Minutes of a special meeting of the Rexburg City Council held June 30, 1976, in room
387 at the Manwaring Center in Rexburg, Idaho. The council chambers at the Rexburg
City Hall having been inundated and rendered unusable as a result of the flood waters,
and debris from the break of the Teton Dam.

RE: CITY ATTORNEY TAKE5 MINUTES

In the excused absence of Afton Anderson, City Clerk, the Mayor asked Mary Smith, City
Attorney, to take the minutes.
RE: MEETING CALLED TO ORDER
The Mayor called the meeting to order. Moved by George Catmull, seconded by Darlene
Blackburn that reading of the minutes of the last meeting be waived because of the
absence of the City Clerk.
RE: MADSEN REQUESTS VARIANCE IN CONSTRUCTION OF APARTMENT
George Madsen requested a variance in the construction of apartment houses on the
property at the end of First North on 5th West. He presented to the Council the proposed
plans and explained them.
RE: VARIANCE GRANTED WITH CONDITIONS
A. H. Brock and Wood Miller of the City Planning Board were present. The Mayor explained
the proposed apartments would not comply with the code because Mr. Madsen wanted the
stairways outside; that there was enough parking. The matter was discussed. Moved by
Barton Jensen, seconded by Morgan Garner and unanimously carried that application
for a variance be granted permitting the stairways to be built on the inside as
shown on the plans presented to the council. The Mayor directed that a copy of the
plans be filed with the City Clerk.
RE: INSPECTION CLARIFIED

RE: HAMILTON ASKS FOR NEW ZONING
Jim Hamilton asked that the City Council consider commercial zoning of possibly. 20
acres of the property between the airport road and the new highway, north of highway
88 and west of the Golf Course; that he would like it annexed to the city and zoned
commercial. The matter was discussed. The Mayor asked that the Planning Board that it
be taken under consideration and report at the next council meeting.
PROPOSALS NEED TO BE CONSIDERED CAREFULLY
The Mayor stated that becuase the City was in a state of emergency careful study
should be given to any proposal to change the pattern of business or anything else
until the City had a chance to adjust and settle; down.
RE: USE OF THE LIBRARY
The Mayor explained that the library had been condemned and the government agency that
had been working on it said the government would build a new library. However, they
wanted to make arrangements with the city to use the area back of the council chambers
pending the construction of a new library; that the areawould have to be remodeled
and they would pay us $350.00 a month rent which would pay for the remodeling of that
portion of the building and cleaning up from the flood.
RE: TEMPORARY LIBRARY
Moved by George Catmull, seconded by Darlene Blackburn and unanimously carried, that
unless the library board is able to acquire more suitable property that the city
clean and remodel the room east of the council chambers for use as a temporary
library.
RE: GOVERNMENT APPROVES CHANGE IN OLD SHOP BUILDING
The Mayor stated the government has approved fixing up the north end of the old shop
building and will put in a 48 foot steel door and do away with the double door so the
police could store things there.
RE: NATIONAL GUARD MOVES, BOWEN, THOMASON AND WARD PROPERTY ASKED TO BE REZONED
The Mayor read a letter from Kennedy and Kennedy regarding the Bowen, Thomason and
Ward property asking that it be rezoned commercial as the National Guard was moving
its armory from the fairgrounds where it would be away from the flood area and have
five or six acres for use.
RE: ZONING TURNED OVER TO PLANNING BOARD
It was moved by Warren Porter, seconded by Morgan Garner and unanimously carried that the
matter of rezoning above property be turned over to the Planning Board and that a
plat of the proposed area be given to the planning board.
RE: THOMPSON AND CLARK PRESENT PLATS
Lyle Thompson and Mrs. Clark presented plats of two plats of two proposed sub-divisions.
Mr. Thompson stated he had resubmitted the plat to the planning board as the council
had requested after making suggested changes. The matter was discussed and Jim
Hamilton stated the planning board had approved it.
RE: SMART WANTS TO USE CESSPOOL FOR LOAN
Rowlee Smart stated the FHA had approved a 40 year loan subject to t he provision that
the City allow him to use the cesspool serving the property; that it was only used
three months out of the year and he would have to go a block to connect with the sewer;
that other properties in that area used cesspools. The Mayor informed him that if he
was in the area where he could hook on to the sewer, he would have to do so but if not,
he could continue to use the cesspool and that in this case the sewer was not available
to him within the distance designated by the ordinance.
RE: CLEANING OF SUMPS
The cleaning of sumps was discussed.
RE: CETA EMPLOYEES AVAILABLE
The Mayor stated that 30 CETA employees were available; that they would have one
supervisor who would take the employees around to the jobs.
RE:STREET SURVEY
The Mayor stated a street survey was going to be made by the City Engineer, Morgan
Garner, Dan and someone from the State and Army Engineers; that it would be a street
project with full restitution. Also that the bridges would be handled in the same
manner.
RE: TAX BASE LOS5
The Mayor stated that Mary and Afton had attended a meeting the 26th of June, 1976,
wherein the loss of tax base in the flood area was discussed and that money was
available to public entitles us to borrow to make up for the tax base loss; that
the county auditor Mrs. Garner, told him the tax payments on June 20th for the last half
of 1975 were about 80~ under what they normally would be. The Mayor explained that under
such a situation the City would be short of .money. The matter was discussed. The
Mayor stated that the water, sewer, and garbage revenue would be reduced about half

RE: SWIMMING POOL AND CLUB HOUSE AT GOLF COURSE DISCUSSED
The Mayor stated that work was being done on the swimming pool; that the park people
had allowed $68,000.00 for the golf course club house; that the Garner gravel pit was
being filled with debris and that the army engineers had agreed to cover it with top
soil; that the double wide mobile home had been placed on the Golf Course as a temporary
club house; that the golf course well had been damaged and was being repaired.
RE: CITY HALL BEING REPAIRED
The Mayor stated that the City Hall was being repaired. The cities of Idaho Falls,
Pocatello and Rigby had sent equipment to help out and he wanted to express his
appreciation to them.
STATE POLICE WITHDRAWAL
George Catmull stated he understood the State Police were being withdrawn; that the
transition would be done in an orderly manner.
RE: CITY TO GET NEW POLICE
The Mayor stated that under the LEA program the city would get about five more police;
that 100 state police had been in Rexburg and had rendered a valuable service to the
City and county; that they would be phased out in an orderly manner.
RE: MEETING ADJOURNED
Moved by Barton Jensen, seconded by Nile Boyle that the meeting adjourn.

A regular meeting of the City Council of the City of Rexburg, Madison County, State of
Idaho was called to order by Mayor John C. Porter at 7:30 P. M. on July 7, 1976 at the
Manwaring Center.

Moved by George Catmull, seconded by Darlene Blackburn that reading of the minutes of the
last meeting be dispensed with.

RE: NEW HOMES MUST HAVE BUILDING PERMIT
The mayor explained the efforts of the City to have the HUD trailers installed properly
and the inspection of the installation. He also stated that the City had not relaxed or
waived zoning requirements; that new homes must have building permits and comply with all
building codes, rules and regulation. The only exception has been to let the owner
present the plans in sections rather than all at once because of the urgency.
The Mayor stated that many of the displaced older citizens wanted to get double wide
trailer; that he had told Flora Shelton, who wanted to place such a trailer in an R2
area that she would have to get the permission of the surrounding property owners to let
her leave it there during her lifetime, and thereafter such permission would be
