Ordinance No. 555
introduced, and there was read, the following

AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE N0. 401, FIXING RATES WHERE
WATER METERS ARE U5ED AND PROVIDING FOR AN INCREASE OF SAID WATER RATES
AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.
Thereupon it was moved by Councilman Nile Boyle and seconded by Councilman
Warren Porter that the rule requiring ordinances of a general and permanent
nature to be read fully and distinctly on three different days be dispensed
with and that said ordinance numbered 555 and be passed and adopted as
read.

call upon said motion was as follows..

The Mayor thereupon declared that the motion, having been passed by not
less than three-fourths of the Council had been duly carried, and that
ordinance No. 555 was duly passed and adopted.
The City Clerk was directed to publish said ordinance No. 555 in at least
one issue of the Rexburg Standard & Journal, a newspaper published in the.
City of Rexburg, Idaho.
Councilman Glenn Peterson moved the meeting be adjourned at 10:00 P. M.
Councilman Morgan Garner seconded.

The .meeting was called to order at 7:30 P. M., at which meeting there was

Minutes of the previous meeting of July 17, 1974 were read and discussed. ~
Councilman Nile Boyle moved the minutes be approved as corrected. Glenn

E: LILLIE ANDERSON CLAIM DISCUSSED
The Lillie Anderson claim was discussed. The Mayor reported to the Council

that Mrs. Anderson claims to have left 130 pounds of sugar and a box of
cotton candy cones out on her lawn and fihat the garbage crew picked it
up and threw it away. She feels the City should reimburse her in the
amount of $50.00. Mrs. Anderson did not report the mishap for 4 days,
and as the stuff was left on the curb where garbage is always left,
some test the City should not be responsible. After discussion, Council-
man Jensen suggested that the Mayor meet with Mrs. Anderson and. he could
settle the claim.

JACK RANDALL PRESENTED REVISED PLATT OF THE PROPOSED RANDALL ADDITION
Jack Randall presented his revised plait of the proposed Randa{I Addition,
showing 4 access streets, 1. 5th West street, 2. Ricks-Wade Street, 3.
Taylor Street, 4. K Street. Mr. Randall asked the Council to make
decision on whether the streets have to go into adjoining addition.

PEOPLE FROM K STREET PRESENT PETITION
Jim Mitchell and 5 other residents of K Street presented to the Council,
a petition asking the Council to consider their wishes in making this
decision. They felt if K street was opened up for access that there
should be at least 3 or more accesses so that all the traffic would not
go through their street as it is so narrow and there are 4i children
p4aying along that street.

BERNIECE TAYLOR $ ATTORNEY GIVE ARGUMENTS AGAINST OPENLNG TAYLOR ADD. STREET
Kent Jolley and Berniece Taylor Peterson arrived at the meeting to give
their arguments against opep~i:mg up the Taylor Addition street into the
proposed Randall Addition. Mr. Jolley advised that he remembers that
was a 5 year time limit put on the street through the Taylor Addition
and that the 5 years is up. The Council read the minutes of both the
planning board and. City Council meeting where the Taylor Addition Piat
was accepted with this access street, and there was no mention of the
5 year limit anywhere in the minute books.
COUNCIL TO AGREE WITH PLANNING BOARD RECOMMENDATIONS
Councilman Barton Jensen moved that the Council agrees with the
Planning Board recommendations. Seconded by Nile Boyle.

E: g~REET DEPARTMENT TO PUT UP CHAIN LINK FENCE AROUND NEWTON PROPERTY
Mayor John C. Porter told the Council that Mrs. Newton was still
having a bad time with the highschoo! students crossing her yard. She
had been trying to plant lawn and they just tromp .right through.
Council-man Jensen suggested Dan put in a chain link fence out to her property
line so the students couldn't cut across.
E: CITY TO ASK FOR BIDS FOR TENNIS COURT AND SKM~ING RINK
Councilman Warren Porter advised that the City really needed a full
size tennis court that was lighted. Mayor John C. Porter showed a
sample and explained about this plastic top that is placed over a tennis
court in the winter to make it usable as an ice skating rink. Council-
man Jensen suggested if it was lighted, they could possible have a
meter so that they had to put money in to keep the lights on for night
play, either for the ice skating rink or the tennis court. All agreed 1
this would be a very much needed facility, and suggested getting the bids f'
as soon as possible. Morgan Garner, Councilman, moved the City accepted
bids for a double tennis court, fully lighted. Councilman Glenn
Peterson seconded.
E: CHRISTMAS LIGHTS DISCUSSED
Mayor Porter suggested buying some new Christmas decorations for the
streets as there haven't been any purchased for a number of years and they
are getting in pretty bad shape. It was decided to spend $1,000 this year and
maybe. add to the lights each year. It was suggested that our Fireman train
to put up the Christmas Lights and decorations each year, as it is
costing the City nearly $1,000 per year.

We the residents and property owners of "K" Street, in .~ ~ ~,~}-
the City of Rexburg would like it put on .public record that
we oppose our street being a through street into Jack Randall's
proposed housing addition, north-west of the City.
Our reasons for opposing are as followas
1. "K" Street is not wide enough to accomod~te traffic for
thirty or more additional hornes;
2. residents are concerned about possible additional sewage
and water problems;
~. there is also concern about the additional traffic being
hazardous to the many small children on the street; (~ ~ c,~ , ,d ~-`,,~
4. also, we feel that there has been no effort made to inform
"K" Street residents about making "K" Street a through street
to the proposed Randall Addition.
Consideration to making "K" Street a through street would
be made with the followings
1. that there be three or more accesses to Jack Randall's
proposed addition. The accesses to be considered would be
that on "K" Street, at the Taylor Addition, on nth West, and
possibly through the Ricks-'Aade Subdivision.

traffic pressure for any one street, especially a street as
narrow as "K" Street.
2. Residents of "K" Street would like to be assured that
there will be no additional sewage and water problems or the
tearing up of existing facilities.

problem.

The bills were presented in the amount of $45,358.55 for payment.

Councilman Morgan Garner moved the meeting adjourn, it being IO:l5 P. M.

A regular meeting of the City Council of the City of Rexburg, Madison
County, Idaho, was held on Wednesday, the 21st of August, at the hour
of 7:30 o'clock P. M. at the City Hall, being the regular meeting place
of said Council, at which meeting there were present and answering roll

The minutes of the previous Council meeting of August 7, 1974 were
read and discussed. Councilman George Catmull moved that the minutes
be approved as corrected. Councilman Nile Boyle seconded.

,~,~ MRS. MELVIN SANFORD KINDERGARTEN APPROVED
Mayor John C. Porter advised the Council that Mrs. Melvyn Sanford, of
460 Morgan Drive, Rexburg, Idaho, wanted to operate a kindergarten in
her home. A letter from D. Blair Manwaring, of the Rexburg City Planning
Board, advised that it would be permissible under the zoning ordinance
to allow this kindergarten if she obtains a petition with signatures of
80~ of adjoining property owners within 300 feet. Mrs. Sanford has
supplied the City with such a petition. .Councilman Nile. Boyle moved the
City grant her permission to Aerate the Kindergarten but she must renew
this each year. Councilman George Catmull seconded.
