Porter, at 7:30 P. M. on September 3, 1975, at the City Hall at Rexburg, Idaho, there being present the following: Mayor: Councilman: Absent: Also Present: IRE: MINUTES APPROVED John C. Porter Barton Jensen George Catmull Nile Boyle Warren Porter Morgan Garner Glenn Peterson Mary Smith, City Attorney Afton Anderson, City Clerk News Media ., The minutes of the previous meeting were read and discussed. Councilman Barton Jensen moved the minutes be approved as corrected. Councilman Nile Boyle seconded. All Aye IRE: SEWER DAMAGE J ;~ Mayor Porter reports that the sewer backed up on 2nd South and did damage to a couple of homes. One house was owned by Reva Rich and is rented to college students. She requested that the City help pay damages. Mayor Porter felt that the city should participate in the cost of clean- ing as we have in the past. Councilman George Catmull moved that the Mayor be given permission to work out equitable refund for Mrs. Rich. Council- man Nile Boyle seconded. All Aye IRE: PROBLEMS WITH STEPDOWN CLUB Mayor Porter reports on the problems at the Step Down Club. Police Chief Blair Siepert asks that it be closed down on Sundays. The people living in that area are really complaining about the noise and distrubance. City Attorney, Mary Smith will check into the matter and advise. IRE: KEVIN NANNEY GIVEN PERMISSION FOR BUSINESS LICENSES Kevin Nanney asked for a business license to operate a business at 49 College Ave. He wants to have a barber stylist shop in the back and a retail record, tape, and etc., sales in front. He would cater mostly to Ricks College students. Councilman Barton Jensen moved that the City issue a business license to Mr. Nanney, Councilman Warren Porter seconded. All Aye R REPORT ON WATER PROJECT Mr. Jim Keller of Forsgren & Perkins, presented a report on the water project. The projected costs and alterations were explained by Mr. Keller. 'RE: DISSATISFACTION WITH NEW ADDITION TO THE PINEVIEW APARTMENTS EXPRESSED Mr. John Barnes expressed dissatisfaction with the construction of the new addition to the Pineview Apartments. There was to be only a walkway through to the other street. The students are now using it for a through street. This is causing concern by neighbors in that area. Mrs. Ellis wants the fence put in as promised, to keep the students from crossing her property. Mr. Saxton removed some sections of curb and sidewalk. They want to see them put back in. Mayor Porter assured Mr. Barnes that Mr. Saxton has promised to take care of these problems. IRE: ~; LETTER FROM E. D. A. Mayor Porter read a letter .from E.D.A. and explained what it was. There are 9 counties participating. Lemhi, Custer, Jefferson, Bonneville, Clark, Madison, Fremont, Teton, and Butte. The purpose of this organi- zation is to obtain federal projects for cities or counties in this East-Central Idaho Planning and Development Association. They will have an office in Rexburg. There will be a sealing of $1,000 per year. They would do all the paper work concerning our Federal Grants. Councilman Barton Jensen moved that when time is appropriate the Mayor be instructed ^ to join. Councilman Morgan Garner seconded. All Aye IRE: RICKS & LANDON TOWNHOUSE PLAZA APPROVED Dean Ricks presented a plat for condominians, 43 units. He has supplied more parking space and taken out the Culdesac since the other plat was turned down. Councilman Nile Boyle moved that Mayor Porter sign and approve Ricks & Landon Townhouse Plaza. Councilman Barton Jensen seconded. All Aye IRE: DRAIN ON 4th EAST TO BE APPROVED John Millar, Engineer reports that the drain on 4th East has only a 4 inch fall, which will be inadequate. Mayor Porter suggested making arrangements with Ted Garner to run flume into gravel pit. They were receptive. If the city could dump water there they could agree to keep place clean. Mayor will try to make agreement. IRE: GENE PALMER PROTESTS ANNEXATION OF HIS PROPERTY Gene Palmer protested the annexation of his property. Mr. Palmer did not know that any of his property had been annexed until he received his tax notice. It showed that 2.6 acres had been annexed to the City. This had been done with no totices being sent to'him. City attorney Mary Smith will check and start correction. IRE: DISCUSSION OF THE EAST REXBURG STAKE CENTER STOP SIGNS Discussion of the East Rexburg Stake Center stop signs. After discussion the Council agreed that the through street should be 4th East and have stop signs the other eay on 3rd