an outside entrance on the side of his
home at 16 West 1st North. It is necessary for them to have a woman to live in and help
care for Mrs. Woodmansee. The entrance would be a stairway down into the basement with
a cinder block retaining wall. Councilman Barton Jensen moved that in as much as
hey are not going to cover the stairway and there will be a cinder block retaining wall
hey should be allowed to build the outside entrance. Councilman Nile Boyle seconded.
RE EWER LINE FOR AL KNUTSON AND FRANK DANIELS
Al Knutson requested a sewer line to service his trailer court on North 2nd East. He
was advised that Frank Daniels is building a furniture store across the road and wishes
to have the sewer put to that property also. Mayor Porter reported that an application
for 100 funding to extend water and sewer lines and improve lagoons has been made.
City Attorney, Mary Smith, advised that the Pizza Place that Frank Daniels has bought
used to be a street right-of-way. That street has never been abondoned. Mayor sug-
gests that Attorney check on this before he rebuilds.
RE: FIRM OF HAMILTON & VOELLER
The firm of Hamilton & Voeller, engineers, were represented by Ted Sorenson and .Jack
Hamilton. They are c~.vil engineers from Pocatello. They have special training in sewer
and sanitary work. They have worked with the new public works employment act and would
like to help the city with the storm sewer problem. They have made many applications
in other cities. Mayor Porter asked if they would be immediately available if we need
assistance. Mr. Hamilton stated they specialized in fast tract projects, they have
their own aircraft. Mayor Porter advised that we would be working with an urban D
project soon that would require proposals from 2 or 3 firms. They would be happy to
help.
RE MOVE SIGN FROM THE CORNER OF COLLEGE AVE
Niles Monson asked to have the sign removed from the corner of College Ave and Main
.Street. The sign sticks out from the corner and the business is no longer located on
College Ave. This sign was in violation before, and should be removed. All agreed
We also need to remove drug zone parking.
RE: REX TV HAD NOT SHOWN FLOOD DISASTER DOCUMENTARY
Mayor Porter reported that the Rex TV had not shown the flood disaster documentary in
Rexburg; 'the film was on Rexburg and was shown everywhere else but Rexburg. Mayor
Porter received 10 or 15 calls from residents that were angry because the show
was not on. He called the television station in Idaho Falls; he was advised that
the Rexburg station had failed to tell them to change the programming. Mayor Porter
said that call came to the city because the city franchises cable TV. They haven't
paid the franchise tax for part of 1975 or 1976.
RE: STORM SEWERS IN STARLITE ADDITION ARE A PROBLEM
Mayor Porter reported that'the storm sewers in the Starlite Addition are a problem.
They have sumps that have to be pumped out after every rain storm. One of the new
employees in the street department pumped the water from the sump into the sanitary
sewer. This backed the sewage into the basements. Mayor Porter authorized them to
urchase new carpet to replace any damaged by this sewage. The water department had
similiar problem, the 4th ward church. The sewer was plugged by roots and the
lusher truck couldn't cle~it. The rotor truck wasn't working. When they unplugged
he sewer,. the first surge of water backed sewage into three basements. The insurance
company will have to pay the claims.
RE: MAYOR AND CITY CLERK GIVEN PERMISSION TO BORROW 25~ OF YEARLY BUDGET
Several meetings ago, the council gave the Mayor and City Clerk permission to borrow
up to 25$ of our yearly budget so as to remain solvent and buy our own LID bonds. Phil
Choate and the City Clerk, Afton Anderson, worked up the application. FDAA studied the
application and asked for several changes. We then sent the application in again and
Mayor Porter called the Governor. The Governor requested a man from Washington to be
sent out to help. Last Monday the man came at 1:30 P. M. They told us that we would

