MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
State of Idaho)
County of Madison(SS
City of Rexburg)
A regular meeting of the City Council of the City of a exburg, Madison
County, State of Idaho, was called to order by the Mayor, John C.
Porter at 7:30 P. M. on May 21, 1975, at the City Hall at Rexburg, Idaho,
there being present the following:
Mayor: John C. Porter
Councilmen: Barton Jensen, Morgan Garner
Warren Porter, Glenn Peterson
George Catmull, Nile Boyle
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
Roger Porter, Reporter for Rexburg Standard
Thereupon the following proceedings, among others, were duly had and
taken:
IRE: MINUTES APPROVED
The minutes of the previous meeting were read and discussed. On motion
of Glenn Peterson, seconded by Morgan Garner the same were approved with
the necessary corrections.

RE: PARKING DENIED FOR REX CATMULL OF REXBURG APARTMENTS
Mayor Porter stated Rex Catmull of the Rexburg Apartments, had contacted
him regarding parking for his apartments; on College Ave. The Mayor
stated in April of 1973, the Council. by resolution had given him permission
to give over-night parking stickers for his hotel guests. Ho'~ever he _
now operates the hotel as apartments and sometimes has guests f'or a week
or a month at a time. That he needs parking and would like the City's
help. The matter was discussed. The Council determined it was not the
Councils obligation to find parking for those renting apartments. That
it might be possible to let him have one parking on a temporary
basis. space
RE: GEORGE STODDARD ASKS FOR PERMISSION TO GET BUILDING PERMIT FOR HIS HOME
George Stoddard wants permission to get a building permit for his home.
The property that the lot lies on was owned by Floyd Bagley; he presented
a Platt to the City which was turned down because it showed no streets or
easements for water and sewer lines. Floyd Bagley sold the lot to George
Stoddard without telling him that the Platt had been turned down. Mayor
Porter advised that a new 6" line must be complete up to the new system
and Mr. Stoddard would have to pay his share. He would also have to
get Floyd Bagley to Platt the ..property before any other lots are sold.
Councilman Barton Jensen moved we draw up some agreement to bring him
up to conformity so he can proceed with the building of their home.
Seconded by Councilman George Catmull.

RE: THOMAS CARTER OF CAROUSEL STATIONERY PRESENTS PLANS FOR BUILDING
Thomas Carter of Carousel Stationery presented plans for a building on
South Center next to Barretts Dress Shop. The Planning Board said if
a street was extended through to Carlson Avenue this would be in the
way. It would have a loading zone in a 16' alley which isn't enough

room. Rick Andrus, Attorney flet that in the law suit with Kentucky
Fried Chicken, they had a 20' alley. The issue is still open. The
Council suggested building the building longer and cutting 3 I/2 feet
off the width so that it leaves a 20' alley. This will be taken up
at a later date.
ARE: BID OPENING FOR NEW GARBAGE TRUCK
Bid opening. The bids were received for a new truck to go under the
refuse compacter for our garbage department.

Councilman Barton Jensen moved we accept the low bid of Taylor Chevrolet,
if it meets all specifications. Councilman Warren Porter seconded.