South. Councilman Warren Porter moved that we follow the Police recommendations and put the stop signs on 3rd South and let 4th East be a through street. Councilman Morgan Garner seconded. All Aye ARE: A NUISANCE PROCLAMATION TO MRS. DELLA PARKINSON City Attorney Mary Smith read nuisance proclamation to Mrs. Della Parkinson, to remove all but 5 cats and to clean yards and outbuildings by Sept. 17. If it has not been taken care of the City will levy special assessment against the property and do so. IRE: STREET SUPERINTENDENT REPAIRING BRIDGES Mayor Porter reports that Street Superintendent, Dan Moulton, is repairing some bridges. Councilman Morgan Garner suggests putting in concrete prestress bridges at 4th West at 1st North and 2nd South. Councilman Barton Jensen suggests putting in our budget to replace one each year. ARE: DISCUSSION ON VACATION Discussion on vacation leave. Wait and study. IRE: MAYOR`S SALARY RAISED Councilman Barton Jensen moved that the Mayors salary be raised from $150.00 per month to $200.00 per month as of January I, 1975 or $2,400, per year. Councilman Nile Boyle seconded. All Aye. IRE: RESOLUTION PASS~D TO SUPPORT THE HOSPITAL BOND Mayor Porter suggests we pass resolution that we support the hospital bond urging people to vote in bond election. We will help raise the~~~~j necessary funds. Councilman Barton Jensen so moved. Councilman Nile Boyle seconded. All Aye IRE: ORDINANCE 565 City Attorney, Mary Smith read ordinance 565. AN ORDINANCE AMENDING PARAGRAPHS A, B, AND C OF SECTION I, ORDINANCE N0. 530, PROVIDING THAT PERMITS REQUIRED FOR EXCAVATION BE ISSUED BY THE CITY CLERK AND FURTHER PROVIDING FOR THE POSTING OF BONDS PRIOR TO THE ISSUANCE OF SAID PERMITS FOR THE REPLACEMENT OF ANY CITY STREET, ALLEY OR EASEMENT AFTER EXCAVATION OF THE SAME, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. Thereupon it was moved by Councilman Barton Jensen and seconded by Councilman Warren Porter that the rule requiring ordinances of a general and permanent nature to be read fully and distinctly on three different days be dispensed with and that said ordinance be numbered 565 and be passed and adopted as read. Thereupon the Clerk was ordered to call the roll on said motion and the roll call upon said motion was as follows: Those voting Aye: Barton Jensen George Catmull Nile Boyle Warren Porter Morgan Garner Absent: Glenn Peterson The Mayor thereupon declared that the motion, having been passed by not less than three-fourths of the Council, had been duly carried, and the Ordinance No. 565 was duly passed and adopted. The City Clerk was directed to publish said Ordinance No. 565 in at least one issue of the Rexburg Standard or Journal, a Newspaper published in the City of Rexburg, Idaho. IRE: ORDINANCE 5B6 City Attorney, Mary Smith read ordinance 566 creating LID 22. AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT N0. 22 IN REXBURG, IDAHO, FOR THE PURPOSE OF CAUSING CERTAIN STREETS AND ALLEYS AND PARTS THEREOF WITHIN THE CORPORATE LIMITS OF SAID CITY, TO BE GRADED, RE-GRADED, GRAVELED, PAVED, REPAVED AND OTHERWISE IMPROVE THE HEREINAFTER DESCRIBED STREETS WITHIN THE DISTRICT AND TO CONSTRUCT AND RECONSTRUCT CURBS, GUTTERS, MAINS AND SEWER SERVICES, DRAINAGE FACILITIES, WATER MAINS, WATER SERVICES, SEWER, INCLUDING STROM SEWERS, AND OTHER WORK INCIDENTAL TO ALL OF THE FOREGOING IMPROVEMENTS ALONG SA I'D STREETS, PROVIDING FOR THE LEVY OF ASSESSMENTS UPON THE PROPERTY TO BE BENEFITED BY SUCH IMPROVEMENTS: STATING THE BOUNDARIES OF SAID DISTRICT: PROVIDING FOR THE LEVY OF ASSESSMENTS UPON THE PROPERTY TO BE BENEFITED BY SUCH IMPROVEMENTS: STATING THE BOUNDARIES OF SAID DISTRICT: PROVIDING FOR THE PREPARATION OF AN ASSESSMENT ROLL: REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY. Thereupon it was moved by Councilman Barton Jensen and seconded by Councilman Warren Porter that the rule requiring ordinances of a general and permanent nature to be read fully and distinctly on three different days be dispensed with and that said ordinance be numbered 566 and be passed and adopted as read. All Aye ~ RE: PETITION FROM HAROLD NIELSON FOR PAVING TO BE DONE Mayor Porter read a petition presented by Harold Nielson. The petition requested that 4th West be paved or oiled between 3rd and 4th South. Mayor Porter stated that there were no funds left to do it this year. Councilman Barton Jensen suggested that it be turned over to the planning board for recommendation. He felt this could be put on an LID next year.
