MINUTES OF A SPECIAL MEETING OF THE CITY
COUNCIL OF THE CITY OF REXBURG HELD
MARCH 22, {974, at 7:30 O'CLOCK P. M. AT
THE CITY HALL

In the excused absence of the City Clerk, Afton Anderson, the Mayor
.asked the City Attorney, Mary Smith, to take the minutes.
;E: RESOLUTION FROM CITY TO FEDERAL COMMUNICATIONS COMMISSION PRESENTED
Ttie Mayor presented a proposed resolution from the City to sent to
the Federal Communications Commission to give relief to the citizens of
the City of Rexburg by making the non-suplication rules and regulations
affecting the Mountain Time Zone conform to those rules that apply to
the remainder of the United States, and setting forth that the City
is unalterably opposed to the continuance of such discriminatory rules
and regulations. It was moved by Glenn Petersen and seconded by George
Catmull that such resolution be adopted. On roll call the following
voted Aye: Glenn Petersen, Morgan Garner, George Catmull, and Nyle
Boyle. The Mayor thereupon declared the resolution carried.
E: CITY INCLUDED AS DEFENANT IN A SUIT BY MARTIN D. HARRIS
The Mayor reported that the City of Rexburg had been included as the
defendant in a suit by Martin D. Harris, et al, claiming damages by
reason of a accident involving the ambulance when Martin D. Harris was
being transported to an Idaho Falls hospital. The Mayor stated he
would hand the papers to the insurance company.

The Mayor further reported that the City had received a letter from the
United States Environmental Protection Agency that the City's application
for reimbursement of the entitlement of $27,699.00 would be fifty
percent of that amount and that payment would be authorized.

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY OF
REXBURG, IDAHO, FOR THE FISCAL YEAR 1974, AND APPROPRIATING TO THE
SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT,
FROM THE REVENUE DER{VED FROM TAXES LEVIED FOR-SAID YEAR, AND ALL OTHER
COURCES, INCLUDING FEDERAL REVENUE SHARING, SUCH SUMS AS MY BE NECESSARY
OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES
LIABILITIES OF SAID CITY FOR THE FISCAL YEAR 1974.

Ordinance 547 introduced, and there was read.
Thereupon it was moved by Councilman Glenn Peterson and seconded by Counci{-
man George Catmull that the rule requiring ordinances of a general and per-
manenfi nature to be read fully and distinctly on three different days be
be dispensed with and that said ordinance be numbered 547 and be passed
and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and the roll
call upon said motion was as follows:

The Mayor thereupon declared that the motion, hav i ncd lre~rl pc~5 Egad by nr~t
less than three-fourths of the Council, had been duly carried, and the
Ordinance No. 547 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 547 in at
least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.

The Mayor reported that Harold Nielsen had contacted him about his
city water. The Mayor asked George Catmull to contact Barton Jensen
and see what agreements the City had made with Mr. Nielsen in the past
The matter was discussed.
A DIFFERENT WAY TO REPORT THE BUILDING PERMITS
The Mayor said that he, together with Tom Matthews, the City Building
Inspector, had figured out a different way to report the building
permits which had been issued. He had a sample copy which he showed to
the Council and the Council approved.
SPECIAL CENSUS FIGURE OF 1973 NOT CONSIDERED IN FEDERAL REVENUE SHARING
The Mayor further reported that he had received a letter from the
Secretary of .the. Treasury advising him that the special census figure
of 1973 would not be considered in Federal Revenue Sharing; that only
the official census of 1970 would be considered. In order to provide
equitable treatment for all governments, the special census would
only be considered if a comparable special census was available for all
other governments within the county area as of the same time period.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Minutes of the regular meeting held April 3, 1974, at 7:30 P. M. at
City Hall.
Mayor John C. Porter was present and presiding. The meeting was called
to order. Present were Councilmen Barton Jensen, Glenn Peterson,
Warren Porter, George Catmull, and Nile Boyle. Attorney Mary Smith
and City Clerk Afton Anderson were also there. Mike Green of the
of the Post Register and Roger Porter of the Rexburg Standard and
Journal.
Minutes of special meeting March 22, 1974, were read by City Attorney
Mary Smith. It was moved by Glenn Peterson that they be approved.
Seconded by Warren Porter.

Minutes of the regular City Council meeting of March 20, 1974, was
discussed. Glenn Peterson moved that they be approved as corrected.

RICKS COLLEGE PLANNING BI-SENTENIAL CELEBRATION
Mr Peterson and Mr. Bossard of Ricks College arrive at the meeting.
They asked that the City be plaMning for the Bi-Sentenial Celebration
for 1976. They wanted to have a good program and asked the City's
Co-operation.
