RE: VERN ANDERSON ASKS TO PRC}CEED W1TH THE ANNEXATION OF HIS PROPC:RTY
The Mayor stated that Vern Anderson had called him and wanted to
proceed with the annexation of his property immediately South of the
City limits. The matter was discussed.
RE: MINUTES READ AND APPROVED
Minutes of the regular meeting held December 5, 1973, were read and on
motion of Ruth Smith, seconded by Barton Jensen, and unanimously carried,
the minutes were approved as amended and corrected. Mayor Shirley read
the minutes of a special meeting held December 13, 1973, at 3:30 p.m.
On motion of Richard Davis, seconded by Ruth Smith and unanimously
carried, the minutes were approved.
RE •. AFTON ANDERSON TO RECEIVED ADDITIONAL COMPENSATION
Mayor Shirley suggested that Afton Anderson should have additional
compensation for the last two weeks of December for the reason that she
had been acting as full-time City Clerk and Treasurer. The matter
was discussed. It was moved by Albert Pieper, seconded by Ruth Smith,
and unanimously carried that $50.00 be added to her last check without
any committment beyond that.
RE: BILLS READ AND APPROVED
Bills in the amount of $20,915.02 were read.. It was .moved by Barton
Jensen, seconded by Albert Pieper, and unanimously carried that the
same be approved and paid.
It was moved by Ruth Smith, seconded by Barton Jensen, and unanimously
carried that meeting adjourn..

MINUTE5 OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Minutes of the regular meeting held January 2, 1974, at 7:30 P. M.
at City Hall.
Present and presiding Mayor Henry Shirley. Also present were
Councilmen Glenn Peterson, Barton Jensen, Dick Davis, Ruth Smith,
Warren Porter, and Albert Pieper.
4~' Others present were Mike Green of the Post Register and Roger Porter
of the Rexburg Standard and Journal. Present also were .Tom Williams
- and Vern Anderson as interested observers.
Minutes were read by Attorney Mary Smith. Motion was made by Ruth
Smith that the minutes be approved. It was seconded by Dick Davis.
ORDINANCE 545
City Attorney Mary Smith read Ordinance 545 annexing 40 acres on
South 5th West, the 40 acres being zoned Commercial. Tom Williams
and Vern Anderson asked that a strip along the frontage of 5th West
be zoned R 2 or R3 to restrict the building along the road. They felt
this property should be zoned Residential to comply with the Residential
area it joins. Barton Jensen recommended frontage 294.7 ft. wide and
240 ft. deep be zoned R2.
Mary Smith, City Attorney introduced, and there was read, the following
ordinance in full:

SAID LANDS AND DECLARING SAME A PART OF THE CITY OF REXBUF-~G, IDAHO; AND
AMENDING AND CHANGING THE ZOING MAP OF THE CITY OF REXBURG, IDAHO, TO
SHOW SUCH ANNEXATION AND THE CLASSIFICATION OF THE SAME UNDER THE ZONING
ORDINANCE OF THE CITY OF REXBURG, IDAHO, AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
.Thereupon it was moved by Councilman Glen Peterson and seconded by
Councilman Albert Pieper that the rule requiring of a general and
permanent nature to be read fully and distinctly on three different days
be dispensed with and that said ordinance be numbered 545 and be passed
and adopted as read.
Thereupon the Clerk was ordered to call the roll on said motion and the
roll call upon said motion was as follows:

Those voting Nay: None
The Mayor thereupon declared that the motion, having been passed by
not less than three-fourths of the Council, had been duly carried, and
the .Ordinance No. 545 was duly passed and adopted.
The City Clerk was directed to publish said Ordinance No. 545 in at
least one issue of the Rexburg Standard or Journal, a Newspaper
published in the City of Rexburg, Idaho.
RE: IF SEWER OR WATER LINES NEEDED PROPERTY OWNERS TO PAY FOR ON ANNEXATION LANDS
Dick Davis recommended annexation be made with the understanding that
if either sewer or water lines are required in the near future the full.
expense be paid by the property owners. Vern Anderson asked if the
City would take care of the lighting the streets in the future.
RE: IF STREET LIGHTING IS NEEDED OWNERS TO RETURN AND ASK COUNCIL ABOUT tT
Mayor Henry Shirley suggested that they come back to the council when
the need arose. Councilman Davis stated that the City does not pay for
lighting streets on private property anyway. He <~Iso noted that if
there is a need to increase sewer lines or put in a lift station the
property owner must stand the cost.
RE: WATER LINES TO BE PUT IN HOPFULLY BY SUMMER
Vern Anderson asked men the. City anticipation the water lines would
be put in. Councilman Dick Davis said that they hoped. by next
summer they would have the t8" line extended that far.
RE: MAYOR PASSED OUT BALANCE SHEETS SHOWING 1973 EXPENSES
Mayor Henry Shirley passed out balance sheets showing the end of
1973 expenses. Each councilman received a copy to show them how their
departments finances were at the end of the year.
RE; MAYOR SHIRLEY THANKS COUNCIL AND EMPLOYEES
.'' Mayor Henry Shirley presented a list of high priority projects for the
~~ new year. He thanked the council for the cooperation given him.
He thanked the City employees, stating they were loyal, competent,
and efficient, and should be given credit. He also stated the residents
of Rexburg deserve credit for progress, for being willing to make
expenditures when necessary. He also thanked Ricks College, which means
so much to the City in so many ways through the years.

