Un~~ed States Postal Department asks the City of Rexburg to wave all
permit costs on the new Post Office for Rexburg. The Council agreed
that the City was under no obligation to wave the costs.
RE: BILLS APPROVED
Bills were presented in the amount of $46,459.07 to complete the payments
for 1975. Councilman Glenn Peterson moved that the bills be approved for
payment. Councilman Morgan Garner seconded.

A regular meeting of the City Council of the City of Rexburg, Madison
County, State of Idaho, was called to order by the Mayor, John C. Porter,
at 7:30 o'clock P.M. on December 18, 197 y, at the City Hall at Rexburg,
Idaho, there being present the following:

George Catmull

Afton Anderson, City Clerk
Thereupon the following proceedings, among others, were duly had and taken:
RE: MINUTES APPROVED
The minutes of the previous Council meeting of December 4, 1974, were read
and discussed. Councilman Barton Jensen moved that the minutes be approved
as corrected. Councilman Glenn Peterson seconded.

RE: REQUEST FOR BETTER TRAFFIC CONTROL AT INTERSECTION OF HIGHWAY 88 & 5 W
Mr. Louis Phillips was recongnized by the Council and Mayor. Mr. Phillips
presented a petition requesting better traffic control at intersection of
Highway 88 and 5th West. The children crossing this intersection from
the Kennedy School are grades I through 6; and the parents feel that a
reduced speed limit is needed. The parents also feel that a traffic guard
should be provided for the morning, noon and afternoon hours when the
children are using the crosswalk. The petition was signed by 50 parents
with children using this crosswalk. Councilman Barton Jensen moved that
the City Council ask the State Highway Dept. for a lower speed limit and
a flashing light. Councilman Morgan Garner seconded. Mayor Porter
suggests getting it signifyed as a school zone.

RE: PUBLIC HEARING FOR ZONING CHANGE
Public Hearing zoning change on the property on the corner of 7th SoutCl"
and 5th blest and running West to the highway. Blair Heinz asks that
this property be zoned commercial. 3

Were present and presented written protest to the zoning change on 5th
West and 7th South.
Let-the records show that there were no protests on the zoning change on
the Cook property nor the Wayne Ricks property. Councilman Barton
Jensen moved we adjourn the zoning hearing until out next council meeting
which is January 15, 1975 at 8:00 P.M. Councilman Morgan Garner seconded.

RE: RESOLUTION FOR WORK PERIOD PER MONTH
Councilman Glenn Peterson introduced the following Resolution and moved
it's adoption, which was seconded by Councilman Barton Jensen and unanimously
carried:
BE IT RESOLVED that the Mayor and City Council of the City of Rexburg
hereby establishs, a 28 day work period per month with standard maximum
hours of 240 for such period, or a 7 day weekly work period of 60 hours for
a period of four weeks.
RE: DEPT. OF HEALTH & WELFARE PRESENT COPY OF PERMIT TO DUMP POLUTANTS IN RIVER
Mr. Hopson, of the Dept. of Health & Welfare presented to the Council a
copy of the permit required by the City of Rexburg to dump polutants into
the river. He advised the Council and members of the Water Department
requirements that would have to be met to comply with these regulations
in Rexburg. Monthly tests of the sewage ponds must be sent in; Mayor
Porter advised the Council that that City Engineer, Clayter Forsgren,
had sent for the necessary equipment to do these tests, and that his office
will do the tests, as required of the City.
RE: REPORT ON MEETING WITH COMMISSIONERS ON COSTS OF NEW JAIL
Mayor John C. Porter reported that he had attended a meeting with the
County Commissioners on the costs of the new jail. They had decided to
charge the City a rent of $350.00 per month on the new bill. After
much discussion the County agreed that the city would pay the jailors bills
on people arrested for misdemeanors only and that the County would have
to pay all the rest. As the County and City are both very concerned about
the high bills for feeding the prisoners, the County will put in a
refrigerator and electric range which will enable the jailor to serve
TV dinners for the prisoners.
RE: GARBAGE SERVICE DISCUSSED
Councilman Nile Boyle, after studying the lists of people living inside
the City limits and not paying for for garbage service, felt that the
City should pass a manditory garbage ordinance after the first of the
year.

RE: DON RYDALCH COMPLAINS ABOUT SEWER HOOK UP ON LID 19
Mayor Porter read a letter from Don Rydalch of 648 South 5th West.
Mr. Rydalch maintains that when the sewer line was put down his street on
LID, 19, the sewer line was put in to high to carry an additional bathroom
in his basement. It would cost them an additional cost of $450.00 for
a pump unit to elevate the sewage to the City line. Mr. Rydalch feels
that as he paid $1,480.00 on LID 19 and is only getting half service, the
City should give him a refund of $450.00. The Council felt they should
check into this before making a decision.

CABLE TV RATE TO RAISE
Mayor Porter read a letter from Don Ellis of the Rex TV Corporation asking
~-~' the Rexburg City Council to reconsider the schedule of charges.
In order to continue serving the Rexburg area, he wishes to raise the
monthly rate for cable TV $I.00. He rewuests that this change be effective
January I, 1975. Councilman Warren Porter moved the rate increase of
$I.00 be approved. Councilman Barton Jensen seconded.

BOISE-CASCADE HOUSING DEVELOPMENT ON 4th WEST APPROVED
Mayor John C. Porter presented a Platt by Boise-Cascade for a housing
development on 4th West. They asked the City Council to accept the
plat and agree to have an LID to improve the streets in that area.
Councilman Barton Jensen so moved that we accept the plat if it meets
all the requirements of the building inspector and the planning board.

IRE: LETTER FROM FREMONT MADISON IRRIGATION COMPANY ASKING CITY TO PURCHASE WATER
Mayor Porter read a letter from the Fremont Madison Irrigation Company,
asking the City to purchase supplemental Teton Dam water. Councilman
Glenn Peterson moved that the City does not need this water now and that
City Attorney, Mary Smith be instructed to notify the Fremont Madison
Irrigation Company of our decision at their next meeting February 3,
1975. Councilman Barton Jensen seconded.
