Barton Jensen suggested George Catmull as Finance Chairman contact

RE: GARBAGE CHANGES CHARGES PRESENTED
Nile Boyle presented proposed garbage changes charges, fior business
district. Will discuss next Council.
RL. ACCURATE INVENTORY TO BE MADE
George Catmull moved that an accurate inventory he made of all departments
and currently checked. Seconded by Nile Boyle. All Aye
RE BILLS APPROVED
Moved by Warren Porter that the bills in the amount of $18,492.46 be
approved for payment.. Seconded by Glenn Peterson.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Minutes of the regular meeting held March 20, 1974, at 7:30 P. M. at
City Hall.
Mayor John C. Porter was present and presiding. The meeting was called
to order. Present were Councilmen George Catmull, Barton Jensen,
Morgan Garner, Warren Porter, Glenn Peterson, and Nile Boyle. Minutes
being taken by Afton Anderson, City Clerk. Attorney Mary Smith Oldham
was absent. Mike Green of the Post Register and Roger Porter of the .
Rexburg Standard & Journal were also present.
Barton Jensen moved that the minutes of the previous meeting be approved
as read. It was seconded by Morgan Garner.

IRE MAYOR READ LETTER FROM PLANNING BOARD ON REZONING CERTAIN AREAS
Mayor John C. Porter read a letter from the planning board suggesting
'the council change lots 1,4,5,6,7, & 8 of block 13 in Klinger Addition
to Commercial zone. Glenn Peterson mentioned that there is a lot of
interest in block 13 for business sites. They have a petition from
12 property owners adjoining this area giving their permission. The
planning board suggest 4 lots of 12 and block 4 all be zoned commercial
George Catmull moved to hold hearing. Seconded by Warren Porter.

NOTICE IS HEREBY GIVEN THAT A public hearing will be held and conducted
by and before the City Council of the City of Rexburg, in the Council

Chambers in the City Building in Rexburg, Idaho, on Wadrlesday, the 1st
day of May, 1974, at 8:30 o'clock P. M, of said day, for the purpose of
conducting a public hearing regarding proposed amendments and changes
of Zoning .Ordinance No. 478 of the City of Rexburg, Idaho, to provide
that the hereinafter described property be changed from R3 Zone to
Commercial; that said property is described as follows, to-wit:
Lots I, 4, 5, 6, 7, 8 in Block 13 of the Klingler Addition to the
City of f~exburg, Idaho.
At such hearing the City Council will hear all persons and all objections
and recommendations relative to such proposed amendments and changes.
This notice is given pursuant to the provisions of Ordinance No. 478 of
the City of Rexburg, Idaho.

MAYOR HAVING VOUCHERS MADE FOR TRAVEL EXPENSE
Mayor John C. Porter gave the Council an idea of the vouchers he was
having made up for travel expense. They would follow the same pattern
as the state travel vouchers. All agreed these were needed as there
has previously been no rules regulating the expenditures for travel.
PERMISSION GIVEN FOR NEW GAMBLES STORE
Jim Mitchell of Rigby and Neil Powell of Blackfoot arrived at the
meeting to obtain permission for a building permit to build a new
Gambles store next to Hirsch's in the shopping center on South Center.
Councilman Glenn Peterson reported that they had been to see the Planning
Board the previous night but that they did not have adequate parking.
Jim Mitchell presented maps and plans showing the location and position
of the building and the available parking. The Council felt that there
needed to be an additional 2 parking spaces. Nile Boyle moved that
permission for the building permit be given whereas there ds permission
given by the adjoining stores for the additional 2 parking spaces.

BUILDING PERMIT NEEDED TO DIG ON YOUR OWN PROPERTY OR A VACANT LOT
Glenn Peterson brought up a question asked him by contractors in
Rexburg. Does the City require a permit to dig on your own property f
or in a vacant lot? Warren Porter, after discussion, felt that this
should be covered by obtaining a building permit. All Agreed.
MOTT FOl1NDATlON DISCUSSED
Mayor John C. Porter reported he had attended a meeting with the
School Board, the object of discussion being the Mott Foundation.
The BYU is now running the Mott Foundation with a completely new '
program. They would send a graduate student to Rexburg, (if we participated)
for 9 months to run our recreation programs. This would be at a cost
of $1,000 for the City and $1,000 for the school board. If the direci~or
turned out to be a good one we could then see about hiring him on a
permanent basis. All agreed it sounded like a better program. Mayor
Porter stated that they were checking further and would let him know.
RE: COMPLAINTS ABOUT PARKING AT TRI COUNTY EQUIPMENT

