In order to continue serving the Rexburg area, he wishes to raise the monthly rate for cable TV $I.00. He rewuests that this change be effective January I, 1975. Councilman Warren Porter moved the rate increase of $I.00 be approved. Councilman Barton Jensen seconded. All Aye RE: BILLS APPROVED Councilman Barton Jensen moved the bills be approved for payment. Councilman George Catmull seconded. All Aye RE: ADJOURNMENT Councilman Warren Porter moved the meeting adjourn. Porter MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO State of Idaho) ii County of Madison(SS City of Rexburg) A regular meeting of the City Council of the City of Rexburg, Madison County, State of Idaho, was called to order by the Mayor, John C. Porter, at 7:30 P.M. on January 15, 1975 at the City Hall at Rexburg, Idaho, there being present the following: Mayor: John C. Porter Councilmen: George Catmull Warren Porter Glenn Peterson Barton Jensen Morgan Garner Nile Boyle Also Present: Mary Smith, City Attorney Afton Anderson, City Clerk Thereupon the following proceedings, among others, were duly had and taken: RE: BOISE-CASCADE HOUSING DEVELOPMENT ON-4th WEST APPROVED Mayor John C. Porter presented a Platt by Boise-Cascade for a housing development on 4th West. They asked the City Council to accept the plat and agree to have an LID to improve the streets in that area. Councilman Barton Jensen so moved that we accept the plat if it meets all the requirements of the building inspector and the planning board. Councilman Glenn Peterson seconded. All Aye RE: LETTER FROM FREMONT MADISON IRRIGATION COMPANY ASKING CITY TO PURCHASE WATER Mayor Porter read a letter from the Fremont Madison Irrigation Company, asking the City to purchase supplemental Teton Dam water. Councilman Glenn Peterson moved that the City does not need this .water now and that City Attorney, Mary Smith be instructed to notify the Fremont Madison Irrigation Company of our decision at their next meeting February 3, 1975. Councilman Barton Jensen seconded. All Aye IRE: CHARGE FOR AND REFUND ON TRADED IN GARBAGE BINS Councilman Nile Boyle reported on his garbage department that a decision is still needed as to what refund should be given on used garbage ~,.~ containers when they are traded in on new bins. Councilman Barton Jensen moved that we have a 10 yer depreciation and that the City should deduct a 10/ per year depreciation from the price they paid for their container, when trading it in on a new bin. They City will not buy back garbage containers; only take them in as trade-ins on new bins. Councilman Nile Boyle seconded. All Aye RE: CITY IS STILL HAULING ROGER BROTHERS GARBAGE Mayor Porter advised the Council that the City is still hauling Rogers Brothers garbage. The office is keeping track of all costs so we can bill them for the service. RE: APPRECIATION FOR SNOW REMOVAL The Council expressed appreciation for the job the street crew is doing on snow removal. They should be commended. IRE: SCHOOL DISTRICT WANTS CITY AND COUNTY TO PAY PART RECREATION LEADER SALARY Mayor John C. Porter reported that Robert Gentry of the recreation department of the school district had been to see him. The school district has asked the County and City to each pay $6,000 for his salary per year. Councilman Barton Jensen suggested having a meeting with the school district, county commissioners and city council to discuss it. None of the Council members felt this was a responsibility of the City or County, but agreed that as the school district had hired him it was not a City obligation. IRE: COOK PROPERTY & WAYNE RICKS PROPERTY TO BE REZONED The public hearing on December 12, 1974, having raised no objections to either the Cook property or the Wayne Ricks property change of zoning, the Council agreed to make the necessary rezoning. The third piece of property was withdrawn and action will be taken at a later date. Councilman Barton Jensen moved that the Cook property; (that portion of real property located within the city limits on South Fifth West lying between the Ricks College coal yard and thence north to the canal) be zoned commercial. Councilman Glenn Peterson seconded. All Aye. Councilman Glenn Peterson then moved that the Wayne Ricks property; (the North half of lot 3, Block 3 of the Klingler Addition, being 10 rods wide and 297 feet deep) be zoned Commercial. Councilman Nile Boyle seconded. All Aye ARE: ORDINANCE 556 City Attorney, Mary Smith read ordinance 556 AN INTERIM ORDINANCE APPROPRIATING SUFFICIENT FUNDS FOR PAYMENT OF EXPENSES AND SALARIES BY THE CITY OF REXBURG, IDAHO, DURING THE 1975 FISCAL YEAR PRIOR TO THE PASSAGE AND APPROVAL OF THE ANNUAL APPROPRIATION ORDINANCE; PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE. Thereupon it was moved by Councilman George Catmull and seconded by Council- man Glenn Peterson that the rule requiring ordinances by read fully and distinctly on three different days be dispensed with. It was then moved by Councilman Barton Jensen and seconded by Councilman Nile Boyle that said ordinance be numbered 556 and be passed and adopted as read. The Clerk thereupon called the roll on said motion and the roll call was: Those voting Aye: George Catmull Warren Porter Glenn Peterson Barton Jensen Morgan Garner Nile Boyle Those Voting Nay: None The Mayor thereupon declared that the motion having been duly passed by not less than three fourths of the Council had been duly carried, and that Ordinance No. 556 was duly passed and adopted. The City Clerk was directed to publish said Ordinance No. 556 in at least one issue of the Rexburg Standard or Journal, a Newspaper published in the ~8 C i ty of Rexburg, I daho. IRE: ORDINANCE 557 City Attorney, Mary Smith read ordinance 557 annexing the Jack Randall property adjoining the Ricks Addition and the Taylor Addition. AN ORDINANCE ANNEXING CERTAIN LANDS TO THE CITY OF REXBURG, IDAHO; DESCRIBING SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBURG, IDAHO; AND AMENDING AND CHANGING THE ZONING MAP OF THE CITY OF REXBURG, IDAHO, TO SHOW SUCH ANNEXATION AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING ORDINANCE OF THE CITY OF REXBURG, IDAHO, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. Thereupon it was moved by Councilman Barton Jensen and seconded by Councilman Glenn Peterson that the rule requiring ordinances to be read fully and distinctly on three different days be dispensed with. It was then moved by Councilman Nile Boyle and seconded by Councilman Barton Jensen be numbered 557 and be passed and adopted as read. The Clerk thereupon called the roll on said motion and the roll call was: Those voting Aye: Those voting Nay: George Catmull Warren Porter Glenn Peterson Barton Jensen Morgan Garner Nile Boyle None The Mayor thereupon declared that the motion having been passed by not less than three fourths of the Council had been duly carried, and that ordinance No. 557 was duly passed and adopted. RE: MANDITORY GARBAGE ORDINANCE STILL NEEDED Councilman Nile Boyle reported that the manditory garbage ordinance is still needed. He felt that if the garbage service was paid for by all; and the pickup was reduced for residences to once per week, there would be no need for a raise in the rates. Mayor Porter agreed to post in the paper twice, that the pickup would be reduced to once a week to see what the public felt about it. RE: BILL APPROVED Bills were presented for payment in the amount of $41,018.90 for payment. Councilman Glenn Peterson moved we approve the bills for payment. Councilman Barton Jensen seconded. All Aye Councilman Morgan Garner moved we adjourn the meeting, it now being 9:05 P. M.
