Porter, at 7:30 P. M. on August 6, 1975, at the City Hall at Rexburg, Idaho there being present the following: Mayor: John C. Porter Councilman: George Catmull Nile Boyle Warren Porter Barton Jensen Morgan Garner Absent: Glenn Peterson (excused) Also Present: Mary Smith, City Attorney Afton Anderson, City Clerk Thereupon the following proceedings, among others, were duly had and taken: RE: MINUTES APPROVED The minutes of the previous meeting were read and discussed. Councilman George Catmull moved the minutes be approved as corrected. Councilman Barton Jensen seconded. All Aye. City Attorney Mary Smith read the minutes of the meeting of July 2, 1975. After discussion, Councilman Barton Jensen moved that the minutes be approved. Councilman Nile Boyle seconded. All Aye RE: ANNEXING OF PROPERTY ON 5th WEST DENIED AT THIS TIME. Mayor John C. Porter reported that the people wanting the property annexed for an apartment complex on 5th West, will not be able to get the financial backing needed :at this time. They are not interested in annexing the property now. Councilman Barton Jensen moved annexations be denied at this time. Councilman Nile Boyle seconded. All Aye RE: SWIMMING POOL TO BE CLOSED 1 Marie Seeley, Head Instructor at the City Swimming Pool reports on the problems at the pool. The water was turning cloudy again where it was impossible to see the bottom of the pool in the deep end. Mr. Perks tested the water and found that it contained floating paint. The paint: had a 7 day curing time which was not observed. The paint is flaking off e~~^~ the side of the pool and clouding the water, then when the chemicals are added the water turns brown. Mr. Perkes said this would be toxic and could cause skin irritations. He suggested closing the pool immediately. The council agreed that as the cloudy water made the pool dangerous also, it should be closed immediately. Mayor Porter will contact the college to see if we can move our swimming classes to the College pool until this session is completed. RE: KATHLEEN SILER GIVEN LICENSE TO OPERATE NURSERY SCHOOL Mayor Porter read a petition presented by Kathleen Siler at 515 Chad Drive. She wishes to operate a nursery school out of her home. After discussion, Councilman Barton Jensen moved that the business license be granted for one year; there will be a review at the end of one year. Councilman Nile Boyle seconded. All Aye RE: RESOLUTION ON LID 22 City Attorney, Mary Smith, read in full the resolution on LID 22. Councilman Barton Jensen introduced the resolution and Councilman Warren Porter seconded. All Aye RE: WATER DEPARTMENT PROBLEMS DISCUSSED, TARGET GUAGE DISCUSSED Councilman Barton Jensen advised of some questions the Water Department has. I. They want to know what to paint the pumphouse at the new reservoir. Councilman Jensen suggested not painting; the pumphouse is cinderblock and would look better if it was left unpainted. Painting it would just mean another maintenance problem. 2. Jerry Brian, Superentendent of the Water Department, wants a target guage for the top of the new tank. This would enable them to see the fullness of the tank with binoculars. The cost would be around $1,000. Council felt that it is unnecessary to go this added expense when the should go up to the reservoir anyway and the City Hall will be equipped with all necessary guages and equipment. 3. The question of the guages and equipment in City Hall. The equipment is being installed now in City Hall. They will have red lights that will come on if there are any problems with the system. Councilman Barton Jensen suggested also putting-warning buzzer in the front office so they could radio the Water Department in case of an emergency.Also it would be a very good idea to have a buzzer or warning light system into the Fire Station so that if anything went wrong at night or on weekends when the Clerks office is closed, the Fire Department could notify Water Department personnel. RE: AIRPORT DISCUSSED Airport discussion on the problems they are having now. RE: PARKING PROBLEM DISCUSSED Parking problem discussed. Need some solution to the problem. RE: DISCUSSION ON NEW PARKS AND TENNIS COURTS Discussion on new Parks and tennis courts. They have started planting the grass at the park by the new high school. Mayor Porter hopes to be able to get the tennis courts in by winter so that they could use them for skating rinks this winter. Councilman Jensen expressed the need for metered lighting for the rinks and tennis courts. This would end the problem of the park lights being left on all night. :E: LID 21 DISSOLVED Councilman Morgan Garner moved to dissolve LtD 21. Councilman Nile Boyle seconded. Councilman Barton Jensen moved the minutes be approved as corrected. Councilman Glenn Peterson seconded. Mayor Porter acknowledged the problems with our City streets being torn up time and again without the proper repairs. The streets are worse this summer than they have previously been. Cuts are being made by utilities and then not repaired properly. We now have an ordinance that states that digging permits must be obtained before cutting into a street. This permit obligates them to put gravel and the proper fill back into a cut, and a proper patch. This is not being done. The Superintendent of the water department issues the digging permits. The Superintendent of the street department is to see that the fill is put in and repair made correctly. The Mayor states that somewhere between the two, there is a lack of communication and the cuts are not being re- paired properly. Mayor Porter suggests having a fee of $200 for anyone cutting into the street. It it is repaired adquately the money can be refunded; if the City has to repair the cut, we keep the fee. He also suggests making the utility companies put a bond of $5,000. The digging permit will be purchased at the Clerks Office. IRE: VFW PRESENTS A FLAG TO CITY COUNCIL ~I! L~ 0 The VFW presented a flag to the City Council to be kept in Council Chambers. They then lead the entire body in the pledge of allegiance to the flag.
