A regular meeting of the City Council of the City of Rexburg, Madison
County, Idaho, was held on Wednesday, the 21st of August, at the hour
of 7:30 o'clock P. M. at the City Hall, being the regular meeting place
of said Counci{, at which meeting there were present and answering roll
call, the following, who constituted a quorum:

The minutes of the previous Council meeting of August 7, 1974 were
read and discussed. Councilman George Catmull moved that the minutes
be approved as corrected. Councilman Nile Boyle seconded.

Mayor John C. Porter advised the Council that Mrs. Melvyn Sanford, of
460 Morgan Drive, Rexburg, Idaho, wanted to operate a kindergarten in
her home. A letter from D. Blair Manwaring, of the Rexburg City Planning
Board, advised that it would be permissible under the zoning ordinance
to allow this kindergarten if she obtains a petition with signatures of
80~ of adjoining property owners within 300 feet. Mrs. Sanford has
supplied the City with such a petition. Councilman Nile. Boyle moved the
City grant her permission to Aerate the Kindergarten but she must renew
this each year. Councilman George Catmull seconded.

E: LETTER FROM BERNICE TAYLOR PETERSON RELATIVE TO TAYLOR ADDITION OPPOSING
STREET TO NORTH

Mayor John C. Porter read the following letter dated August 16, 1974.
Dear Mayor and City Council:
On Wednesday, August 7, my attorney, Kent Jolley.A, and I met with you. at
your regular council meeting and discussed a proposed street Leading from
the north end of the Taylor Subdivision, and which would go through my
fot No. t4. I have given this matter considerab~ls thought and have
concluded that I do not want a street coming int~the Taylor Addition
from the north end, or from any direction other~tfian the one leading onto
Highway No. 88 for the following reasons:

In the Spring of 1969 I agreed to consider the possibility of having
a street exit from my subdivision on the north- nd, but placed a limita-
tion of five years on the agreement, and the fi-year period expired
this spring. "~
2. l have talked with alf of the home and lot .owners in the Taylor
Subdivision and none of them favor putting a street in the north end.
3, Subdivisions of this kind with a circular street and with only one
access are being constructed all ouer the State, they are very popular
and seem to be highly favored among residence owners.-
4. The Taylor Subdivision only has one access and all r-esidence owners
in the addition have fou~d:,that one access services the addition amply
well. I understand that Mr. Randall has at least two or three accesses
into his subdivision; whereas I think one would also be sufficient for
him.

7. Streets in the Taylor Addition are not wide streets and were not
' designed to handle a heavy traffic flow... A traffic congestEi.on problem
would be created if Randall and Ricks Additions were to~~use the Streets
in the Taylor Addition for access to those respective subdivisions.
~* 8.. I am confident in my own thinking that it is not in the best interest
of the residents of the Taylor Addition to have a street coming into
the subdivision f:r~im the north, anal I am also confidnnt in my own mind
that to not have a street join the Randall Additon dees not detract from
his subdivision nor will it create any problems of significance.
9. Even if it were in the best interests of all concerned to have a
road leading from .my subdivision to the north, I have had no indication
from the City or Mr. Randall, or anyone, as to who would pay for Lot no.
14, which has a sel i ir~~~<pr~e of $6,000.

I have taken it upon myself t.o make this decision for the reasons lisfed
above regardless of how I ma_y'be advised by my husband who sits on the
City Council or by my .attorney who has assisted me in the pas I
have simply gone to each'"residence. or lot owner in the Taylor Sub-
division and those who ire not in favor of such a street leading to the
north ahve signed a pett~kion 4and in fact the residence and lot owners
`were unanimous in opposing the.-read, so I feel compelled to take this

RULING FROM. SUB-DIVISION~ORDINANCE ON STREET ARRANGEMENT READ

Councilman Barton Jensen read a paragraph from the subdivision ordinance
which states: The arrangements of streets in new sub-divisions shall
make provision for the continuation of the existing streets in adjoining
areas for their proper protection where adjoining land is not subdivided
at the same or greater width but in no case less than the required
minimum width unless variations are deemed necessary by the planning
commission. The street arrangement must be such as to cause no unnecessary
hardship to owners of adjoining property .when they plat their own land
and seek to provide for convenient access to it. Where, in the opinion
f the planning commission, it is desirable to provide for street
ccess to adjoining property, proposed streets shall be extended by
edication to the boundary of such property.

Councilman Nile Boyle moved that the City accept the proposed plat of the
Jack Randall addition__shAwing the 4 access roads, and that the recommendation .
of the Planning Commission, including the annexation of his property be .~~~
carried out. Jack Randall agreed to have his property annexed although
he was going to continue farming the ground. Seconded by Morgan Garner.
Thereupon, the Clerk was ordered to call the roll on said motion and
the roll call upon said motion was as follows:

set up on a 2 month"trial period, with a minimum of $2.00 sewer charge
per month. Councilman Nile Boyle seconded.
