MEETING OF THE CITY OF REXBURG, IDAHO
A sp~~~a.l meeting of the City Council of the City of Rexburg, Madison
County, Idaho, was held on Monday, the 22nd day of December,
1975, at the hour of 7 o'clock P. M. at the City Hall, this being the
regular meeting place of said Council, at which meeting there were
present and answering roll call the following who constituted a quorum:
Mayor: John C. Porter
Councilmen: George Catmull
Nile Boyle
Glenn Peterson
Barton Jensen
Warren Porter
Morgan Garner
Absent: None
Also Present: Afton Anderson, City Clerk
Mary Smith, City Attorney
John Millar of Forsgren &
Perkins, City Engineer
Thereupon the following proceedings were duly had and taken:
~ RE: MINUTES APPROVED
The minutes of the previous meeting were read and discussed. Councilman
Glenn Peterson moved the minutes be approved as corrected. Councilman
Nile Boyle seconded.

~ RE: BEER LICENSES APPROVED
Beer licenses were submitted for approval, for the B. J. Bar and the
Stephensons Groc. Councilman Glenn Peterson moved the licenses be
approved. Councilman Barton Jensen seconded.

~ RE: JOINT SERVICE AGREEMENT WITH SCHOOL ON NEW PARKS AND PLAYGROUND
Mayor Porter reported on the joint service agreement with the school
district on the new parks and playground by the highschool. The City
crews will maintain the park in the summer months and the school will
maintain during the school months. Mayor Porter gave the service
agreement to the City attorney to go over. The council will make the
decision in the next meeting.
~ RE: PEOPLE INTERESTED IN RENTING PARKING SPACE BEHIND FIRE DEPARTMENT
Mayor Porter advised that there are a couple of people interested in
renting a parking space behind the fire department. The council agreed
that if the space is available, the Mayor should negotiate.
RE: STREET LIGHTS NEEDED
Mayor Porter reported that Utah Power & Light has given him a survey
showing the locations where the city needs street lights. Mayor
Porter has discussed the list with Chief of Police, Blair Siepert
and they are in agreement. The places suggested are:
Park Street- 2 at West end.
Starlite Addition- 6 lights
Ricks Wade Addition- one at each
Edith Circle- one at each end
College tennis courts - one
4th East and Main
Morgan Drive- one each end
intersection - 9 lights
This makes a total of 26 lights. Councilman Barton Jensen moved that
the city have the lights put in. Councilman Nile Boyle seconded.

RE: CHIEF SIEPERT REPORTS ON VACANT HOUSE
Mayor Porter read a letter of recommendation from Police Chief, Blair
Siepert, concerning the vacant house on North second west. The ~~
residents in that area want the house removed. Councilman Nile Boyle
moved that the city attorney write them a letter. Councilman Barton
Jensen seconded.

The City Clerk reported that she had caused to be mailed to all property
owners within the limits of said Local Improvement District No. 22 a
notice of the filing of assessment roll and opportunity to file written
objections thereto and of the time and place of hearing written objections
to said assessment roll by parties aggrieved and time and place of hearing
all objections to the regularity of the proceedings making such assessments,
the correctness of assessment, the amount levied on the particular lot
or parcel in relation to the benefits accruing thereon, and in relation
to the proper proportionate share of the total cost of the improvement,
al.l pertaining to the Local Improvement District No. 22, in Rexburg,
Madison County, Idaho, that said notice mailed to each property owner
stated the amount of the individual assessments, and that she had made
and executed her affidavit of mailing said notices. That she had also
caused to be published as required by law, said notice in one issue of
the Rexburg Standard and had received and filed in her office the
Affidavit of Publication of said notice.
The Mayor announced that the meeting had been called for the purpose of
the City Council hearing and considering objections to the assessment
roll for Local Improvement District No. 22 which assessment roll was
filed in the office of the City Clerk December 3, 1975, and is now on
file therein, and that the Council would also hear all objections to
the regularity of the proceedings making such assessment, the
correctness of assessment, the amount levied on the particular lot or
parcel in relation to the benefits accruing thereon and in relation to
the proper proportionate share of the total cost of the improvement,
all pertaining to the Local Improvement District No. 22 in Rexburg,
Madison County, Idaho.
The following objections were heard by the Council:
William Fowler, No. 44, did not file a written objection against the
proposed improvements on North Harvard Avenue, but made a verbal
protest stating the cost of the proposed improvements was too high and
also unnecessary.
Howard Widdison, No. 42, representing himself and LuSeba Peterson
(Abner Widdison property), No. 46, made a verbal protest (no written
protest) re North Harvard Avenue improvements, principally because of
difference in surveys for curb and gutters on the east corner of his
property going North which he had previously done and the present
survey for curb and gutter for the proposed improvement.
Morris Parkinson, No. 43, who had property on North Harvard stated
(no written protest) he thought the costs were too high. Jerome
Garrick, No. 48, also with property on North Harvard, stated (no
written protest) he was for improvements within reason but didn't
think street paving necessary.
Max Benson, No. 52 (no written protest) with property on North Harvard
protested the cost.
The matter of the protests of the North Harvard property owners was
discussed at great length. The Mayor stated the protests would be
given further consideration at a special meeting to be held January 28,
1976, at 7 o'clock P. M. and invited all of the Protestants to return.

Robert Woodmansee, No. 64, filed a written protest and also appeared
in person, protesting that the cost of the improvements to his property
way about twice what it should be. The matter was discussed and the
Mayor told Mr. Woodmansee the council sould take it under advisement
and make its decision at the special meeting to be held January 28, 1976.
Mr. Harrop of Intermountain Block & Pipe Co., No. 13, made a verbal
protest (no Written protest) that the property was isolated and would
receive no benefits from any of the proposed improvements.
Thomas and Zola Forsgren, No. 10, filed a written protest pointing
out that their property would receive no benefits from any such
improvements.
Garnett Beardall, Nos. II and 12, also filed a written protest that
her property would receive no benefits.
The Mayor told Mr. Harrop, Mr. and Mrs. Forsgren and Mrs. Beardall that
the Council would take their protests under consideration and make a
decision at the meeting to be held January 28, 1976.
Mrs. Florence J. Weeks, No. 6, appeared in person in support of her
written protest. After discussing the matter with her the Mayor
stated the council would take it under consideration and make its
decision at the meeting to be held January 28, 1976.

R. J. Rhees, No. 69, appeared in support of his written protest. After
a lengthy discussion, the Mayor stated the Council would consider the
matter and make its decision at the meeting to be held January 28, 1976.
Gordon Smith, No. 76, although he had filed no written protest, stated
he was protesting the assessment for the street, that it was torn up
when the new high school was constructed and that the City should make
an adjustment. The matter was discussed at considerable length and the
Mayor advised Mr. Smith the council would take it under advisement and
make its decision at the meeting to be held January 28, 1976.
It was moved by Barton Jensen, seconded by Morgan Garner, that inasmuch
as it was so late the meeting be adjourned to January 28, 1976, at
which time the remainder of the protests would be considered and that
everyone would be welcome and encouraged to meet with the council at
that time. Unanimously carried.
The Mayor thereupon declared the meeting adjourned to January 28, 1976,
at 7 o'clock P.M. at the City Hall and ordered copies of the protests
to be attached to these minutes.

A regular meeting of the City Council of the City Council of the City
of Rexburg, Madison County, State of Idaho, was called to order by
Mayor Porter, at 7:30 P. M. January 7, 1976.
