;E: MORGAN GARNER REPORTED ON THE WIDENING OF 4th EAST
Morgan Garner reported on the widening of 4th East. They need to
widen on west side and .put in no parking signs along there. Mayor
Porter suggested he get Clayter Forsgren and go up and find. out how
much needed widened to make it uniform and report back.
'.E: CITY TO PAY DONALD WYLiE $500 PER MONTH
Mayor John Porter reported the County Clerk, Neliis Garner, had told
him that the City must pay wages for Donald Wylie. He has been working
at the land fill and needed monthly salary now that he is off the
State prograrn. Mayor Porter suggested a wage of $.500 per month and
discontinue the hourly wage and travel pay given him now.

Mayor John Porter reported that Phyllis Terry, of the Association of
Idaho Cities would be here April 29, 1974, to work on the personnel
folder.
;E: AERIAL PHOTO TO BE TAKEN OF CITY
Mayor Porter told the Counci{ that Clayter Forsgren has arranged for
aerial photos to be taken of the City. He had advised the Water
Department to paint all their valves and manholes white so they would
show up in the photos.
BILLS PASSED
Bills were presented for payment in the amount of $19,461.18. it
was moved by Warren Porter that they be passed for payment. Seconded
by Morgan Garner.

Bill Caisse of the Water Department .asked the City to pay for his
dues to the Northwest Water Polution Control Association. Mayor
suggested we check in to it later.
Morgan Garner moved that the meeting adjourn it being 10:30 P. M.
Seconded by Glenn Peterson.

MEETING OF THE REGULAR CITY COUNCIL
OF THE CITY OF REXBllRG AT CITY HALL, MAY I, 1974
The meeting was called to order at 7:30 P. M. by Mayor John C. Porter.
Present were Councilman George Catmull, Warren Porter, Barton Jensen,
Morgan Garner, and Nile Boyle. Councilman Glenn Peterson was absent.
Present were City Attorney Mary Smith Oldham and City Clerk, Afton
Anderson. A{so present was Roger Porter, reporter for the Rexburg
Standard and Journal.
Councilman Barton Jensen moved that the minutes be approved as
corrected. It was seconded by Morgan Garner.

RE: PROTEST HEARING ON ZONING CHANGE
8:00 P. M. Protest .hearing on zoning change of Block 13. No one
arrived to protest. City Attorney, Mary Smith read in detail
Ordinance no 552.
RE: ORDINANCE 552

AN ORDINANCE AMENDING AND CHANGING THE. ZONING MAP OF THE CITY OF
REXBURG, IDAHO, TO PROVIDE THAT CERTAIN PROPERTY HEREINAFTER
DESCRIBED IN REXBURG, MADISON COUNTY, IDAHO, BE CHANGED FROM R3
ZONE TO COMMERCIAL.
Thereupon it was moved by Councilman Barton Jensen and seconded by
Councilman Nile Boyle that the rule requiring ordinances of a general
and permanent nature to be read fully and distinctly on three different
days be dispensed with and that said ordinance be numbered 552 and
be passed and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows.

Absent: Glenn Petersen
The Mayor thereupon declared that the motion, having been passed by
not less than three-fourths of the Council, had been duly carried, and
the Ordinance No. 552 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 552
in at least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
RE: CERTIFICATE
We, the undersigned Mayor and City Council of the City of Rexburg,
Madison County, State of Idaho, hereby certify and declare that the
Zoning Map of the City of Rexburg, certified by the Mayor and Council
of the City of Rexburg, Idaho, and filed with the City Clerk thereof on
the 3rd day of May, 1968, be, and the same is hereby amended to provide
that the hereinafter described property be, and the same is hereby
classified as Commercial under the zoning Ordinance of the City of
Rexburg; that said property is described as follows:
Lots I, 4, 5, 6, 7, and 8 in Block 13 of
the Klingler Addition to the City of
Rexburg, Idaho.
That the Zoning Map showing this amendment be, and the same is the
official zone. requirements of the City of Rexburg, Idaho.

