MINUTES OF THE SPECIAL CITY COUNCIIL
MEETING OF THE CITY OF REXBURG, IDAHO

City of Rexburg)
The regular Meeting of the City Council of the City of Rexburg, Madison
County, Idaho was held on Wednesday, May 7, 1975, at the hour of 7:30 P. M.
at the City Hall, being the regular meeting place for said Council, at
which meeting there were present and answering roll call, the following,
who constituted a quorum:
Mayor: John C. Porter
Councilman: Glenn Peterson !

Barton Jensen
Warren Porter
Absent: George Catmull
Nile Boyle
Also Present: Mary Smith, City Attorney
Afton Anderson, City Clerk
Thereupon the following proceedings, amongothers, were duly had and
taken:
IRE: MINUTES APPROVED
Minutes of the previous meeting of April 16, 1975,
cussed. Councilman Barton Jensen moved we approve
corrected. Councilman Warren Porter seconded.

RE: STATE HIWAY WANTS TO CHANGE TRAFFIC LIGHT AT MAIN

STREET & 2nd WEST
Police Chief Blair Siepert, representing the Traffic Safety Commission,
reported. on a meeting with the State Highway Department concerning the
traffic light at Main Street ans 2nd West. The State would put left
hand turn areas and bays if the City would put parallel parking only
for 300' along main street. There is a concentration of accidents in
this area, and the traffic is backed up for quite a distance. The left
hand bays would allow traffic to move without the backup. Chief
Siepert reported that the State would move right along with this and
complete it this summer if the City would give them an immediate reply.
Morgan Garner, Councilman, moved that Chief Siepert notify them that the
City agrees to change the parking along Main for 300' to parallel
parking only if the State will put in the left turn lights and bays.
Councilman Glenn Peterson seconded.

INPUT HEARING
8:00 P. M. Input hearing
Citizens Attending:
J. D. Hancock, Don Ard, Clyde Anderson, Verla Chapman, Jim Flamm, Jack
Randall, Reed Larsen, R. L. Smith, Gayle Smith, carl Smith, Bob Nelson,
Galy Weber, Gordon Timothy, Lyle Saxton.
Problems brought up by citizens were as follows:
PARKING: Ist and 2nd East. Employees are parking along these streets
and making it hard for property owners to get in ans out of their driveways.
Business' along these streets are complaining. Mayor suggests putting in
2 hour parking along both of these streets. This should help also to
get the streets cleared away so the street crew can clean the streets.
PARKING: Peopl3 with apartments in their homes are not providing off
street parking for their students. This is getting to be a real problem.
The City needs to find out what people have apartment intheir
hom3s~and force them to provide parking or stop renting to students that
have cars.
DOGS: Gayle Smith. People letting their dogs run loose are a real
nuisance. Need to control the dogs and police the leash law. Mayor
Porter agreed that the dogs are a real problem but that the City has
a hard time keeping dog catchers.
PAf~KING: Clyde Anderson, Chamber of Commerce. The business' really
need customers parking 'in the dowtown area. Mayor Porter, after
various discussion, suggested that we study the problem for the next
two weeks and make any suggestions.
TAYOR RENTAL: This corner is real problem with them parking tractors
and other vehicles at the curb and on the sidewalk. North bound
traffic on Ist East just cannot see around the corner. Mayor Porter
will send the Police over to tell them to clean up this corner.
POLICE AND SHERRIFFS DEPT'S: Jack Randall feels the City and County
are not getting their monies worth out of our law enforcement. He
feels all the cars are in the lot at the court house instead of
being out on patrol. One of the sherriffs department sits in his
office and plays the guitar. He also feels there is too much use
of City vehicles for personal use.
ALLEY PAVING: Don Ard asks if the City will be paving the alley
from Barretts on South Center into Safeways. Mayor Porter advised
that Safeways has agreed to pave the alley as it is used for access to
their store.
BUILDING INSPECTOR: Gale Weber wants to know if the City has plans of
hiring a full time building inspector to attend planning board meetings
and Council meetings and coordinate everything. Mayor Porter says No.
Reed Larsen states that it is very awkward for contractors to have
to hunt all over for the building inspector.
IRE: PINEVIEW APARTMENTS
Mr. Lyle Saxton, Pineview Apartments on 2nd South wish to extend
their college housing. They now have a unit that will hold 208
students. The area where they wish to build is zoned R2 and it
would be necessary to rezone to R3. Mr. Saxton has obtained a petition
signed by all property owners in a 300' radius. Mr. Saxton agreed to
build a fence all along the property so taht students wouldn't bother
the residents in that area. Councilman Barton Jensen moved that this
area be rezoned R3 to accomadate in as much as Mr. Saxton agrees to
build a fence and in as much as there will be no additional street
exit and it meets all requirements. Councilman Glenn Peterson
seconded.

