A regular meeting of the City Council of the City of Rexburg, Madison
County, State of Idaho, was called to order by the Mayor John C. Porter,
at 7:30 P. M. on July 16, 1975, at the City Hall at Rexburg, Idaho, there
being present the following:
Mayor: John C. Porter
Councilman: George Catmull
Nile Boyle
Warren Porter
Morgan Garner
Glenn Peterson
Barton Jensen
Also Present: J. D. Hancock, Assistant City Attorney
Afton Anderson, City Clerk
Thereupon the following proceedings, among others, were duly had and
taken:
RE: MINUTES OF PREVIOUS MEETING APPROVED
The minutes of the previous meeting were read and discussed. Councilman
Morgan Garner moved the minutes be approved with the necessary corrections.

RE: CONTROVERSY OVER PARKING AREA USED BY TRI COUNTY EQUIPMENT
Mayor Porter reported there has been some controversy over the
parking area used by Tri County Equipment from the curb on Main Street
down 2nd East to the alley. Tri County Equipment had painted the curb
yellow for no parking. People complained and the police (Corporal
Hammer checked with them). Tri County said Mayor Shirley had given permission
to paint the curb to stop parking. Mayor Shirley couldn't remember. Mayor
Porter told them to get a petition. Tri County needs this room to pull
big equipment in and out of their lot. They want tt painted from the
corner approximately 70 feet. Council felt they didn't have any right to
stop parf~ing all. the way around their store anymore than any other store
would. They ask that Tri County Equipment stop parking their equipment
on the City sidewalk. They promised to stop parking on the sidewalk.
The City would see what they could do about the parking there. Mayor
Porter stated that he would have the police go down and measure and make
their recommendations.
RE: EMERGENCY NUMBER TO BE 911
The County Sheriffs Department, the ambulance service, and the Police
Department are considering the 911 emergency number adopted in other
areas. In a meeting with the County Commissioners, it was agreed that
the County would give their okay on the number if the City will go along
with it. The monthly rate would be $94.75 and $100.50 for installation.
The City would pay half and the County would pay half. Blair Siepert
Chief of Police explained that this number would be separate from their
other law enforcement lines. He felt it was a good way to go. A call can
be traced back to the caller by simply holding down the receiver to keep
a connection until it has been traced. This would stop prank calls
besides helping to trace the location of a caller that is unable to give
his location.
RE: IDAHO BANK & TRUST GIVEN PERMISSION TO PUT TRAILER TEMPORARILY FOR BUSINESS
Idaho Bank & Trust requested permission to put in a temporary business
trailer on their property on West Main while they are in the process of
building their new bank. They hope to move in by September 1st. They
would want to have the trailer there for a year so they will be able to
operate their business while the bank is being constructed. Mayor
Porter advised that as the. property there is Commercial there should
be no problem. Councilman Barton Jensen moved that we grant them a
temporary trailer permit for one year starting September I, 1975. Councilman
Glenn Peterson seconded.

RE: GREAT WESTERN DEVELOPMENT ASKS FOR PROPERTY TO BE ANNEXED

Great Wester Development is buying property from Melvin Cook west of
51~h West. They are requesting that the property be annexed into the
City. They wish to put in FHA financed low cost housing. Mayor Porter
suggested annexing clear to 7th South so they could get all the property
in at the same time. J. D. Hancock will get to work on it.
ORDINANCE 564
J. D. Hancock introduced, and there was read ordinance 564 in full
stating the use of public parks. This ordinance prohibits the driniking
of any alcoholic beverages in any City Park. It also places a curfew
for parks of 11:30 P. M.
REGULATIONS CONCERNING USE OF THE CITY PARKS OF THE CITY OF REXBURG,
IDAHO; PROVIDING THAT ANY PERSON, FIRM OR CORPORATION VIOLATING THIS
ORDINANCE SHALL BE GUILTY OF A MISDEMEANOR; PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
Thereupon it was moved by Councilman Glenn Peterson and seconded by
Councilman Morgan Garner, that the rule requiring ordinances of a general
and permanent nature to be read fully and distinctly on three different
days be dispensed with and that said ordinance be numbered 564 and be
passed and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and
the roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by
not less than three-fourths of the Council, had been duly carried, and the
Ordinance no. 564 was duly passed and adopted.
RE: EMPLOYEES GET A 4/ RAISE
Employees of the City were present at the meeting to express their desire
for the promised 4% raise. Chief of Police, Blair Siepert expressed the
need of all the employees for this raise. The raises in March were small
but accepted because of the 4% raise in July. He didn't know there was
any question of getting the raise. The cost of living has raised and
the employees have been counting on this raise. He asked that they
approve this raise as of July I. Mayor Porter argued that the budget
figures were figured for 6 months at the March raise and 6 months at the
4~ which would not be until Sept. I. They have to keep the budget at
the same until the new budget is set. Chief Siepert questioned this as
all of our budget figures go from Jan. I to Dec. 31 and the salaries
after Jan. I would go on the 1976 budget. Councilman Nile Boyle moved
that the employees be given a 4/ cost of living raise as of July I, 1975.

RE: CITY EMPLOYEES GET PRAISE
Cal Boren expressed his appreciation to the City Street Department. The
snow removal has been the best he has ever seen. It was a tremendous
service. Councilman Glenn Peterson announced that all of the City
employees were doing well. He had heard so many good comments about
the service given by all of the employees.
RE: STREET CREW TO CLEAN YARDS
Mayor suggested setting a cost for cleaning yards and cleaning up; the
the street crew will clean up lots and yards and then charge for it.

Councilman Warren Porter moved we approve the bills for payment. Councilman
Morgan Garner seconded.

Councilman Morgan Garner moved we adjourn. Councilman Barton Jensen
seconded.

being present the following:

Thereupon the following proceedings, among others, were duly had and

The minutes of the previous meeting were read and discussed. Councilman
George Catmull moved the minutes be approved as corrected. Councilman
Barton Jensen seconded. All Aye. City Attorney Mary Smith read the
minutes of the meeti"ng of July 2, 1975. After discussion, Councilman
Barton Jensen moved that the minutes be approved. Councilman Nile Boyle
seconded.

RE: ANNEXING OF PROPERTY ON 5th WEST DENIED AT THIS TIME.
Mayor John C. Porter reported that the people wanting the property
annexed for an apartment complex on 5th West, will not be able to get
the financial backing needed at this time. They are not interested in
annexing the property now. Councilman Barton Jensen moved annexations
be denied at this time. Councilman Nile Boyle seconded.