RE: DAN MOULTON TO PURCHASE SPRAY ATTACHMENT FOR FERTILIZER
Councilman Warren Porter advised the Council that Dan Moulton had
been to see him about the application of fertilizer on the Porter Park.
Dan felt-that if he purchased an attachment for his tractor that would
spray the liquid type fertilizer, he would be able to fertilize both
the parks and the trees without so much expense. He reported that Dan
could buy this spray attachment for $400 or $500. The Council all
agreed that he should go ahead and purchase the attachment.

CLAYTER FORSGREN ASKS FOR ZONING CHANGE ON LAND. BY HIS OFFICE
Mayor Porter advised that Clayter Forsgren had asked for a zoning
change on the land by his office on the North Hiway. Councilman
Jensen suggested zoning some of the area as commercial as there were
quite a few businesses out in that area. Mayor Porter said the
Planning Board was working on it right now.
RE: D. [3. ROWBURY REQUESTS A ZONING VARIANCE
Mayor Porter reported that D. B. Rowbury had been in to see him
about a zoning variance. He is in a R2 zone. He has two large
diesel trucks which he parks in the street all the time, he wants
to build a large building for storage. and parking the trucks.
Councilman Jensen moved that Mayor Porter be instructed to have a
petition circulated to be signed by 80~ of the neighbors within 300
feet of Mr. Rowbury, at 410 West Ist North.
RE: STEVE MEYERS GIVEN PERMISSION TO BUILD GARAGE
The Steve meyers petition was turned in signed by his neighbors.
The Council agreed this gave him his zoning variance, so he could
build his garage.
RE: COMMITTEE ASKS COUNCIL TO WORK TOWARDS GETTING 3 ACCESSES TO NEW HIWAY
The Carl Agren Committee came before the Council requesting they
work towards getting three raised accesses to the City on the new
Hiway. They felt that if Rigby and St. Anthony could have the full
treatment, with raised accesses that the City Council needed to "
write the highway department, notifying them that we would not accept
anything less. Councilman Barton Jensen moved that the Council be
put on record as supporting the raised accesses regardless of which
route the highway took. It was seconded by Nile Boyle.

RE: BUD ARMSTRONG ASKS COUNCIL TO RECONS{DER STAND ON RAILROAD ROUTE
Bud Armstrong asked the Council to reconsider their stand on the
railroad route as he didn't feet they knew what added expense it
would incure. He noted that the highway would. cross 12 water lines
and 9 sewer lines which would cause either rerouting the lines or
make them inaccessable in case of a break.

Councilman Morgan Garner reported on the widening of 4th East.
Clayter Forsgren had drawn up two alternate plans. They approved the
one which called for widening the East side and making 32 parking
spaces along the side. Warren Porter moved that his plan be carried
out. It was seconded by Barton Jensen.

RE: REPAIRS ON SWIMMING POOL TO BE MADE, NEW RECREATION DIRECTOR TO BE HIRED
Councilman Warren Porter reported that Larry Perkins and Darrell Wasden
had been down to check the swimming pool and advise on repair costs..
He reported that he hadn't been able to get ahold of Brad balling,
the Recreation Director. Councilman Barton Jensen moved that Warren
Porter go ahead and hire a new Recreation Director. It was seconded by
Morgan Garner.

RE: REPAIRING OF STREETS BEING DONE
Mayor John C. Porter reported that Dan Moulton had been working
on patching the streets. He felt that if the street crew had a
jack hammer they would be able to patch the holes so they would stay
in longer. Morgan Garner said they were trying one out and if it
worked, suggested they let Dan buy it. Mayor Porter also mentioned, that
there were a lot of complaints because the streets were not being
replaced properly after they have been dug up to put in water, sewer,

RE: IRRIGATION DITCH TO BE KEPT OPEN BY PARK AND CEMENTED IN
Councilman George Catmull reported on the irrigation ditch. He
feels that the ditch should be kept open by the park to catch the
run off from the hill. Dan Moulton suggested cementing the ditch
in so it wouldn't take so much labor to keep it cleaned out. Barton
Jensen mentioned that they could cement the ditch in for a lot less
than they could run pipe down there. All agreed it needed to be
cemented in, and. possibly covered over.
SERVICE AGREEMENT WITH UTAH POWER & LIGHT
Mayor John C. Porter read a service agreement with Utah Power & Light
to bury the power lines to our irrigation pump. Councilman Barton
Jensen moved that the agreement be signed. It was seconded by Nile
-Boyle. .