~RE: MAYOR, ENGINEER, MOULTON, & GARNER TO INSPECT CITY STREETS FOR REPAIRS
Councilman Morgan Garner, Engineer Clayter Forsgren, Mayor Porter,
and Dan Moulton Superintendent of the Street Department are going
around throughout the City to check all streets for trouble spots.
They will check the sumps that need cleaning and drains that need
fixing. They will take a map marked with streets that need repairs.
ARE: DELINQUENT LIDS
Attorney Mary Smith read letter on delinquent LID's This will give
them until May 21, 1975, to contact the City Clerk about their LID's
or the City will take over deeds. Councilman Glenn Peterson moved
we eliminate the Wilson Construction property as it is already deeded
to the City. Councilman Morgan Garner seconded.

IRE: A fJOTICE TO ABATE A NUISANCE TO BE SERVED
Attorney Mary Smith read a notice to Abate A Nuisance which will be
served on Frank Jenkins and The Rexburg Lumber Company. Pictures as
to the condition of the barns and corrals at 350 North 2nd West were
turned over to be kept on file in the City Hall. Councilman Glenn
Peterson moved the City Clerk be instructed to serve notice to
abate a nuisance to Frank Jenkins and The Rexburg Lumber Company.
Councilman Warren Porter seconded.

RE DEPARTMENT HEADS TO MEET EVERY WEDNESDAY AT 1:30 P.M.
Mayor John C. Porter advised that there will be a meeting every Wednesday
between 1:30 P. M, and 2:30 P. M. at City Hall with the Mayor and all
department heads. He asked that any Councilman able to come should
attend.
RE: DOUG HARDY ASKS PERMISSION TO MOVE OUT OF TOWN
Mayor Porter reports that Doug Hardy of the Water Department had
been to see him for permission to build a home out at Archer. After
general discussion, the Council agreed that employees of the fire
and water departments that have to be on emergency call must live in
a radius of one mile.
RE: DON FOWLERS STILL OFF WORK WAGES STOPPED
Mayor Porter reports that Don Fowler is still unable to come back to
work. Don Fowler has been on full salary while off work for two
months. There is a possibility that he may have to have surgery
again. The City has stopped his wages as of the Ist of May. He is
still getting his workmens compensation.
RE: SICKLEAVE POLICY AMENDED
Councilman Barton Jensen moved that we amend out 1966 sickleave
policy to read sickness, accident and or both. Councilman Glenn
Peterson seconded.

RE: AIC CONVENTION
There will be an Association of Idaho Cities convention in Idaho
Falls June 18 through 21. Please try to attend.
RE: COLLEGE REQUESTS TO COLSE CENTER STREET BETWEEN 2nd SOUTH AND 4th SOUTH
Ronaid Stone, representing Ricks College wish to close Center Street
between 2nd South and 4th South to make a park. The City will make
up an agreement to vacate that street and it will be taken up at the
next meeting.
2E: BILLS PASSED
Bills were presented for payment in the amount of $43,900.62 for
payment. Councilman Morgan Garner moved we pay the bills. Councilman
Barton Jensen seconded.

ZE OFFICER ISAACSON TO GET RAISE
The Council approved a pay increase for Officer Isaacson of the Police
Department. This would put him at his 4th step of the pay scale, the
wage being $614:00 as of May I, 1975.
~E: IGA BEER LICENSE TRANSFERED
Councilman Glenn Peterson moved that we transfer the beer license of
the James IGA to the new owners. Councilman Morgan Garner seconded.
