Robert Woodmansee, No. 64, filed a written protest and also appeared
in person, protesting that the cost of the improvements to his property
way about twice what it should be. The matter was discussed and the
Mayor told Mr. Woodmansee the council sould take it under advisement
and make its decision at the special meeting to be held January 28, 1976.
Mr. Harrop of Intermountain Block & Pipe Co., No. 13, made a verbal
protest (no Written protest) that the property was isolated and would
receive no benefits from any of the proposed improvements.
Thomas and Zola Forsgren, No. 10, filed a written protest pointing
out that their property would receive no benefits from any such
improvements.
Garnett Beardall, Nos. II and 12, also filed a written protest that
her property would receive no benefits.
The Mayor told Mr. Harrop, Mr. and Mrs. Forsgren and Mrs. Beardall that
the Council would take their protests under consideration and make a
decision at the meeting to be held January 28, 1976.
Mrs. Florence J. Weeks, No. 6, appeared in person in support cf her
written protest. After discussing the matter with her the Mayor
stated the council would take it under consideration and make its
decision at the meeting to be-held January 28, 1976.

R. J. Rhees, No. 69, appeared in support of his written protest. After
a lengthy discussion, the Mayor stated the Council would consider the
matter and make its decision at the meeting to be held January 28, 1976.
Gordon Smith, No. 76, although he had filed no written protest, stated
he was protesting the assessment for the street, that it was torn up
when the new high school was constructed and that the City should make
an adjustment. The matter was discussed at considerable length and the
Mayor advised Mr. Smith the council would take it under advisement and
make its decision at the meeting to be held January 28, 1976.
It was moved by Barton Jensen, seconded by Morgan Garner, that inasmuch
as it was so late the meeting be adjourned to January 28, 1976, at
which time the remainder of the protests would be considered and that
everyone would be welcome and encouraged to meet with the council at
that time. Unanimously carried.
The Mayor thereupon declared the meeting adjourned to January 28, 1976,
at 7 o'clock P.M. at the City Hall and ordered copies of the protests
to be attached to these minutes.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
A regular meeting of the City Council of the City Council of the City
of Rexburg, Madison County, State of Idaho, was called to order by
Mayor Porter, at 7:30 P. M. January 7, 1976.

Councilman Warren Porter moved the minutes be approved.

RE: PROTESTS ON LID 22 DISCUSSED

Mayor Porter reported that he had met with City Engineer, Clayter Forsgren
to discuss the protests on LID 22. Mayor Porter gave the written protests
to the Engineer to investigate. He suggests having a special meeting to
go through the protests and answer. He did investigate the bids that
were obtained in Rigby and Idaho Falls in the last two years and found
that the bids were let two years ago before the costs were raised so
high. At this special meeting the engineer will have answers for the
protests and the council will give consideration to all protests.
DITCH GOING CHURCH PROPERTY NEEDS TO BE FIXED
The ditch going through `f°he church property was discussed. The ditch is
crooked and angles of 5 feet into the property. Mayor Porter explained
that the ditch was dug in a real hurry as the cold weather was setting in;
the ditch will be put in right as soon as the weather permits.
~ RE: NEW LAW STATING CITIES AND COUNTIES HAVE TO HAVE A PLANNING BOARD
Mayor Porter reported on the meeting with the County Commissioners.
There has been a new law passed which requires the Cities and Counties
to have a planning board. He suggests cooperation between the two.
The City could keep their present board and the county could hire their
own board and the two would work together on all the joint problems.
The County would have to draw up ordinances and be under the same
jurisdiction of the City ordinances. Councilman Nile Boyle moved that
a joint City and County Planning Board be organized. Councilman Morgan
Garner seconded.

R SERVICE AGREEMENT BETWEEN CITY AND SCHOOL DISTRICT OF MAINTENANCE OF PARK
City Attorney, Mary Smith, read the joint service agreement between the
City of Rexburg, and the Madison School District as to the use and
maintenance of the new park. It is very similar to the other agreement.
It does provide that _i.t is perpetual unless discolved by agreement of
both sides. Councilman Barton Jensen moved the Mayor be instructed to
sign the agreement. Councilman Warren Porter seconded.

RE: BUILDING PERMIT REPORT
The building permit report for 1957 shows that 170 permits were issued
for building during the year whereas 142 were issued in 1974. The total
cost was $4,061,533 in 1975 and $4,882,891 in 1974. The reason the dollar
cost were down is that the post office, school, and churchs are not
required to have permits. There was actually a lot more building done
this year than 1974.

Councilman Barton Jensen moved that the bills be approved for payment
in the amount of $68,206.85. Councilman Nile Boyle seconded.