RE: COMPLAINTS OF OFF STREET PARKING FOR COLLEGE STUDENTS
Councilman Barton Jensen reported that there were numerous cornplaints
from people that those renting to college students were not supplying
off street parking. He felt that when college started again this fall,
the city needed to crack down on this.
RE: FIREMAN TO GO TO FIRE SCHOOL AT LEWISTON

RE: PROBLEM WITH SOME STORM SEWERS
Mayor John C. Porter stated that he and Dan Moulton, Superintendent
of streets, had been riding around after the rain to check on the
job the storm sewers were doing. He reported that there were three
spots in the City where we still had a problem of ponding water.
The 3 locations being, Pearson Fine Auto on 4th South, Morris Madsen
at the corner of 2nd North and North Center, and the Viking Motel
on 2nd West. He suggested putting sumps in these three places, as
there is gravel there and should work very well. They would cost around
$400 each. Councilman Warren Porter moved that they go ahead and install
the sumps. It was seconded by Nile Boyle.

R ASSOCIATION OF IDAHO CITIES CONVENTION
Mayor John C. Porter reported that there was an Association of Idaho
Cities convention in Boise in June. All Councilmen and their wives
were invited to go. They were having a new type program for the
spouses. Councilman George Catmull felt they might be free to go.
The Mayor and his wife are planning to attend.
RE: FEDERAL FUNDS AVAILABLE TO PAY 90~ OF SEWER TREATMENT SURVEY
Mayor Porter advised the council that there were going to be Federal
Funds available to pay 90~ of the costs on these sewer treatment
surveys. Clayter Forsgren and Bud Armstrong are applying for the
grant along with Sugar City.
RE : LETTER FROM ROGER BROTHERS ~°~PR07ES~' 1 NG RAILROAD ROUTE FOR H I C~a~IWAY
Mayor John C. Porter read a letter from Rogers Brothers Company of
Rexburg, {daho, protesting against the Railroad Route for the Highway,
This route would go right through their waste drainage system and
restrict further growth. Councilman Nile Boyle moved. that the Mayor
and Council send a letter to the Highway Board asking them to consider
Rogers Brothers economic value to Rexburg, when they are naming the
route. Seconded by George Catmull.

RE: EMPLOYEE VACATION
Councilman Barton Jensen moved that the rule on vacations be put
on record as after one year an employee earns l week vacation; after
2 or more years he earns 2 weeks vacation. They must be taken within
14 months with no accumulation firom year to year. It was seconded
by Nile Boyle.

The bills in the amount of $29,151.69 were presented. Morgan
Garner moved the bi{Is be passed for payment. Warren Porter seconded
seconded the motion.

RE: BIDS ON TRUCK FOR STREET DEPARTMENT
Bids were opened for the I ton truck for the Street Department, There
were three bids; Rexburg Motor Company, whose bid was $5,205.91;
Stones flown & Country Motors, whose bid was $5,635.73; and .Taylor
Chevrolet, whose bid was $5,371.7.5. Barton Jensen moved that the
low bid from Rexburg Motor Company for $5,205.91 be accepted.

RE: BIDS ON POLICE CAR
Bids were opened for the Police Car. There were three bids; Rexburg
Motor Company Company, whose bid was $3,521.42, Stones Town & Country,
whose bid was $3,561.72, and Taylor Chevrolet whose bid was $3,763.74.
George Catmull moved that the low bid from Rexburg Motor Company
Inc for $3,521.42 be accepted. It was seconded by Niie Boyle.