Councilman Morgan Garner reported that there were a lat of complaints
from Rexburg City Residents and Merchants on the parking at Tri County
Equipment. He stated that they were parking their trucks across the
sidewalks and stopping all walking on that side of the street. Mayor.
Porter advised having the police department pay them a visit and give
them a warning that it would have to stop.
RE: COMPLAINTS ABOUT THE STREETS OVER BY THE NEW HIGHSCHOOL
There were also complaints about the streets over by the new highschool.
There are no sidewalks and the streets haven't been finished yet. The
kids have to walk in the muddy streets or on peoples fawns. Councilman
Jensen said Hartwell would be finishing the streets there, as soon as
it was warm enough to lay asphalt.
RE: NORTH 4TH EAST ALONG SMITH PARK NEEDS TO BE WIDENED
Councilman Morgan Garner, Chairman of the Streets Committee, asked that
a study be made to widen North 4th East along Smith Park. He pointed
out that traffic has increased since the high school opened and that
the narrow section of the street, from Main Street north of the City
ditch crossing, is not wide enough to handle the increased traffic.
The street is scheduled to be resurfaced this summer and Garner suggested
that it be widened before this is done. The Counci{ wi{I study the
proposal and make a recommendation at the next meeting. Mayor Porter
suggested all the members of the Council drive past this street before
the next council meeting.
~RE: CITY NEEDS A NEW MANAGER FOR THE SWIMMING POOL
Councilman Warren Porter, Chairman of Parks and Recreation, reported
that the City would need a new manager for the Swimming Pool this
summer as Brad Parkinson has resigned. He mentioned that he had received
one application.
RE SCHEDULE OF NEW GARBAGE RATES PRESENTED
Councilman Nile Boyle, Chairman of Health and Sanitation, presented a
schedule of new garbage rates .for the Commercial Area and recommended
that they be adopted. He reported that some of the Businesses were
getting a daily pickup and were .being charged the same as others with
a twice weekly pickup. .These new rates would insure that they were
paying for the service they are getting. Nile Boyle moved that the
City adopt the new commercial garbage rates and they go into effect
May I, 1974. Barton Jensen seconded. AI! Aye.
RE: NEW GARBAGE TRUCK SHOULD BE HERE IN JUNE
Mayor John C. Porter stated that the new garbage truck should be here
in June so we should have the new ordinance ready by then to make the
garbage service manditory and change the rates.
RE: MAYOR WANTS TRAILER ORDINANCE READY TO PASS AT THE NEXT COUNCIL
Mayor John C. Porter reported that he wanted the trailer ordinance
ready to pass at the next council. The necessary changes have been
made.
RE MAYOR REPORTS ON MEETING WITH THE STATE HIWAY BOARD
Mayor John C. Porter reported that he had been to a meeting with the
State Hiway Board. They notified him that whichever location the
highway takes they will jive the City 3 accesses. There will be a
cloverleaf access on highway 88 and 2 interchange of grade accesses,
one at each end of the City. They will. buy right of way for any
future cloverleaf accesses needed. Whichever route is taken, they
will be buying right of way within 10 to 30 days of the hearing,
April 16th.
RE: EDNA V{LLELLA GETS RAISE.
A $25.00 raise was approved for Edna Villella the City Meter Maid.
RE: BILLS PASSED
Glenn Peterson moved that the bills be approved for payment in the

COUNCIL OF THE CITY OF REXBURG HELD
MARCH 22, 1974, at 7:30 O'CLOCK P. M. AT

In the excused absence of the City Clerk, Afton Anderson, the Mayor
asked the City Attorney, Mary Smith, to take the minutes.
~E: RESOLUTION FROM CITY TO FEDERAL COMMUNICATIONS COMMISSION PRESENTED
Tt~e Mayer presented a proposed resolution from the City to sent to
the Federal Communications Commission to give relief to the citizens of
the City of Rexburg by making the non-suplication rules and regulations.
affecting the Mountain Time Zone conform to those rules that apply to
the remainder of the United States, and setting forth that the City
is unalterably opposed to the continuance of such discriminatory rules
and regulations. It was moved by Glenn Petersen and seconded by George
Catmull that such resolution be adopted. On roll call the following
voted Aye: Glenn Petersen, Morgan Garner, George Catmull, and Nyle
Boyle. The Mayor thereupon declared the resolution carried.
tE: CITY INCLUDED AS DEFENANT IN A SUIT BY MARTIN D. HARRIS
The Mayor reported that the City of Rexburg had been included as the
defendant in a suit by Martin D. Harris, et al, claiming damages by
reason of a accident involving the ambulance when Martin D. Harris was
being transported to an Idaho Falls hospital. The Mayor stated he
would hand the papers to the insurance company.
CI~tY RtCEIVED LETTER FROM UNITED STATES ENVIRONMENTAL PROTECTION AGENCY

The Mayor further reported that the City had received a letter from the
United States Environmental Protection Agency that the City's application
for reimbursement of the entitlement of $27,699.00 would be fifty
percent of that amount and that payment would be authorized.

REXBURG, IDAHO, FOR THE FISCAL YEAR 1974, AND APPROPRIATING TO THE
SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT,
FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID YEAR, AND ALL OTHER
COURCES, INCLUDING FEDERAL REVENUE SHARING, SUCH SUMS AS MY BE NECESSARY
OR DEEMED NECESSARY BY THE MAYOR AND CITY COUNCIL TO DEFRAY THE EXPENSES
LIABILITIES OF SAID CITY FOR THE FISCAL YEAR 1974.
It was seconded by Warren Porter.