~RE: RICKS COLLEGE TO CLOSE CENTER STREET FROM 2nd SOUTH TO 4th SOUTH
Ronald Stone and Rex Bennion representing Ricks College asked the City
to close off Center Street from 2nd South and 4th South. Ricks College
plans to build across this street and stop the through traffic across
the campus. There would be a parking area, trees, benches, and grass
put in this location. Councilman Barton Jensen moved that the rule
requiring ordinances of a general and permanent nature to be read fully
and distinctly on three different occasions to be dispensed with.
Councilman Nile Boyle seconded. All Aye.
IRE: ORDINANCE 561
Ordinance 561 introduce, and there was read, the following ordinance in
full:
Ordinance No. 561
AN ORDINANCE VACATING ANC CLOSING ALL OF THAT PORTION OF SOUTH CENTER
STREET BETWEEN SECOND AND FOURTH SOUTH IN THE CITY OF REXBURG, IDAHO,
AND DIRECTING THAT THE VACATED PROPERTY BE CONVEYED TO THE ADJOINING
PROPERTY OWNERS.
Thereupon it was moved by Councilman Barton Jensen and seconded by
Councilman Morgan Garner that the rule requiring ordinances of a general
and permanent nature to be read fully and distinctly on three different
days be dispensed with and that said ordinance be numbered 561 and be
passed and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, have been passed by not
less than three-fourths of the Council, had been duly carried, and the
Ordinance No. 561 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 561 in
at least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
RE: RICHARD MAY RESIGNS
Mayor Porter read Captain Richard May's resignation and reported that
he was taking over the position as Police Chief in Burley, Idaho.
Police Chief Blair Siepert will be at the next Council meeting to offer
his recommendations for the new Assistant Chief of Police.
RE: RESOLUTION Councilman Boyle moved we pass Resolution No I providing for
Flood Insurance. Councilman Jenson seconded. All Aye Resolution enables
residents of Madison Co. and the City to obtain flood insurance.
RE: RESOLUTION ACCEPTING FLOOD CONTROL MAP
~ Councilman Barton Jensen moved that we pass resolution No 2
accepi'ng the flood control map. Councilman Morgan Garner seconded.

RE: AGREEMENT BETWEEN THE CITY AND UTAH POWER & LIGHT
Mayor Porter read proposed agreement between the City of Rexburg and
Utah Power & Light Company to supply services for pumps on our two new
wells. The Mayor read the agreement. Councilman Glenn Peterson moved
that the Mayor sign the agreement. Councilman Warren Porter seconded.
Uninimously carried. The Mayor brought up the matter of the City
purchasing transformers or renting them; that his investigation
determined it would be better to rent rather than own the transformers
as the maintenance might be very costly. When renting the transformers
the Power Company is responsible for the maintenance.
~ RE: ROBERT TAYLOR BUILDING PERMIT
Mayor Porter brought up the Robert Taylor building permit. He reported
that the building permit was issued correctly for an addition to Taya>or home
but Mr. Taylor put on another addition until he was past his property
line. He used the retaining wall belonging to Phil Garn as the wall on
his addition. This put his eaves 4 feet over onto the property of Phil
Garn. This violates the building code. The Planning Board recommended
that Mr. Taylor be made to remove this building to conform with the building
recommendations of the planning board, Councilman Barton Jensen moved
that Mr. Taylor be forced to conform with the City Buiidi'ng Code._
Councilman Nile Boyle seconded.

RE: GLAIR MANWARING ASKS TO HOLD A PUBLIC HEARING FOR- RE-ZONING
Blair Manwaring asks the Council to hold a public hearing so that he
can rezone the property belonging to Manwaring construction to
commercial. Councilman Morgan Garner moved that we hold a public
hearing June 18, 1975. Councilman George Catmull seconded.

~ RE: MAYOR & J. D. HANCOCK TO ATTEND MEETING
Mayor Porter advised that J. D. Hancock and himself will be attending;a
meeting in Pocatello .with the Department of Parks and Recreation.
RE: BELLS PASSED
Councilman Morgan Garner moved that we accept the bills in the amount of
$69,921.08 for payment. Councilman Glenn Peterson seconded.

Councilman Warren Porter moved that the meeting adjourn. Councilman
Morgan Garner seconded.

RESOLUTION
(BUILDING PERMIT SYSTEM WHICH THE COMMUNITY HAS
ADOPTED AND THE REVIEW PROCEDURE FOR THE SYSTEM
FOR FLOOD INSURANCE)
WHEREAS, the CITY OF REXBU RG has adopted and is
enforcing ORDINANCE NO. 527, the City Building Code, and
WHEREAS, Section 301(a) of 'the aforesaid .prohibits

any person, firm or corporation from erecting, constructing,
enlarging, altering, repairing, improving, moving or demolishing

is in a location that has a flood hazard, any proposed new ::'

of the structure, (ii) use construction materials and utility
and mobile homes) must (i) be designed (or modified) and
equipment ,that are resistant to flood`'damage, and (iii) use ;.~
construction methods and practices that will minimize flood
damage; and
2. That the CITY BUILDING INSPECTOR shall review
subdivision proposals and other proposed new developments to
assure that (i) all such proposals are consistent with th` need

to minimize flood damage, (ii) all public utilities and
facilities, such as sewer, gas, electrical and water systems
are located, elevated,-and constructed to minimize or eliminate
flood damage, and (iii) adequate drainage is provided so as
to reduce exposure to flood hazards; and
3. That the CITY BUILDING INSPECTOR shall require new
or replacement water .supply systems and/or sanitary sewage
systems to be designed to minimize or eliminate infiltration
of flood waters into the systems and discharges from the systems
into flood waters, and require on-site waste disposal systems
to be located so as to avoid impairment of them or contamination
from them during flooding.

