All Aye Joh Porter, Mayor ~-- ~ ~" Afto Anderson, City Clerk MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO State of Idaho) County of Madison(SS City of Rexburg) A regular meeting of the City Council of the City of Rexburg, Madison County, State of Idaho, was called to order by the Mayor John C. Porter, at 7:30 P.M. on August 20, 1975, at the City Hall at Rexburg, Idaho, there being present the following: Mayor: John C. Porter Councilman: Barton Jensen Glenn Peterson Nile Boyle George Catmull Warren Porter Morgan Garner Also Present: Mary Smith, City Attorney Afton Anderson, City Clerk News Media IRE: MINUTES APPROVED A I I Aye IRE: PROBLEM OF CITY STREETS BEING TORN UP WITHOUT PROPER REPAIRS The minutes of the previous meeting were read and discussed. Councilman Barton Jensen moved the minutes be approved as corrected. Councilman Glenn Peterson seconded. Mayor Porter acknowledged the problems with our City streets being torn up time and again without the proper repairs. The streets are worse this summer than they have previously been. Cuts are being made by utilities and then not repaired properly. We now have an ordinance that states that digging permits must be obtained before cutting into a street. This permit obligates them to put gravel and the proper fill back into a cut, and a proper patch. This is not being done. The Superintendent of the water department issues the digging permits. The Superintendent of the street department is to see that the fill is put in and repair made correctly. The Mayor states that somewhere between the two, there is a lack of communication and the cuts are not being re- paired properly. Mayor Porter suggests having a fee of $200 for anyone cutting into the street. It it is repaired adquately the money can be refunded; if the City has to repair the cut, we keep the fee. He also suggests making the utility companies put a bond of $5,000. The digging permit will be purchased at the Clerks Office. IRE: VFW PRESENTS A FLAG TO CITY COUNCIL 1 The VFW presented a flag to the City Council to be kept in Council Chambers. They then lead the entire body in the pledge of allegiance to the flag. IRE: PUBLIC HEARING ON LID 22 Attending: J. Thomas Jacobs, Roger 0. Gerry Zirker, Lyle Thompson, Charles Leigh Pond, Vernice Rhees, Bud Rhees, Porter, Gary Porter, John Zirker., Rasmussen, Glen Hunter, Glen Por1d, Robert Clark. J John Millar, of Forsgren & Perkins showed on a map the streets where curb and gutter will be put in; where water, sewer or paving will be put in. Charles Rasmussen asks sewer to be extended north of 3rd north on Ist West. This can be done if the necessary paper work is taken care of at the Attorneys office. Bud Rhees presented a letter and by mouth showing concern over the drainage problem of Edith Circle. The proposed curb, gutter, and paving of Edith Circle will cause the water to drain onto his lot and the lot belonging to Charles Frost. He feels it is necessary to put a storm drain or some means of drainage before this street is paved. He is afraid he will be held responsible for the water problem. Councilman Barton Jensen moved that the minutes show, the City is responsible for the drainage problem on Edith Circle. Councilman Morgan Garner seconded. All Aye Mr. Reese then withdrew his protest. John Zirker & Wife questioned the curb and gutter as not adequate to control the run off water on 3rd East. They feel something must be done about this drainage water before this street is paved. They also question the right to assess them for paving along this street. They claim to have been assured at the public hearing on LID 20, that they would not have to pay for the paving there as it is to be paid by the City. They feel that it is used more by the highschool than them so the City should pay for the paving. They also request that the City put some type of speed check in the pamement in front of their home to prevent the highschool students from speeding. They have a real problem with the traffic going so fast there. Glen Pond expressed his concern of the drainage problem on Edith Circle. He suggests the City put in a storm drain before the street is paved so the curb and gutter will handle the run off from the hill. There must be some provisions made for drainage. John Zirker. Water draining from off the hill comes down the drain to his home. The sediment then builds up and stops the water. This results in the water flooding onto his lot and driveway. He suggest the City finish ditch or concrete drain. Glen Hunter questions the right of the City to charge property owners for the paving along 4th East as that street was put there by the City for their use. Mayor Porter advised that the City pays for the paving of the streets of the original townsite only. We don't have title to that street. It has not been dedicated. Mr. Hunter says the City has claimed that street for 50 years. Mayor Porter suggested a compromise. No written protests were filed. The next hearing will be on the assess- ment roll. RE: ENGINEER LYLE THOMPSON PRESENTS PLATS ON A NEW SUBDIVISION Engineer Lyle Thompson presented plats on a new subdivision. The planning board had approved the plat and suggested that the City Council give approval. Councilman Barton Jensen moved that the City revise the existing plat of Newville Valley View Addition only to increase the lot frontage as recorded on the plat. Councilman Nile Boyle seconded. All Aye RE: SKYVIEW ESTATES PLATT APPROVED Councilman Warren Porter moved that the Platt of the Skyview Estates be approved as recommended by the Planning Board. Councilman Morgan Garner seconded. All Aye 'RE. IRE: PLANNING BOARD ASKS .CITY TO TAKE STEPS TO PROVIDE ACCESS TO INDUSTRIAL AREAS Mayor John C. Porter reported that the Planning Board has asked the City to immediately take steps to provide access to the industrial areas of Rexburg including Manwaring Construction, Walters Ready Mix, Rexburg Lumber Company, Garner Concrete, by building one or more bridges accross the canal and a street to 191 around the City. The transportation Board of the State Highway Dept., through urban D funds, provide 70~ of funding. Mayor Porter suggests putting the project in three parts; one from Ist East accross the canal and to highway 191. From 191 to 5th West or 2nd West. The highway board will be here the 18th of September to meet with the City. City Engineer,. Clayter Forsgren has already started working to find the best locations and where we will be able to get right of ways. GIVING MONEY FROM REVENUE SHARING MONEY TO HOSPITAL BOND DISCUSSED Mayor Porter reported that the hospital bond will be $250,000. He feels that in order to get enough money for the hospital, that that-the City Council give revenue sharing money for the next two years of $25,000, as the County is doing. Councilman Barton Jensen opposed the plan as he feels this would mean the City people would be paying twice on the County hospital. The County is giving 50~ of the revenue sharing which already belongs to the city too, stated Mayor Porter. Councilman Barton Jensen suggested it be tabled until next time, and find out the feelings of the people. IRE: BIDS IN IMPOUND VEHICLES Bids were received on impound autos from Larry Bevin, Intermountain Supply, James Mulberry, Jesse Brown, Willard Mc Culloch, and Big 0 Salvage. Councilman Glenn Peterson moved we turn over bids to Chief Blair Siepert to accept bids. Councilman Morgan Garner seconded. All Aye IRE: FENCE TO BE PUT AROUND IMPOUND LOT & LIGHTS NEEDED Mayor Porter reports that the City impound lot for vehicles needs to be fenced and lighted to keep the autos from being vandalized. A chain link fence should be installed all the way around the lot and a couple of large lights so the cars can not be stripped. IRE: BILLS APPROVED Councilman Warren Porter moved the bills be approved for payment. Councilman Nile Boyle seconded. All Aye IRE: POLICE ARE MAKING MAPS FOR IMPORVEMENTS Mayor Porter advised that the police are going through the city making maps where signs need replacing or repair.
