The City Clerk was ' directed to publish said ordinance No. 54$ in at least one issue of the Rexburg Standard & Journal, a newspaper published in the City of Rexburg, Idaho. RE: NOTICE OF PUBLIC HEARING I Attorney Mary Smith presented the Notice of public hearing to change the zoning of Block 13 of the Klinger Addition from R3 to Commercial. The Hearing will be May I, 1974, at 8:30 o'clock P. M., at City Hall. RE P`1AYOR ANNOU~dCED THAT HIGHSCHOOL WILL NOT BUILD A FOOTBALL STADIUM Mayor John C. Porter advised the Council that the high school would not be building a football stadium as the college has made available their football stadium anytime the highschool needs it. They will, instead have baseball diamonds, practice fields, ete. 8i11s were paid in the amount of $45,190.36. Moved by Warren Porter, and seconded by George Catmull. Gl _ / / Mayor ~- // City Clerk MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY OF REXBURG, AT CITY HALL APRIL 17, 1974 The Meeting was called to order by Mayor John C. Porter at 7:30 P. M. Present City Attorney Mary Smith Oldham, and City Clerk, Afton Anderson. Councilmen George Catmull, Warren Porter, Glenn Peterson, Barton Jensen, Morgan Garner, and Nile Boyle were all present. Also present were Carol Davis of the Post Register, Mr. Ken Newman, of Burrows, Smith & Co., and Jim Keller of Forsgren, Perkins, & Associates. Gordon Tychsen of the Rexburg Fire Department and William Caisse of the Water & Sewer Department were there as obs^rvers. RE: MINUTES APPROVED The minutes of the previous meeting were discussed and Councilman George Catmull moved they be approved. It was N~econded by Councilman Barton Jensen. All Aye Rid 4~JIDUISON ADDITION APPROVED Mayor John C. Porter presented a plat on the Widdison Addition for approval. The location being out of the City Limits but still requiring the Council's approval, it being adjacent to the Starlite Addition. Councilman Jensen, after discussion, moved that the plat be approved. Councilman Peterson seconded. All Aye r a t a RE: LETTER FROM ENVIRONMENTAL & COMMUNITY SERVICES Mayor Porter read the following letter from the Department of Invironmental and Community Services. Gentlemen: The Department of Environmental and Community Services (D.E.C.S.) has been appointed by Governor Cecil D. Andrus as the single state agency charged with the responsibility of determining local needs regarding drug abuse. We are presently conducting a random survey of local citizens in compliance with federal funding regulations. The survey is primarily concerned with the incidence and prevalence of drug use in Region Vll, and the data will be used only to assess the need for preventative and treatment programs in our area. Survey personnel have been hired and will be conducting the interviews in your community. The survey personnel will have identification tags on their coats and will in most cases be working in groups of two or three. Although confidentiality is maintained and surveyors are well trained, .the questionnaire being utilized could be considered offensive or .controversial to some citizens. If your office or agency received complaints, please contact me (524-2060 ext. 270). If you have any questions, please call me. This survey should be completed in the entire region (nine southeastern counties) by June I, 1974. Sincerely, Jerry A. Taylor Drug Abuse Coordinator JT'b RE: COUNTY WEED CONTROL TO SPRAY ALONG DITCHES AND CANALS Mayor Porter .advised the Council the John Lusk of the County Weed Control had been to see him. They are having a lot of trouble with Leafy Spurge and want to spray along ditches and canals. They wanfi the City to share 50~ of the cost of labor and material. Councilman Glenn Peterson moved that we go along with the program. Councilman Morgan Garner seconded the motion. All Aye RE: CITY TO RENEW AGREEMENT WITH UNION PACIFIC RAILROAD Mayor Porter read a letter from the Union Pacific Railroad, asking the City to renew agreement with them far the storm sewer which goes under the railroad ctrossing, It was moved by Barton Jensen to renew the agreement. Seconded by George Catmull. All Aye RE: FISCAL AGENT OFFERED A PRESENTATION, DISCUSSION ON SALE OF BONDS Mr. Ken Newman, Fiscal Agent for the City of Rexburg, from Burrows, Smith and Company, of Salt Lake, offered a presentation. He read the timetable for the construction to begin by middle of May, and has requested bond attorneys in Denver to draft necessary papers. He advised the Council of the formal proceedings for calling sale of $500,000 GOB bonds, and $500,000 Water Revenue Bonds, and setting the sale of bonds date at May 15, 1974. He advised that the City must have money for completion of the project before bids are awarded. Mr. Newman reported that interest rates are high now but may go even higher; he recommends going ahead as construction costs are also going higher. 