MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO A r lar meeting of the City Council of the City of Rexburg, Madison Coin State of Idaho, was called to order by Mayor John C. Porter, at 7:30 P. M. on December 3, 1975. Mayor: John C. Porter Councilman: George Catmuil Nile Boyle Warren Porter Barton Jensen Morgan Garner Absent: Glenn Peterson Also Present: City Attorney, Mary Smith City Clerk, Afton Anderson IRE: MINUTES APPROVED The minutes of the meeting were read and discussed. Councilman Nile Boyle moved the minutes be approved as corrected. Councilman Barton Jensen seconded. All Aye ARE: MOUNTAIN BELL TELEPHONE REQUESTS ABANDONMENT OF EASEMENT Mountain Bell telephone has requested the abandonment of an easemernt that the City now has on the north side of their present building on North Center. They wish to expand their building accross this present easement. Mayor Porter stated that there now was an established alley on the South side of their building so there really was no need for this easement. Councilman Barton Jensen moved that the City Attorney, Mary Smith be instructed to get the legal description and proceed with necessary documents to make the present alley a dedicated public alley and to abandon the easement on the South of Mountain Bell building. Councilman Warren Porter seconded. All Aye IRE: MILTON TAYLOR GRANTED VARIANCE FOR A FOOT Milton Taylor needs a variance to build a house 56 feet by 50 feet on a corner lot with 80 feet of frontage. As it is a corner lot there must be 25 foot clearance on the side as well as the front. He is one foot short on the side. Councilman Morgan Garner moved that he be granted a variance for a foot. Councilman Nile Boyle seconded. All Aye IRE: SNOW REMOVAL PROBLEM Mayor Porter reported that there has been a problem with snow removal. The people with large parking lots are having the snow cleaned off their,. lots and pushing it out into the street causing a traffic hazard. We must set some standards. Some lots make a large pile on their lot and then have it hauled off later. Others push all the snow into the street. In some cases the plows have just cleaned off the street and must go back to remove the snow that has been pushed into the street. Mayor Porter stated that the city crews do haul off this snow that has been stockpiled in the lots after they catch up with the street clearance. He suggested that the City should haul for anyone willing to pay the price. They must call City Hall and request the service; which be charged on their water bill. All Councilmen agreed that the City should then fine for anyone pushing their snow into the street. IRE: JON RAY ASKS OF PLANS OF PUTTING SIDEWALKS ON LID FOR STREET IN FRONT BUSINESS Jon Ray asks Council if their is any plans of putting sidewalks on an LID for the street in front Sober Society. Mayor Porter states that it is too late to put it on this LID but we will keep it in mind for the next one. RE: ENGINEER WITH CMZ BOISE WITH THE IDAHO TRAFFIC SAFETY COMMISSION GIVES PRESENTATION ON SAFETY STUDIES Mr. Bromwell, a civil engineer with CMZ Boise, with the Idaho Traffic Safety Commission gave a presentation to the council on the safet~r ~ studies they are now doing in some cities. There is a grant that will pay 77/ of the costs of such a survey. The cost for Rexburg w©uld be between $18,000 and $24,000. Mayor Porter stated that after the new State Highway is completed there will be a great change in the cities traffic problem. It would be more advisable for us to wait until we know what the problems will be before we have a survey. We are however, trying to activate our safety commission to help with any problems that may arrise. RE REXBURG IRRIGATION COMPANY HAS AGREEMENT WITH CITY TO LET THEM LEASE WATER RE: A. KNUTSON PROTESTED TO COUNCIL ON THE TRAILER HOUSE ORDINANCE Rexburg Irrigation Company, in 1967 they made a agreement with the City of Rexburg to let them lease any water that the City is not using. They had heard the City was leasing water to others. Mayor Porter advised that we were not aware of the agreement but we will put into our minutes now that at the time the leases already signed expire, that the City will offer Rexburg Irrigation all their excess water for lease. We are now committed to two leases but will not renew them. A. Knutson protested to the council on the trailer house ordinance that was passed several years ago. This ordinance gave the trailer courts until July 1976 to comply with the regulations in this ordinance. Mr. Knutson feels that this ordinance is way out of line. He was lead to believe before the ordinance was passed that this would apply only to new courts going in and would not make existing courts comply. He feels the expense involved would be excessive and not necessary. Councilman Warren Porter asked Mr. Knutson to make a list of the things in the ordinance that he is against and present the list to the Council. The council will then take it underadvisement. Councilman Morgan Garner seconded. All Aye RE KNUTSON ASKS WHERE CITY IS GOING TO PUT BRIDGE ACROSS CANAL Mr. Knutson asked where the council intended to put this bridge across the canal. This is being studied now. Mr. Knutson asked if he gives an easement across his property, will the city fence off the corner from his trailer court. Mayor Porter says I'm sure we would. RE: RESOLUTION #2 SETTING PROTEST HEARING FOR THE ASSESSMENT ROLL ON LID 22 Councilman George Catmull introduced resolution #2 setting the protest hearing for the assessment roll on LID 22 for December 22, 1975, at 7:00 P. M. Councilman Morgan Garner seconded. All Aye RE: SCHOOL DISTRICT TO START PAYING FOR USE OF PARKS Mayor Porter reported on the meetings he has attended with the Madison School District. They want to change their plans for the park now and want to restrict the use of it. Mayor Porter stated that they have used our parks free of charge for 30 years, but they were going to have to start paying a charge for use of them for activities where admission is charged. tf~ Bilis Approved Councilman Morgan Garner moved we approve the bills for payment.