RESOLUTION
(APPLICATION FOR FLOOD INSURANCE)

WHEREAS, certain areas of the City of Rexburg are
subject to periodic flooding from the Teton River, causing
serious damages to properties within these areas; and
WHEREAS, relief is available in the form of Federally
subsidized flood insurance as authorized by the National Flood
Insurance Act of 1968; and
WHEREAS, it is the intent of this City Council to
require the recognition and evaluation of flood hazards in all
official actions relating to land use in the flood plain areas
having special flood hazards.; and
WHEREAS, this body has the legal authority to adopt
land use and control measures to reduce future flood losses
pursuant to state law;
NOW, THEREFORE, BE IT~RESOLVED, that. this CI~'Y COUNCIL
hereby:
1. Assures the Federal Insurance Administration that
it will enact as necessary, and maintain in force for those
areas having flood hazards, adequate land use and control
measures with effective enforcement provisions consistent with
the Criteria set forth in Section 1910 of the National Flood
Insurance Program Regulations; and
2. Vests City of Rexburg, REXBURG CITY BUILDING
INSPECTOR, with the responsibility, authority, and means to:
(a) Delineate or assist the Administrator, at his
request, in delineating the limits of the areas having special
flood hazards on available local maps of sufficient scale to
identify the location of building sites.
(b) Provide such information as the Administrator
may request concerning present uses and occupancy of .the flood

plain.

(c) Cooperate with Federal, State, and local
agencies and private firms which undertake to study, survey,
map, and identify flood plain areas, and cooperate with
neighboring communities with respect to management of adjoining
flood plain areas in order to prevent aggravation of existing
hazards .
(d) Submit on the anniversary date of the
community's initial eligibility an annual report to the
Administrator on the progress made during the past year within
the community in the development and implementation of flood
plain management measures.
3. Appoints the REXBURG CITY BUILDING INSPECTOR to
maintain for public inspection and to furnish upon request a
record of elevations (in relation to mean sea level) of the
lowest floor (including basement) of all new or substantially
improved structures located in ,the special flood hazard areas.
If the lowest floor is below grade on one or more sides, the
elevation of the floor immediately above must also be recorded.
4. Agrees to take such other official action as may
be reasonably necessary to carry out the objectives of the
program.

NOTICE OF PUBLIC HEARING REGARDING PROPOSED
AMENDMENT AND CHANGE OF ZONING ORDINANCE N0. 478
NOTICE IS HEREBY GIVEN that a public hearing will be
_ held and conducted by and before the City Council of the City
of Rexburg, in the Council Chambers in the City Building in
Rexburg, Idaho, on Wednesday, the lath day of June, 1975, at
8 o'clock P.M, of said day, for the purpose of conducting a
public hearing regarding proposed amendments and changes of
Zoning Ordinance No. 478 of the City of Rexburg, Idaho, to
provide that the hereinafter described property be rezoned and
changed from R2 Residential to Industrial;'that said property
is described as follows, to-wit:
Commencing at the Northwest corner of Lot 2, Block 16
in the City of Rexburg, thence South 86 feet, thence
East 330 feet, thence North 86 feet, thence West 330
feet to the point of beginning.
Commencing at a point 100 feet North of the Southwest
corner of Lot 2 in Block 16 of the Original Rexburg,
Townsite of the City of Rexburg, Madison County, Idaho
as per the recorded plat thereof, and running thence
North 144 feet, thence East 330 feet, thence South 244
feet, thence West 192 feet, thence North 100 feet,
thence West 138 feet to the point of begnr,i.ng.
At such hearing the City Council will hear all person
and all objections and recommendations relative to such pro~s~