1 ~~~~ _. Councilman Glenn Peterson All Aye CITY ATTORNEY TO GET A LETTER OF COMMITTMENT FROM RICKS COLLEGE, RESOLUTION READ Mr. .Ken Newman, Asked the City Attorney, Mary Smith to get a letter of Committment from Ricks College for the proposed $291,000.00. Mary Smith, City Attorney, read resolution on bond. It was moved by Barton Jensen that it be passed. Seconded by Nile Boyle. All Aye RE: REX CATMULL OF IDAMONT HOTEL PROTESED GARBAGE RATES Rex Catmull, of the Idamont Hotel protested his garbage rates. •He felt they were too high. Mayor Porter suggested they check them and correct if necessary. RE: JACK RANDALL ASKS FOR DECISION ON TAYLOR ADDITION .NORTH STREET Jack Randall was at the meeting to get the .decision of the Planning Board on .the Taylor addition north street. No answer as yet. RE: STEVE MEYERS ASKED FOR A VARIANCE TO BUILD A GARAGE AT HIS HOUSE Steve Meyers asked for a variance to build a garage at his house. The City had stopped his building a garage after obtaining the building permit from the Building Inspector Max Brinton. The Council agreed that the permit was issued in violation without proper checking. Councilman Barton Jensen recommended getting a petition signed by the neighbors. The Council would make decision in two days time and would let him know. Petition to be signed by .neighbors within 300 ft. of Meyers property. Permission was given. RE: SENIOR CITIZENS REPORT Glenn Peterson reported that the Senior Citizens were having a luncheon the following day at IZ Noon at the VFW hall. RE: PORTER P,gRK TO BE FERTILIZED AND WALL<WAYS TO GET OIL MAT Warren Porter asked the Council for permission to give Dan Moulton the go ahead on fertilizing the Porter Park. The cost would be around $500. It is very badly needed. They all felt we should proceed. Warren also reported that Dan Moulton wanted to put an oii mat on the walkways at the park. This was approved. Barton Jensen said also put 'fertilizer in the plant boxes so the Civic Club could plant their ,petunias again. -• CITY TO PURCHASE IRRIGATION PUMP George Catmull reported presented a cost proposal on the pump for irrigation water that is needed. Councilman Morgan Garner moved that we purchase the-pump, and sign .over I water right to Harold Nielson upon getting a release signed by Harold Nielson. It was seconded by Barton Jensen. All Aye ,~ ,. i _ 1 RE: MORGAN GARNER REPORTED ON THE WIDENING OF 4th EAST Morgan Garner reported on the widening of 4th East. They need to widen on west side and put in no parking signs along there. Mayor Porter suggested he get Clayter Forsgren and go up and find .out how much needed widened to make it uniform and report back. RE: CITY TO PAY DONALD WYLIE $500 PER MONTH Mayor John Porter reported the County Clerk, Nellis Garner, had told him that the City must pay wages for Donald Wylie. He has been working at the land fill and needed monthly. salary now that he is off the State program. Mayor Porter suggested a wage of $500 per month and discontinue the houriy wage and travel pay given him now. ~E: PHYLLIS TERRY OF AIC TO BE HERE APRIL 29 TO WORK ON PERSONNEL FOLDER Mayor John Porter reported that Phyllis Terry, of the Association of Idaho Cities would be here April 29, 1974, to work on the personnel folder. ~E: AERIAL PHOTO TO BE TAKEN OF CITY Mayor Porter told the Council that Clayter Forsgren has arranged for aerial photos to be taken of the City. He had advised the Water Department to paint all their valves and manholes white so they wouid show up in the photos. ~E: BILLS PASSED Bills were presented for payment in the amount of $19,461.18. It was moved by Warren Porter that they be passed for payment. Seconded by Morgan Garner.