receive the money in 3 payments. September 3, January and June of 1977. They brought
some papers to sign and it was finalized.
RE: HIGHWAY BOARD WILL BE ON TOUR HERE
Mayor Porter reported that the Highway Board will be on tour here from Sept 27 to Oct 1
They will be here in Rexburg at 10:00 A. M. Sept. 29th. The bids for bridges have
been called. Mayor Porter suggested that Councilman Morgan Garner should go to
Forsgren & Perkins and see that they get the railroad crossings and alleys fixed before
the snow falls. FDAA has given us funds but we must get bids.
RE: PROVIDE POLICE AND FIRE PROTECTION TO HUD TRAILER COURT
Mayor Porter advised that we are to provide police and fire protection to the HUD
trailer court. They are out of the city limits so this creates difficulties. We are only
able to send the county fire truck to the court because it is out of the city limits.
City Attorney, Mary Smith says the city fire truck can not go out of the city limits
to put out a fire. The county Sheriff's Department should do the patrol also as it
lies in their jurisdiction. Mayor Porter has suggested to the HUD people that they get
a private contractor to take care of their snow removal as we can not go out of the
city limits with city equipment.
RE: ACCIDENT INVOLVING OUR CITY GARBAGE TRUCK
Mayor Porter advised the council of the accident involving our city garbage truck. The
truck was driven by Charles Niederer. He was heading south towards Rigby, when a pickup
slowed to turn off the highway. Charlie hit the back of the pick and then turned the
Garbage truck off the road and went through the trailer sales hitting a new car parked
there. A third vehicle, a cement truck, was hit by the other pickup after being hit
by the garbage truck. Charlie may be cited; his foot was pinned in the truck but was
only bruised.
RE: WALKWAY NEEDED FOR SCHOOL CHILDREN
It will be three months before they can put the bridges in on Tst North and they need a
walkway for the school children. The matter will be taken under study.
RE: PARKING ENFORCED
Mayor Porter reported that the 2 hour parking will be enforced as of September 1st.
RE: MILLHOLLOWSUBDIVISION TO BE ANNEXED AND ZONED R-1
The Millhollow Subdivision has asked to be annexed and zoned R-l. City Attorney, Mary
Smith read ordinance 572 annexing this property and zoning it R-1.

AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS
AND DECLARING SAME A PART OF THE CITY OF ReXBURG, Idaho: AND AMENDING AND CHANGING THE
ZONING MAP OF THE CITY OF REXBURG, IDAHO, TO SHOW SUCH ANNEXATION AND THE CLASSIFICATION
OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, Idaho, AND PROVIDING
WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
A MOTION WA5 MADE BY Councilman Barton Jensen and seconded by Councilman Warren Porter
that the rules requiring ordinances of a general and permanent nature to be fully and
distinctly read on three different occasions be dispensed with and the said Ordinance be
numbered 572 and be read~in full and at length and placed upon its final passage.
Thereupon the Clerk was ordered to call the roll on said motion and the roll call
upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by not less than

RE: FLOOD DISASTER DOCUMENTARY TO BE SHOWN THIS SUNDAY
Mayor Porter reported on the cable TV. He was upset because the flood disaster docu-
mentary failed to be shown in Rexburg.. However, he found that there had been an error
to change the programing. Rex TV will be showing the documentary this Sunday. Western
Telecommunications wrote the Mayor a letter saying there was nothing Rex TV could have
done.
RE: TRIED TO GET FDAA TO PROVIDE FUNDS FOR SPRAY TO KILL FLIES
The County Commissioners have tried to get FDAA to provide funds to spray the area to
kill all the flies.

RE: BIDS OPENING FRIDAY FOR BRIDGES IN REXBURG
Mayor Porter reported that there was a bid opening Friday at 2:00 P, M. for the 4 bridges
in Rexburg. Clark Bros, submitted the low bid on all the bridges. Councilman Barton
Jensen moved the city accept the Clark Brothers bid. Councilman Morgan Garner seconded.
All Aye. There are 5 bridges across the canal, four were destroyed. The 2nd South Bridge
by Chapples is now starting to deteriorate. FDAA explained that there will be a team to
investigate. They may be able to include the 5th bridge and still come under the money
allowed which was $140,000.
RE: TRUCKS RUNNING OFF MILLHOLLOW ROAD AND INTO HIGH SCHOOL
Discussion of the high school building problem. Millhollow Road and 1st North crossing
by the new high school. Trucks coming off the hill have run into the building twice.
Councilman Barton Jensen suggested building a barricade of some type. Mayor Porter
suggested building a guard rail like approachs for bridges. The school district is putting
a temporary trench to prevent vehicles hitting the school. The trucks coming off the hill
are speeding; it is very dangerous for the students walking from the HUD trailer park.
The county is planning a road from the dairy along the canal joining North 2nd East
by Cal Ranch. There should also be a black top path for the school children to walk to
school. Morgan Garner was assigned to study the problem and report to the council.
