(~ STATE OF IDAHO, ) (SS County of Madison,) A special meeting of the Clty Council of the City of Rexburg, Madison County, Idaho, was held on Wednesday, the 28th day of January, 1976, at the hour of 7 o'clock P. M. at the City Hall, this being the regular meeting place of said Council, at which meeting there were present and answering roll call the following who constituted a quorum: Mayor: John C. Porter Councilmen: George Catmull Nile Boyle Darlene Blackburn Barton Jensen Warren Porter Morgan Garner Absent: None Also Present: Afton Anderson, City Clerk Mary Smith, City Attorney Clayter Forsgren and John Millar of Forsgren & Perkins, City Engineer. Thereupon the following proceedings were duly had and taken: The Mayor stated this was an adjourned meeting of the one held December 22, 1975, to consider protests and objections to the assessment roll of Improvement District No. 22 and also to the regularity of the proceedings and the correctness of the assessments, the .amount levied on the particular lot or parcel in relation to the benefits accruing thereto, and in relation to the proper proportionate share of the total cost of the improvement. E: FLORENCE J. WEEKS & EMMA WEEKS The matter of the protest of Florence J. Weeks and Emma Weeks, No. 6, was discussed. It was moved by Nile Boyle, seconded by Morgan Garner and unanimous) carried that the assessments for sanitar y y sewer be reduced by 125 lineal feet, leaving a total assessed frontage of 205. feet. E: SLLAS CLEMENTS, N0. 7 The oral objection of Silar Clements, No. 7, was considered. It was moved by Warren Porter, seconded by Morgan Garner and unanimously carried that inasmuch as Mr. Clemts' property had 'heretofore been assessed for sewer that the amount he had paid $127.00 be deleted from the present assessment. ~E: R. V. CANTWELL, NO 2~ The Council discussed the written protest of R. V. Cantwell, No. 24. It was moved by Barton Jensen, seconded by Nile Boyle and unanimously carried that his protest be denied. ~2E• GARY GAMBLE N0. 62 The written protest of Gary Gamble, No. 62, was discussed and considered. It was moved by Nile Boyle, seconded by Barton Jensen and unanimously carried that his protest be denied. ~E: ROBERT WOODMANSEE, NO 64 After consideration and discussion of the written protest of Robert Woodmansee, No. 64, it was moved by Barton Jensen, seconded by Nile Boyle and unanimously carried that his protest be denied. RE: BILL MOSS N0. 67 The written protest of Bill Moss, No. 67, was discussed and considered. It was moved by Barton Jensen, seconded by George Catmull and unanimously carried that his protest be denied. RE: IRE: IRE IRE IRE ~~ R. J. RHEES, N0. 69 The written protest of R. J. Rhees, No. 69, was discussed and considered. It was moved by Barton Jensen, seconded by Nile Boyle and unanimously carried that his protest be denied. L. D. S. CHURCH N0. 77 The protest of the L. D. S. Church, No. 77, was discussed and considered. The City advised its representatives that the City would fix the ditch going through its property. It was moved by Warren Porter, seconded by Morgan Garner and unanimously carried that the assessment for asphalt paving be reduced from the assessed width of 17 I/2 feet to 10 feet. ZIRKER, N0. 72, WEBSTER N0. 73, HUNTER N0. 74, POND, N0. 75, SMITH, NO 76 SMITH N0. 78, AND SMITH N0. 79 In discussing and considering the protests of John Zirker, No. 72, Michael A. Webster, No. 73, Glen R. Hunter, No. 74, Glen S. Pond, No. 75 Gordon Smith, No. 76, J. Fred Smith, No. 78, and Orson Smith, No. 79, it was moved by Warren Porter, seconded by Morgan Garner and unanimously carried that the assessments for asphalt paving be reduced from an assessed width of 17 I/2 feet to an assessed width of 10 feet. K. MERLE JEPPESEN, N0. 