A regular meeting of the City Council of the City of Rexburg, Madison
County, State of Idaho, was called to order by the Mayor, John C. Porter
at 7:30 P.M. on February 5, 1975 at the City Hall at Rexburg, Idaho,
there being present the following:

Thereupon the following proceedings, among others, were duly had and
taken
ARE: MINUTES APPROVED
Councilman Nile Boyle moved that the minutes of the previous meeting be
approved as corrected. Councilman Morgan Garner seconded.

ARE: JERRY LEIDING PLANS TO START A TREE SERVICE COMPANY
Mr. Jerry Leiding plans to start a tree service company in the area in
and around Rexburg. He asked the Council about the probability of
getting the Cities work. Mayor Porter advised that if the City had
tree trimming or spraying that it would be put up for bids. The Council
felt there should be a need for this type of work as there is only one other
firm around that does trees.
~RE: JACK SCHOFIELD GIVEN PERMISSION TO START TYPEWRITER REPAIR BUSINESS
Mayor Porter read a letter from Jack Schofield asking for permission
to purchase a business license. He wants to run a typewriter repair
in the basement of his home on North Center. This is an RI zone,
however he would have no customers coming to his home; it would be pickup
and delivery work only. The Council felt he should be allowed to
have the business license if there are no customers coming there the
neighbors should have no objection.
IRE: DISCUSSION ON GARBAGE ORDINANCE
Discussion on the garbage ordinance. Mary Smith, City Attorney, will
have the garbage ordinance ready for passage at our next meeting.
Councilman Warren Porter moved that the garbage charge be raised to
$2.00 from $1.50. The general feeleing of the calls being that the
people would rather pay more for the service than have the pickup reduced
to once per week. Councilman Barton Jensen seconded.

RE: CITY APPROVES PLANS FOR TENTATIVE REXBURG HEIGHTS
Forsgren & Perkins, and Associates presented the tentative plans for
the Rexburg Heights. The plans showed a trailer court with a capacity
of 200 trailers plus a large housing development with building lots of an
acre each. Councilman Barton Jensen moved that the Mayor sign the plans
`"as approved. Councilman Nile Boyle seconded.

RE: CORDON TYCHEN TO GO AHEAD WITH REMODELING IN CITY HALL
Mayor John C. Porter reported to the Council that no remodeling had
been done on the Council chambers. Gordon Tychsen wants to remodel the
old water office which will be extended to the front office for a
work room. There are now two machines which have to be kept in the vault
as there is no space to keep them. The additional room will be for
these machines and the posting machine. Councilman Barton Jensen moved
that Gordon Tychsen be told to go ahead with the remodeling. Councilman
Morgan Garner seconded.

RE: BILLS APPROVED
Councilman Nile Boyle moved that the bills be approved for payment in
the amount of $81,296.61. Councilman Morgan Garner seconded.

RE: ORDINANCE 558
Attorney Mary Smith read ordinance 558 which, amends the zoning on the
properties on 5th West which were previously residential.
AN ORDINANCE AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG,
IDAHO, TO PROVIDE THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED IN REXBURG,
MADISON COUNTY, IDAHO, LOCATED WITHIN THE CITY LIMITS ON SOUTH FIFTH
WEST LYING BETWEEN THE RICKS COLLEGE COAL YARD AND THENCE NORTH TO THE
CANAL BE ZONED COMMERCIAL AND THAT THE PROPERTY HEREINAFTER DESCRIBED
AS THE NORTH HALF OF LOT 3, BLOCK 3 OF THE KLINGLER ADDITION TO THE
CITY OF REXBURG BEING 10 RODS WIDE AND 297 FEET DEEP BE ZONED COMMERCIAL.

Thereupon it was moved by Councilman Barton Jensen and seconded by
Councilman Nile Boyle that the rule requiring ordinances of a general
and permanent nature to be read fully and distinctly on three different
days be dispensed with and that said ordinance be numbered 558 and be
passed and adopted. as read.
Thereupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows:

The Mayor thereupon declared that the motion, having been passed by not
less than three-fourths of the Council, had been duly carried, and the
Ordinance No. 558 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 558 in at
least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
Councilman Warren Porter moved that the meeting adjourn, it now
being 9:05 P. M. Councilman George Catmull seconded.