~ RE: WATER DEPARTMENT TO PUT IN FIRE HYDRANTS
Mayor Porter reported that the fire hydrants which were to be put in
by H & K contractors are going to be put in by our water department.
He believes the cost of having H & K to do them would be three times
as much.

RE: COUNCILMAN GLENN PETERSON IS RETIRING
Councilman Glenn Peterson is retiring after 12 years, on the Council.
Mayor Porter presented him with a plack and thanked him for his years of
service. Councilman Glenn Peterson thanked the Council for the opportunity
of working with them.
RE: NEW COUNCILMAN AND COUNCILWOMAN
The two incumbents Barton Jensen, and Warren Porter, and the new
Councilwoman, Darlene Blackburn, were sworn in by City Attorney,
Mary Smith.
New Councilwoman, Darlene Blackburn takes her position on the
Council.
1 RE: ORDINANCE 568
AN INTERIM ORDINANCE APPROPRIATING SUFFICIENT FUNDS FOR PAYMENT OF
EXPENSES AND SALARIES BY THE CITY OF REXBURG, IDAHO, DURING THE
1976 FISCAL YEAR PRIOR TO THE PASSAGE AND APPROVAL OF THE ANNUAL
APPROPRIATION ORDINANCE; PROVIDING WHEN THE ORDINANCE SHALL BECOME
EFFECTIVE.
Thereupon it was moved by Councilman Warren Porter and seconded by
Councilman George Catmull that the rule requiring ordinances of a
general and permanent nature to be read fully and distinctly on three
different days be dispensed with and that said ordinance be numbered
568 and be passed and adopted as read.
Threupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by
not less than three-fourths of the Council, had been duly carried, and
the Ordinance No. 568 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 568 in
at Least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
I RE: COUNCILMAN HEAD OF COMMITTIEES
The committiees will not be changed for the time being. Mrs. Blackburn
will take over the Police and Fire Committee which was previously
chairmaned by Glenn Peterson. The City Attorney, Mary Smith, stated that
this was a first for Rexburg. We have never had a female Police
commissioner before.
Councilman Warren Porter moved that Councilman Barton Jensen has
done such a good job this year as the President of the Council that he
will remain in the position another term. Councilman Nile Boyle
seconded.

~ RE: COLLEGE WANTS TO JOIN WITH THE CITY ON FLOOD CONTROL
Mayor Porter met with the college and city engineer. The college is
building a fine arts building and doubling the size of Manwaring
Center this year. They are concerned with the flood problem that
Rexburg has. They want io joim with the City on flood control master
plan to put in more storm se~aers all over the City. They also want
to close off the old City ditch that runs through the campus. Council-

man Morgan Garner moved that we work together to put (looms and storm's
sewers where they are needed. Councilman Barton Jensen seconded. ~,~~
All Aye. The engineer will be in with a cost estimate soon.
RE: ADAMS SCHOOL ASKS FOR HELP WITH SNOWREMOVAL
Mrs. Messer of the Adams School PTA asked the Council for help with
their snow problem. The snow plows put a role of snow onto the
sidewalk around the school. The Cities sidewalk plow will not move it
as it is just to smell to be able to move the heavy snow. The little
elementary students have to walk out on the highway because the
sidewalk is filled in. They are really concerned for the safety of
these children. Mayor Porter advised Mrs. Messer that the City will
have to find something heavier that will move the snow off of those
sidewalks. They will get the sidewalks cleared as soon as possible.
IRE: NEED OF SNOW EQUIPMENT
Discussion as to the need for more snow equipment. We need more
trucks and plows. The county is selling some trucks. Morgan will
check into the price and condition of the trucks. He will also check
the cost of the big snow blowers.
IRE: DON RICKS WANTS TO PUT PAINTINGS IN COUNCIL ROOM
Don Ricks wants to put paintings in the council room. He rents them
for $5.00 per month each. The council felt this was an unnecessary
expense.
IRE: GAMBLES FENCE
Mayor Porter reported that the deadline on the fence at Gambles was
January IOth. If the fence is not removed by then, the City
crews will take it down.
RE: GARBAGE PROBLEM IN ALLEY BEHIND GREENS RESTHOME
Discussion on the garbage problem in the alley behind Greens Resthome.
Vern Anderson does not have adequate containers for his garbage. The
students in his apartments throw their garbage all over the ground.
People all along that alley are complaining. Mayor Porter suggests
making them put a bin there and have it picked up real often to clean
up that mess.
Councilman Barton Jensen moved that the meeting be adjourned. Councilman
Morgan Garner seconded.
