A regular meeting of the City Council of the City of Rexburg, Madison
County, Sate of Idaho, was called to order by the Mayor John C. Porter,
at 7:30 P. M. on June 4, 1975, at the City Hall at Rexburg, Idaho, there
being present the following:

Thereupon the following proceedings, among others, were duly had and
taken:
IRE: MINUTES APPROVED
The minutes of the previous meeting were read and discussed. On motion
of Warren Porter, seconded by Nile Boyle the same were approved with the
necessary corrections.

IRE: WILBURN ANDREW PERMITTED TO PUT TRAILER AT 247 North 2nd West
Mr. & Mrs. Wilburn Andrew, presented to the Council a petition signed
by all the neighbors adjacent to the La Mont Bell property at 247 North
2nd West. Mr. Andrew requests permission to move his trailer house onto
the property at this location where there has previously been a trailer.
Councilman Nile Boyle moved that they be permitted to put the trailer
at this location but must renew this variance every year. Councilman
Warren Porter seconded.

ARE: SHAKLEE DEALERS TO RENT COUNCIL ROOM
Mayor Porter advised that the Shaklee Dealers want to rent the Council
room for meeting once each month. Councilman George Catmull suggests
charging $15.00 per hour for rental on the room. This would cover the
cleaning and having the janitor let them in and out.

RE: DON FOWLER TO TAKE DICK MAY'S PLACE AS ASSISTANT CHIEF OF POLICE
Police Chief Blair Siepert announced new appointments to take Captain
Dick May's place. Officer Don Fowler is back on full time and is next
in line for promotion. He will be promoted to Captain and will take
over the position of Assistant Chief of Police. Corporal Kauer will
be promoted to Sergeant and full time investigator. Patrolman First
Class Clifford Hammer will be promoted to Corporal. They will receive
subsequent raises. Councilman Glenn Peterson moved that we accept the
Chief's recommendations and that Don Fowler have one year in which to
pass a complete physical. Councilman Nile Boyle seconded. All Aye.
Chief Blair Siepert agreed to the stipulation, stating that Don Fowler
realized that if he was still having trouble with his leg at the end of
a year he would have to give u;p law enforcement all together.
RE: APPLICATIONS BEING ACCEPTED FOR VACANCY ON POLICE FORCE
Police Chief Blair Siepert further stated that he was accepting applications
to fill the vacancy for an officer left by promoting the other officers.

D,O.G POUND TO BE REPAIRED
Mayor Porter reported that the dog pound is in dire need of repair. The
Chief says the dogs are being broken out of the pound regularly. It needs
the electric wiring fixed as they have no power right now. The pump has
been stolen from the well so there is no water. He has checked pith
Holley plumbing on what the costs will be for the needed repairs. The
quote was between $400 and $500. Mayor Porter hopes to build a new
dog pound next year. They need a cinder block pound that can be kept more
sanitary and is vandalizm proof. Mayor Porter advised Blair to get the
necessary repairs done. This was approved by the Council.

IRE: YOUTH CONFERENCE IN REXBURG NEEDS PROJECT
There will be a youth conference in Rexburg on May 20th. They need a
project. They will help put a rock garder up at Smith Park and weed
the tulips.
IRE: PROTEST ON CHANGE OF ZONING OF MANWARING PROPERTY
James Barrett, F'iarlow Mc Namara, Dee Fullmer, Mildred Jeppesen, Mrs.
George Wilding, Charles Zollinger, Virginia Zollinger, Ina Fikstad,
Fred Scoresby, N. R. Henderson, K. W. Zollinger, and D. M. Fikstad,
attended the Council meeting to protest the change of the Manwaring
Property from R2 to Commercial. Mayor John C. Porter asked them to
come to the next Council meeting June 18, as this is the date set for
the Public Hearing on this property. They will then be given an
opportunity to give their objections.
~RE: ENGINEER PRESENTS AERIAL PHOTOS OF CITY, WITH WATER & SEWER LINES ON IT
City Engineer, Clayter Forsgren presented to the Council, aerial photos of
the City. He has photographed the city in sections; draw the water
and sewer lines onto these photos, and piece them together to make a large
aerial photo for the wall of the Council room. Councilman Barton Jensen
moved that we order the map be make with a frame and glass to protect it.
The Mayor can make the decision as to what paper and frame, etc. Council-
man Warren Porter seconded.

IRE: MAPS SHOWING STREETS MOST NEEDING REPAIR REVIEWED
Maps showing the streets most needing repair were reviewed. Councilman
Morgan Garner moved to approve the street program as marked on the map,
and the LID improvements as shown on the map. Councilman Glenn Peterson
seconded.

MAYOR REPORTES ON STORE TO BE BUILT BY MR CARTER
Mayor John C. Porter reported on the store to be built by Mr. Carter
of Carousel Stationery. He advised that the store may have to stay
back two feet because of the sewer line. This could mean that the alley
would have to be 18 feet instead of 20 feet. No decision was made by the
council.
FIREWORKS PERMIT APPROVED
The fireworks permit for M. H. King was approved. Councilman Barton
Jensen made the motion and Councilman Glenn Peterson seconced.

MR & MRS BOB CLARK ASKS THAT PROPERTY BE INCLUDED IN IMPROVEMENT DISTRICT
Mr. & Mrs. Bob Clark asked that Mrs. Clark's property in the Southeast ~~
corner of the City be included in the imporvement district. This was
approved by the council.

It was moved by Councilman Morgan Garner and seconded by Councilman Warren
Porter that the bills be approved for payment.

The minutes of the previous meeting were read and discussed. Councilman
Nile Boyle moved that the minutes be approved with the necessary corrections.

IRE: SWIMMING POOL BEING FIXED
Councilman Warren Porter reported on the swimming pool. The pool was
leaking gorse this year. The City street crew dug out some of the pipe
to find that it was completely rotted away. Larry Perkins of Forsgren
and perkins suggested putting a new line inside the pool instead of on
the outside. Mayor Porter advised that Twin Falls had this same problem
4 years ago. They put in the same type of lines on the inside as Mr.
Perkins suggested, and it has been working perfectly since. Mayor
Porter stated that the total repair should cost approximately $3,000.

City Attorney Mary Smith read ordinance 562 in full; an ordinance providing
for the definitions applicable generally to ordinances of the City of
Rexburg and providing for rules of construction for the ordinances of the
