it be removed as a nuisance.
RE: ACTION TO ENFORCE ZONING ORDINANCE
City Attorney, Mary Smith, is preparing action to enforce the zoning
ordinance on the Manwaring Construction property.
RE: SCOUTS TO HAVE SOAP BOX DERBY AND STREET TO BE CLOSED
Concilman Barton Jensen reported that the Scouts had been in contact
with him about closing a street and have a soap box derby in July.
He suggested closing half of 4th South from the Manwaring Center to
Erickson Pontiac for the time of the races. A decision will be made
later when the plans are complete.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
A regular meeting of the City Council of the City of Rexburg, Madison
County, Idaho, was held on April 7, 1976, at the hour of 7:30 P. M.
at the City Hall, this being the regular meeting place of said Council,
at which meeting there were present and answering roll call the
following who constituted a quorum:

Councilman: Barton Jensen
Darlene Blackburn
George Catmull
Morgan Garner
Warren Porter
Nile Boyle
Absent: None
Also Present: Afton Anderson, City Clerk

Thereupon the following proceedings were duly had and taken:
E: ORDINANCE 570 ASSESSMENT ROLL FOR LID 22
Councilman George Catmull thereupon introduced. an ordinance entitled
"An Ordinance Confirming the Assessment Roll for Local Improvement
District No. 22 in Rexburg, Idaho, for the purpose of causing certain
streets and alleys and parts thereof within the corporate limits of
said City, to be graded, re-graded, graveled, paved, re-paved and
otherwise improve said streets within the district and to construct
and re-construct curbs, gutters, mains and sewer services, drainage
facilities, water mains, water services, sewer, including storm
sewers, and other work incidental to said improvements within said district."

ORDINANCE 570
AN ORDINANCE CONFIRMING THE ASSESSMENT ROLL FOR LOCAL IMPR0~IEMENT
DISTRICT N0. 22 IN REXBURG, IDAHO, FOR THE PURPOSE OF CAUSING
CERTAIN STREETS AND ALLEYS AND PARTS THEREOF WITHIN THE CORPORATE
LIMITS OF SAID CITY, TO BE GRADED, RE-GRADED, GRAVELED, PAVED, RE-
PAVED AND OTHERWISE IMPROVE SAID STREETS WITHIN THE DISTRICT AND TO
CONSTRUCT AND RE_-CONSTRUCT CURBS, GUTTERS, MAINS AND SEWER SERVICES,
DRAINAGE FACILITIES, WATER MAINS, WATER SERVICES, SEWER, INCLUDING
STORM SEWERS, AND OTHER WORK INCIDENTAL TO SAID IMPROVEMENTS WITHIN
SAID DISTRICT; ORDERING A ASSESSMENTS TO BE MADE IN ACCORDANCE
WITH THE ASSESSMENT ROLL AND PRESCRIBING DETAILS CONCERNING SAID
ASSESSMENTS: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH, AND DECLARING AN EMERGENCY,
A motion was made by Councilman George Catmull and seconded by
Councilman Barton Jensen that the rules requiring ordinances of a
general and permanent nature to be fully and distinctly read on three
different days be dispensed with and that said Ordinance be numbered
570 and be read in full and at length and placed upon its final passage.
Thereupon the Clerk was ordered to call the roll on said motion and
the roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed
by not less than three-fourths of the Council, had been duly
carried, Ordinance No. 570 was then read by the Clerk in full and
at length.
RE: AREAS WANTING TO BE ANNEXED TO CITY
Mayor Porter reported that there are three areas wanting to be
annexed to the City. (I) Tri County Equipment property North of the
river; (2) Lyle Robinson property North of the river, extending to the
Robers Brothers road. These two pieces of property will require water
and sewer lines .under the river. A lift station would have to be put
in for the sewer. The people involved would be willing to put in
septic tanks until the city could get a federal grant to put sewer lines
to them. Mayor Porter recommends annexing both pieces of property and
zoning them commercial. (3) A subdivision Platt along Millhollow
Road. The Platt is being presented to the planning board for approval.
Councilman Barton Jensen moved we proceed to annex these three areas
subject to the planning board approval. Councilman Morgan Garner seconded.

RE: CITY TO RENT STORAGE TO KINGS
Mayor Porter reported that Kings needs a storage area for fixtures
while their store on Main Street is being remodeled. .The Mayor suggests
$80.00 per month rental. Councilman George Catmull moved we rent them
storage with perscribed conditions leaving the Mayor to make arrangements.

RE: TRAFFIC SAFETY COMMISSION ACTIVATED AGAIN
Mayor Porter advised that they are trying to get the Traffic Safety
Commission activated again. The ordinance which set up the original
safety commission is still on the books requires ten members. Chief
Siepert has turned in names of people interested in serving. There
are still more needed. Councilmen may make recommendations.
ARE: SOIL CONSERVATION SURVEYING FOR FLOOD CONTROL

Mayor Porter reported that the Soil Conservation is surveying the hill
south of Rexburg for flood control.
~E: CITY TO USE BARRETTS PARKING LOT FOR PARKING
Barretts parking lot- where the old creamery was on South Center, will
be cleared by the end of the week. If the City leve ls and puts
gravel on t he lot, the City of Rexburg can use it as a public two hour
parking lot for two years wi th no charge. It would have to be patroled
during the day. The Council agreed that it would be helpful to have
parking in the area and appr oved the project.
E. ORSON SMITH IS UNHAPPY WITH LID 22 ASSESSMENT
Mayor Porter advised the council that Orson Smith is unhappy with
the assessment he has to pay on LID 22, it does not give him access
to the sewer line. Mayor Porter suggested that the City agree to
run the sewer accross the street to his lot without charge for cutting
the street. Councilman Barton Jensen moved that the Mayor write him
a letter to this effect. Councilman Morgan Garner seconded.

