A regular meeting of the City Council of the City of Rexburg, Madison County, State
of Idaho was called to order by Mayor John C. Porter, at 7:30 P. M, on May 19,-1976.

The minutes of the April 21 and May 5 meetings were read and discussed. Councilman
George Catmuss moved that the minutes be approved as corrected. Second was by
Barton Jensen.

RE; ROBERT SIPHERD'S PLAT OF PROPERTY APPROVED
A plat of property owned by Robert 5ipherd was presented for approval. The owner
wishes to have the property annexed and approved for a subdivision. The planning board
has recommended that the plat be approved as they have met all requirements; including
a letter of intent to install all facilities and utilities according to the city's
requirements. Councilwoman Darlene Blackburn moved the platt be approved. The second
was by George Catmull.

RE: PLAT APPROVED FOR MILL HOLLOW SUBDIVISION
A plat was studied on a Mill Hollow Subdivision. The preliminary plat is of property
owned by Steve Meyers, Mike Mickelson, and Gary Olsen. With a letter of intent
regarding installation of sewer, water and utilities for the Mill Hollow Heights
Subdivision located on 3.5 acres West of the proposed Mill Hollow Subdivision. They are
also requesting annexation. The planning board has approved the plat with the stipulation
that the plans show a 7 1/2 ft. easement of the South side of Lot 6 and a 15 foot easement
between all other lots for water and sewer lines. Councilman Morgan Garner moved
the plat be approved. The motion was seconded by Councilman Barton Jensen.

RE: OREON BROWN PETITIONED FOR ZONE CHANGE
Oreon Brown petitioned the council to change the zoning of h.is property at 23 East
2nd South. They have a buyer for the property that wants it zoned commercial. Mayor
Porter advised that they would have to have a hearing to change the zoning. They may
be able to get a change to limited commercial but that a commercial zone would not
work in a residential zone.
WAHRER ASKS PERMISSION TO SELL FROM A TRAILER
Nick Wahrer asked permission to sell from a trailer at the Northside Trailer Court.
It is zoned commercial so there is not a problem. Mr. Wharer had to move from the premises
because of construction of the Idaho Bank and Trust building.
RE: GEORGE STODDARD ASKS FOR BUILDING PERMIT
George Stoddard wants another building permit to build a house at the east of his home.
At the time that Mr. Stoddard obtained special permission for his building permit
to build his home, he was told that the property had to be platted before he could build
anything else. This ruling still stands.
RE: HUD TO PUT SEWERS IN HOMES WITHOUT IT
Mayor Porter reported that Bud Armstrong is working on the HUD grant. He is making
a list of homes without sewers.
RE: MILLER ASKS FOR SMITH PARK DECISION
John Miller asked the Council to make a decision on the ditch at Smith Park. Should it
be concreted or not? The council agreed to leave it a few years to see if the flood
control study will come up with a better route.
RE: TENNIS COURTS BIDS READY TO ADVERTISE
Mayor Porter advised that the tennis courts bids are ready to advertise.
RE: BIDS OPENED ON POLICE CAR
Bids were opened on the sale of the used police car. The only bid was by Kelly
Sonderegger for $425.00. Councilman Barton Jensen moved the bid be accepted.
Councilman Morgan Garner seconded.

RE: MOORE ASKS PERMISSION TO BUILD FENCE
Pat Moore has asked for permission to build a fence on her lot on Ricks Ave. This is
a corner lot and there has been some question as to the necessity of a fence. Councilman
George Catmull made a motion that the Moores be allowed to build a fence if the
neighbors sign a petition that they approve. Councilman Morgan Garner seconded.

RE: FEDERAL FUNDS AVAILABLE FOR BRIDGES
Clayter Forsgren, City Engineer, told the council there may be federal funds available
through the State Highway Department for the construction of two or three city bridges.
It was decided that bridges to be constructed would be the one on 2nd South near
Chapples, on 3rd North near the Fair grounds, and on lst North near Covingtons. The
priority would be in the order listed.
RE: URBAN D FUNDS DISCUSSED
Mr. Forsgren explained the city's map showing the main intercepter streets had been
approved for Urban D Funds. He was instructed to start writing the Environment Impact
Statement for 7th South from the highway to Mill Hollow Road and along 2nd South to the
north city boundry. It was also agreed to postpone street improvement on So 2nd
East until Urban D funds could be obtained.
~ RE: ENGINEER AUTHORISED TO CONDUCT FLOOD CONTROL STUDY
It was also decided to authorise the engineer to conduct a Flood Control Study Plan
for the City in cooperation with Ricks College. It was pointed out that some funding
for flood control construction outside the city limits could be secured through Soil
Conservation.
RE: BILLS APPROVED FOR PAYMENT
Bills were approved for payment. Motion made by George Catmull and seconded by Morgan
Garner. The vote was in the affirmative.

Darlene Blackburn moved that the council meeting be adjourned. Seconded was made by
Barton Jensen.
