MR & MRS BOB CLARK ASKS THAT PROPERTY BE INCLUDED IN IMPROVEMENT DISTRICT
Mr. & Mrs. Bob Clark asked that Mrs. Clark's property in the Southeast ~~
corner of the City be included in the imporvement district. This was
approved by the council.
BILLS APPROVED
It was moved by Councilman Morgan Garner and seconded by Councilman Warren
Porger that the bills be approved for payment.

Councilman Barton Jensen moved that the meeting adjourn. Councilman Nile
Coyle seconded.

MEETING OF THE CITY OF REXBURG, IDAHO

A regular meeting of the City Council of the City of Rexburg, Madison
County, State of Idaho, was called to order by the Mayor John C. Porter,
at 7:30 P. M. on June 18, 1975, at the City Hall at Rexburg, Idaho, there
being present the following:

Thereupon the following proceedings, among others, were duly had and taken:
IRE: MINUTES APPROVED
The minutes of the previous meeting were read and discussed. Councilman
Nile Boyle moved that the minutes be approved with the necessary corrections.
Councilman Barton Jensen seconded.

IRE: SWIMMING POOL BEING FIXED
Councilman Warren Porter reported on the swimming pool. The pool was
leaking b?orse this year. The City street crew dug out some of the pipe
to find that it was completely rotted away. Larry Perkins of Forsgren
and Perkins suggested putting a new line inside the pool instead of on
the outside. Mayor Porter advised that Twin Falls had this same problem
4 years ago. They put in the same type of lines on the inside as Mr.
Perkins suggested, and it has been working perfectly since. Mayor
Porter stated that the total repair should cost approximately $3,000.
RE: ORDINANCE 562
City Attorney Mary Smith read ordinance 562 in full; an ordinance providing
for the definitions applicable generally to ordinances of the City of
Rexburg and providing for rules of construction for the ordinances of the
City of Rexburg. ORDINANCE~j62 introduced, and there was read, the following
AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, PROVIDING FOR THE DEFINITIONS
APPLICABLE GENERALLY TO ORDINANCES OF THE CITY OF REXBURG, IDAHO AND
PROVIDING FOR RULES OF CONSTRUCTION. FOR THE ORDINANCES OF THE CITY OF
REXBURG, IDAHO.
Thereu on it was moved by Councilman Nile Boyle and seconded by
Cound~i~man Warren Porter that the rule requiring ordinanes of a general
and permanent nature to be read fully and distinctly on three different
days be dispensed with and that said ordinance be numbered 562 and be
passed and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by not
less than three-fourths of the Council, had been duly carried, and the
Ordinance No. 562 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 562 in at
least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
RE: PUBLIC HEARING ZONING CHANGE ON MANWARING PROPERTY
8:00 P. M. Public Hearing on the zoning change of property owned by
Manwaring Construction Company. The property in question being located
on 1st East North of 2nd North about 100 feet to middle of 3rd North.
It is now R2 and Manwaring Construction wish to change the zoning to
Industrial so they can expand their business.
RE: PETITION READ
Mayor John C. Porter read a petition protesting the change. The petition
contained 26 signatures of concerned property owners in the near vicinity.
Mr. Manwaring advised that some of the people were not within a 300 foot
perimeter, so were not eligible to sign. The protest would have to
come from property owners within 300 feet of the perimeter of the property
wanting to be changed.
RE: PEOPLE ATTENDING HEARING
People attending the hearing to protest the change were as follows:
Fred Scoresby, Wanda Scoresby, David Phillips, Bruce Eckman, Harlow
McNamera, Mary Ann Zollinger, Charles Zollinger, Virginia Zollinger,
Dee Fullmer, and Doug Hardy.
RE: COMMENTS ON HEARING
Mayor Porter asked for comments. Attorney Harlow Mc Nemara representing
the people apposed to the zone change, felt that the expansion of the
Manwaring Construction business, farther into their neighborhood would
lower property value. Mr. Blair Manwaring advised that they were short
sighted and didn't know they would be expanding so much. This is why they
want the zone change. Mr. McNemara stated that the people feel they must
stop the incroachment into the residential area. The people in this area
allowed them to move over into the residential area once and now they want
to move farther in. They feel if they grant them this zone change they
will just keep moving over until they will no longer have a residential
area. Mr. Dee Fullmer asks if it were possible for them to move North
across the canal. Mr. Manwaring reported that Charles Rasmussen owns a
little. over 2 acres on north of the canal. They approched him about
buying it. He told them he wanted over $100,000.00 for it. As this
is a ridiculous price, it doesn't make it feasible to expand that direction.
Fred Scoresby stated it didn't matter anyway the City has alread let Garner
Concrete build a Commercial building in a residential zone. Mayor Porter
stated that the permit issued was for a garage for storage only.

COUNCIL TO DECIDE WHAT CONSTITUES A COMMERCIAL ENTERPRISE
Councilman Barton Jensen says the Council has to try to decide what
constitutes a commercial enterprise.
IRE: MAYOR RECOMMENDS A HEARING FOR LIMITED COMMERCIAL ZONE

Mayor John C. Porter recommended that Manwarings put down all uses they
plan for the property and have a public hearing for limited commercial.
IRE: ZONING CHANGE DENIED
Councilman Barton Jensen moved the request for zoning change 478 be
denied. Councilman Glenn Peterson seconded.
R ORDINANCE 563

City Attorney Mary Smith read ordinance 563 in full: an ordinance granting
a right of entry to authorized city officials for the ''inspection of buildings
and premises for the enforcement of the provisions of the City of Rexburg,
Idaho.
AN ORDINANCE GRANTING A RIGHT OF ENTRY TO AUTHORIZED CITY OFFICIALS FOR
THE INSPECTION OF BUILDINGS AND PREMISES FOR THE ENFORCEMENT OF THE
PROVISIONS OF THE REABURG, IDAHO, ORDINANCES.
Thereupon it was moved by Councilman Barton Jensen and seconded by
Councilman Nile Boyle that the rule requiring ordinces of a general and
permanent nature to be read fully and distinctly on three different days
be dispensed with and that said ordinance be numbered 563 and be
passed and adopted as read.

IRE: FINAL PLANS FOR 1975 LID
John Millar of Forsgren and Perkins presented final plans for 1975 LID.
IRE: CIVIC CLUB AND YOUTHS HAVE NEW PROJECT
Sue Huskinson, of the Civic Club and youths, are going to do another
project. They are going to plant low shrubs on the East side of Smith Park.
Councilman George Catmull asked that the minutes so read that the Council
appreciate the beautification of our City done by the Civic Club. Mayor
Porter will write them a letter to this effect.
RE: COUNCIL APPROVED BILLS
Councilman Glenn Peterson moved that the bills be approved for payment.