IRE: CITY OF REXBURG TO BE FISCAL AGENT FOR ECIPDA
The organization of seven counties (East-Central Idaho Planning and
Development Assoc.) needs a fiscal agent when applying for the HUD
grant for $5,000.00. Mayor Porter suggested that the City of Rexburg
be the fiscal agent. Their meetings are held at the City Hall.
The City Clerk could do the bookkeeping and the banking. In return
for this service, the city would be reimbursed for the time and
inconvenience. Councilman Morgan Garner moved that the City of Rexburg
agree to be the fiscal agent for the ECIPDA. Councilman Barton Jensen
seconded.

IRE: NEW POLICY FOR VACATION AND SICK LEAVE
The new policy for vacation and sick leave was discussed. Councilman
Barton Jensen moved that the new policy be adopted. Councilman George
Catmull seconded.

IiRE: ATTENDANCE AND LEAVE
Section I-Hours of Work
The established work week for all full-time employees in the classified
service shall be not less than 40 hours, and shall be the same for all
persons occupying full-time positions in the same class under the same
conditions. The work schedule for each department shall be established
by the Mayor and Council.
Section 2 - Attendance
Each department head shall be responsible for the attendance of all
persons in his department and shall keep complete attendance records
including vacation, sick, overtime, etc. Leave shall be authorized
in units of days or hours only.
Section 3 - Holidays
The following days are designated as regular holidays for employees
in the classified service: January I, National Memorial Day, July 4,
Labor Day, Thanksgiving Day, and December 25. Other days may be
declared holidays by the Mayor and Council at its discretion. Whenever

Whenever a holiday falls on a Saturday, the preceding Friday shall be
considered a holiday. Whenever a holiday falls on Sunday, the following,.,
Monday shall be considered a holiday. Holidays which occur during
annual leave shall not be charged against annual leave. Full-time,
hourly workers shall be paid for holidays on the basis of the number of
hours they normally work, without overtime. Part-time workers will
not be paid for holidays not worked.
Section 4 - Annual (Vacation) Leave
(a) General - Vacations are for the purpose of rejuvenation both
physical and mental faculties and all employees are urged to avail
themselves of vacation periods. No employee shall receive pay in
lieu of vacation unless specific approval is given by the Mayor
and council.
(b) Rate of Leave Accrual - Full-time employees begin to accrue vacation
leave immediately upon employment although vacation leave may not be
used until the employee has successfully completed six months' service.
Employees with less than one year continuous service earn vacation
leave at the rate of I/2 of a day per month. Employees with more
than one year continuous service earn vacation leave at the rate of
I day per month. Employees with more than five years continuous
service earn vacation leave at the rate of I I/2 days per month.
(c) Requests for Leave - A request for vacation leave shall be
submitted to the employee's immediate supervisor. Leave may be
taken only after approval by the appropriate department head so that,
insofar, as practicable, the department can function without the
hiring of additional, temporary help.
Section 5 - Sick Leave
(a) General - Sick leave shall be allowed to an eligible classified
employee only in the case of actual sickness or disability of the
employee or for medical, dental or eye examination or treatment for
which arrangements cannot be made outside of working hours.
The employee shall report his illness prior to his scheduled work
time if possible. If not, he shall see that his illness is reported
within 30 minutes after the time he is scheduled to have reported for
work.
(b) Rate of Leave Accrual - Full-time employees begin to accrue sick
leave immediately upon employment at the rate of one day per month
although sick leave may not be used until the employee has successfully
completed three months' service.
(c) Certification by Physician - A medical certificate signed by a
licensed physician may be required by his department head to substantiate
a request for sick leave for the following reasons:
(I) Any period of absence consisting of five or or more consecutive
working days.
(2) To support a request for sick leave during a period when the
employee is on vacation leave.
(3) Leave of any duration if absence from duty recurs frequently or
habitually provided the employee has been notified or warned that a
certificate will be required.
(d) Maximum Allowable Accumulation - Sick leave may not be accumulated
in excess of 60 days.
(3) When Earned Sick Leave is Exhausted. - No sick leave in excess
of the leave accumulated to the employee's credit may be granted unless
such sick leave advance is specifically authorized by the Mayor and
council upon recommendation of the department head and Personnel)

IRE: BUSINESS LICENSE APPROVED FOR TL PEST CONTROL

Mayor Porter read a letter from TL Pest Control asking permission
for. them to operate an answering service for their business from a
home. They would only take calls from this location; at no time will
chemicals or related materials be stored in the area. Councilman
Barton Jensen moved they be approved to purchase a business license.
Councilman Morgan Garner seconded.

RE:ARCHITECTS PRESENT P. U. D. PLAN TO COUNCIL
Mr. Jensen and Mr. Hancock, Architects from Pocatello, presented a
P.U.D. plan to the Council. Planned Unit Development is a new idea in
subdivision planning. They explained the idea to the council and
showed a short film showing this new concept.
IRE: PETITION PRESENTED FOR 2 HOUR PARKING ON MAIN STREET BETWEEN 2nd & 3rd EAST
A petition was presented to the Council asking that two hour parking
enforcement be started on Main Street between 2nd and 3rd East.
Councilman Barton Jensen moved that the Council allow two hour parking
enforcement on~both sides of Main Street from 2nd East to 3rd East.
Councilman Morgan Garner seconded.