59 K. Merle Jeppesen, No. 59, appeared to orally protest the cost of his improvements. The matter was discussed and considered by the Council. It was moved by Darlene Blackburn, seconded by Nile Boyle and unanimously carried that his protests be denied. CRAMER, NO 45, 47, WIDDISON NO 42, PETERSON, N0. 46, FOWLER, N0. 44, Parkinson, no. 43, HERDTI N0. 49, BENSON, N0. 52, THOMPSON N0. 50 Imogene Cramer, Nos. 45 and 47, appeared to orally protest the costs of the proposed improvements to her property on North Harvard Avenue. Other Property owners on North Harvard Avenue were present, as follows: Howard Widdison, No. 42, LuSeba Peterson, No. 46, Wm Fowler, No. 44, Morris Parkinson, No. 43, R. G. Herdti No. 49, Max Benson, No. 52, Ralph Thompson, No. 50. The matter was discussed at great length by all of the above property owners and the Council. On motion by Mrs. Cramer duly seconded and carried, a vote of said property owners was taken as to whether or not they wanted to continue with the improvements. Four voted for the im- provements and three against. The Mayor suggested that the cost of the street paving could be reduced by about one-half by using soil cement rather than aspahlt. After discussion and consideration by the council, it was moved by Barton Jensen, seconded by Morgan Garner and unanimously carried that the following adjustments be made: Morris D. Parkinson, No. 43, assessment for asphalt be reduced one-half and that the sewer assessment be reduced from $2,447.28 to $1,991.78. Wm. Fowler, No. 44, assessment for asphalt be reduced 50%. Assessment for water and sewer be reduced from $3670.92 to $2786.42. Howard J. Widdison, No. 42: Assessment for asphalt paving be reduced by 50% Assessment for water and sewer be reduced from $472.00 to $352.00. Imogene Cramer, No. 47: Assessment for asphalt reduced by 50%. Assessment for water and sewer reduced from $3365.01 to $2996.01. Jerome S. Garrick, No. 48: Assessment for asphalt reduced 50% Assessment for water and sewer reduced from $2174.04 to $1899.52. R. G. Herdti, No. 49: Assessment for asphalt paving reduced 50%. Assessment for water and sewer reduced from $2171.04 to $1899.52. Ralph A. Thompson, No. 50: Assessment for asphalt paving reduced 50% Assessment for water and sewer reduced from $1529.55 to $1451.38. Charles M. Grant, No. 51: Assessment for asphalt paving reduced 50~. IRE: CORDON SMITH ASKS FOR REDUCTION .~.,~ Gordon Smith asked the Council to reduce the charge for his street on LID 22. He stated that street was only 35 foot wide. Councilman Barton Jensen moved that in as much as this has been discussed before, we wait until after the budget is set to see how we stand. Councilman Nile Boyle seconded. All Aye RE• HARVARD AVENUE RE: APPOINTMENTS TO AIRPORT BOARD Councilman Nile Boyle moved that we include Harvard Avenue on the LID, not charging water and sewer on the corner lots. The city will pay for the corner lots and half on the paving. Councilman Darlene Blackburn seconded. All Aye Councilman Barton Jensen moved the following appointments be made to the airport board. Gary Ball, I yr., Arthur Porter appointed member by City and County 2 yr, Jim Meikle, 3 yrs. Councilman Nile Boyle seconded. A I I Aye IRE: APPOINTMENTS MADE ON CITY PLANNING BOARD Councilman Barton Jensen moved the following appointments be made on the City Planning Board. Alice Tout and Ann Weber are reappointed. Councilman Warren Porter seconded. All Aye ~E: LETTER NOTIFYING CITY OF SUIT Mayor Porter read a letter notifying the City of a suit being filed against them. City Attorney, Mary Smith will write them a letter denying the Cities liability. There being no further business or written or oral protests to come before the meeting, it was moved, seconded and unanimously carried that the meeting adjourn. ~~ ~~ or, hn C.