RE: WARREN PORTER GAVE MAYOR AND RETIRING COUNCIL VOTE 0~ THANKS
Warren Porter gave Mayor and retiring Council vote of thanks, whsle
retiring Council gave best wishes to new administration. Councilman
Davis remarked that the Mayor job is a full time job. Mayor Shirley
remarked that he had been swept along on the tide.
RE: BILLS APPROVED
Bills were approved for payment in the amount of $48,942.77. The
motion was made by Barton Jensen .and seconded by Ruth Smith.

Rt, NEW ADMINISTRATION SWORN IN BY ATTORNEY MARY SMITH
The New Administration was sworn in by Attorney Mary Smith. The
'~ new Mayor John Porter, and Councilmen George Catmulf, Morgan Garner,
and Nile Boyle then took over the seats vacated by the oid Mayor and
Council.
R~: MAYOR PORTER PRESENTED PLAQUES TO THREE EX MAYORS LIVING
Mayor John Porter took over the meeting. Mayor Porter asked the
three ex mayors living in Rexburg, Henry Shirley, Gilbert Larsen,. and
Whitey Brock, to step up. He then presented them with a plaque each,
and .thanked them for their service to Rexburg.
RE: MAYOR JOHN PORTER APPOINTED THE FOLLOWING
Afton Anderson - Acting City Clerk and Treasurer with a $100 per month
raise. Mayor Porter noted that applications were being accepted for
the position of Administrator. The job of City Clerk and Treasurer
would be held open until that time. Moved by Barton Jensen, Seconded
by Glenn Peterson.

RE: RAISES MUST BE OKAYED BY THE MAYOR AND COUNCIL FROM THIS DATE
Mayor John Porter asked that it be noted in the minutes that all
raises must be okayed by the Mayor and Council from this date.

CITY IN NEED OF GRADER ALSO STORAGE FOR GARBAGE TRUCKS
Mayor John Porter reported that DAn Moulton, Superintendent of the
Street Department, had informed him that the small grader is no
longer functioning. He suggested trying to locate another used
grader as soon as possible. Mayor Porter appointed Morgan Garner and
Dan Moulton to check on available graders and report. Dan Moulton
had also reported that he was having difficulty starting the garbage
.trucks due to the cold. Mayor Porter stated Wells Grover has a shop
that would accommodate the two garbage trucks and enable Dan to
to take better care of them. Councilman Morgan Garner remarked
that it would be worthwhile to put out a little money for the rental
of the shop, as hydrolic equipment shouldn't be left in the cold.
Councilman Warren Porter suggested checking into the feasibility of
putting heat into the shop and the cost of rental. Councilman Jensen
made a motion that an available place be found to put the garbage
trucks. Seconded by Warren Porter.

RE: COLLEGE INVITES CITY COUNCIL AND WIVES TO DINNER
Mayor Porter read a letter from President Eyring of Ricks College,.
inviting the City Council and their wives to a dinner at the. college.
A tentative date of January 23, 1974, at 7:00 P, M, was set.-
MAYOR APPOINTS COUNCILMEN TO HEAD VARIOUS DEPARTMENTS
Mayor Porter appointed the Councilmen to head various departments as
follows:
Finance & Irrigation- George Catmull
Fire & Police - Glenn Peterson
Streets - Morgan Garner
Health and Sanitation - Nile Boyle
Parks & Recreation - Warren Porter
Water & Sewer - Barton Jensen
Barton Jensen was elected president of the Council. Mayor John
Porter suggested the Councilmen get with the heads of the departments
and begin work on their budgets.
Peterson moved that the meeting adjourn at 9:30 P. M. Seconded by
Warren Porter.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Minutes of the regular meeting held January 16, 1974, at 7:30 P. M.
at .City Hall.
Mayor John C. Porter present and. presiding. Present were Councilmen
George Catmull, Morgan Garner, Barton Jensen, and Nile Boyle, Warren
Porter. Councilman Glenn Peterson was absent.
Also present were Mike Green of the Post Register and Roger Porter
of the Rexburg Standard and Journal. City Attorney, Mary Smith Oldham,
and City Clerk, Afton Anderson.
REQUEST PRESENTED ASKING FOR PARKING SPACES FOR TETON STAGES
Mayor John C. Porter announced that a request had been presented to
him asking for parking spaces for the Teton Stages for loading and
unloading at their new location at 123 East Main. A letter was read
from Chief of Police, Blair K. Siepert, asking that they consider:
I. that parking of the bus would take a minimum of 5 parking spaces.
2, that to enforce the area as a Bus Zone would require a No
Parking sign at anytime.
3. that business~in that area were very. concerned about the
loss of their customer parking.
Chief Siepert suggested the possibility of the bus loading and
unloading in or near the County Parking Lot, so as not to block the
traffic lane in this heavy traffic area.
Nile Boyle moved that one parking space be given for loading and
unloading of the bus directly in front of the door, temporarily,
until .the Council has time to study other possibilities. It was
seconded by Warren Porter.
