MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Minutes of the regular meeting of the Rexburg City Council held November 5,
1975, at the City Hall in Rexburg, Idaho. Present were Mayor John C.
Porter, Councilmen Glenn Peterson, Warren Porter, George Catmull, Morgan
Garner, Barton Jensen, and Nile Boyle. Also present were members of the
news media, and City Attorney, Mary Smith. Minutes were taken by
Afton Anderson, City Clerk.
IRE: ZONING CHANGE FOR WESTERN STATES DEVELOPMENT APPROVED BY PLANNING BOARD
Mayor Porter reported that the planning board has approved the zoning
change for Western States Development. The property needing changed is
between 4th & 5th West and 7th South. Councilman Gelnn Peterson moved
the City Attorney be instructed to set up a rezoning hearing. Councilman
George Catmull seconded.

IRE: LOU DAVIDSON GIVEN PERMISSION TO PUT CONCRETE DRIVEWAY ONTO CENTER
Mrs. Lou Davidson is buying property owned by Gary Gladwin. The property
is in a commercial zone. The garage is in the back of the house, where
the entrance is to the alley. She wants a concrete driveway onto
Center street adjacent to the property of Jim Barrett Sr. Councilman
Barton Jensen moved that permission be given as the property is in a
commercial zone and there are no regulations against this. Councilman
Glenn Peterson seconded.

IRE: PAT MOORE GIVEN LICENSE TO OPERATE A SHELTER HOME
Pat Moore, with two gentlemen from the Public Health Department,
requested a business license. Moores have purchased the Jeppson property,
which is in a commercial zone. They wish to operate a shelter home.
They have been licensed by the state. Councilman Nile Boyle moved
that Mrs. Moore be given license to operate the shelter home as long as
they meet all state requirements. Councilman Morgan Garner seconded.

IRE: VOTES CANVASSED
Councilman Glenn Peterson moved that as all the votes were canvassed and
correct, the count of election becomes official. Councilman Nile Boyle
seconded.

IRE: REZONING FOR MANWARING PROPERTY TAKEN UP AGAIN PEOPLE DECLINE PROPOSAL
Manwarings: Mr. Gordon Thatcher went over the proposal map and
submitted proposal. Mayor Porter asked for two-thirds vote of people in
residential zone within 400 feet radius of property to be changed. Mr.
MaNemara has taken up with people he represents. They wish to decline and
that is their stand now. People voiced opinions as to value of their
property. Mayor Porter asks if the people couldn't work out some kind
of an agreement.
Mr. Thatcher suggests a restrictive covenent which would stop any further
encroachment into the residential area. Councilman Nile Boyle stated
that he thought it was ridiculous to keep a piece of property zoned so
that it could not be used. This property could not be used for anything
else. Councilman Boyle then moved that the decision be postponed for
two weeks. If the people and two attorneys do not come up with an agreement,
the council will then decide their awn plan. Councilman Glenn Peterson
seconded.

IRE: 5th WEST TO BE CLOSED DURING WINTER MONTHS FOR CUTTER RACES
The Cutter Association has been using the track by closing north 5th West
during the winter months. Last year was closed just Saturday. This is
a problem with the traffic making ruts in the track. The City crew then has
a lot of maintenance to put the track back in shape. The people in the Ricks
Wade Addition do not want the road closed. Mayor Porter agreed that they
could close the road this year but they must come up with another route
next year so that this street does not have to be closed.
ARE: GARY BUELL AND BOB GENTRY PRESENTS FINANCIAL REPORT
Gary Buell and Bob Gentry presented a financial report on the summer
recreation and swimming pool. There were a lot of problems and expenses
this year, mostly due to the merry-go-round and pool having so much work
done on them. Gary Buell asked the Council to please get the swimming
pool fixed this winter so that it would be ready to go first thing next
summer. Without a competent pool man to fix all the broken lines, boiler,
filtering system, and anything else that isn't working, there is not going
to be a swimming program this summer. Mayor Porter said he would call that
pool man again and get him here this month.

Nile Boyle seconded.

A regular meeting of the City Council of the City of Rexburg, Madison
County, State of Idaho, was called to order by the Acting Mayor,
Councilman Barton Jensen, in the absence of Mayor Porter at 7:30 P. M.
on November 19, 1975.
