Mayo MINUTES OF THE SPECIAL CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO Special mee-iing December 13, 1973, at 3:30 P. M. at City Hall. . Present & presiding Mayor Henry Shirley. Council present Ruth Smith, Glenn Peterson, Richard Davis and Warren Porter, also Chief of Police Blair Siepert. ~ RE B. J. BAR REQUESTS DECISION ON BEER LICENSE I RE: Mrs. Jo Summers and Brent Church, manager of the B. J. Bar, appeared and requested transfer of 1973 Beer license from Randy Luke to Mrs. Jo Summers. Mrs. Summers also requested a decision on her•applica- tion for a beer license for 1974. Action on this license had been I~ostponed at the December 5 council meeting pending investigation of complaints aboui- the operation and the possibility that the B. J. Bar was possibly operation 1n violation of the Beer .Ordinance. CHIEF SIEPERT R~P~IRTS ON B J BAk;~;, COMPLAINTS, BAR CLOSED :. ,. Chief Siepert reported as follows:`'°- The B. J. Bar does have an arrangement with Rasmussen Real Estate for an emergency exit through their offices and opening onto main street. On two or three occasions the police had been called to the place to stop a fight. This had happened both inside and on the outside of the establishment. Complaints had been received of excessive noise from a juke box after the business had closed up for the night. Police had gone there and required them to lower the volume. ,lust recently a Rexburg Officer had apprehended a youth of age 18 drinking beer in the B. J. Bar. Chief Siepert said that the bartender stated that he had not sold the beer to the youth, and it was assumed that some one else had purchased it and passed it to the youth. The youth was charged but there was no case against the bartender. Chief Siepert at this time observed that the Beer License was in the name of Randy Luke. On December 12, 1973, Chief. Siepert and a State Liquor Law Enforcement Officer, Jim Mason, went to Randy Luke and advised him that he would be held responsible for any law violations that occurred in the operation of said bar. Randy Luke informed them that he had turned the Bar back to Mrs. Jo Summers in June of 1973. He then accompanied Chief Siepert and Jim Mason to the Bar and he (Randy Luke) removed the License from the wall. Chief Siepert and Jim Mason then informed the Barmaid that - no beer was to be sold until a license was obtained. Mr. Church closed the establishment and intends to stay closed until proper licenses are obtained. ~E COUNCILMEN QUESTION MR CHURCH ABOUT MUSIC PLAYING AFTER HOURS Mr. Church was asked why there needed to be music after closing time. He explained that the help liked to have the music while they cleaned up but that he would see that they kept the volume low. One councilman asked mr. Church if he would be willing, in case another complaint was received, to give orders that no music be played after closing time. Mr. Church agreed to this suggestion. ~ ~E: BEER LICENSE TRANSFERRED FROM RANDY LUKE TO MRS. JO SUMMERS Mrs. Jo Summers stated that she had supposed that Randy Luke had, had the Beer Licenses transferred to her. ,~ " It was moved by Petersen, seconded by Barter that the beer,liceh~e be transferred from Randy Luke to Mrs, Jo Summers, All feur cQUn~llmen present voted aye. BAR It was then moved by Petersen and seconded by Porter that a beer license for sale of beer to be consumed on the premises be granted to Mrs. Jo Sommers for the year 1974, all four councilmen voted aye. RE: REXBURG LUMBER COMPANY GIVEN PERMISSION TO HAVE STORAGE TANKS FOR FUEL Mayor Shirley informed the council that the Rexburg Lumber Company had requested permission to install 3 large storage tanks for liquid motor fuel aboveground. Fire Chief Clements and Building Inspector, Brinton had checked this out and it appeared that this ppuld be allowed under presently adopted codes, because of the outlyin~~ location of the proposed installation and providing that certain regulations be followed including those of OSHA. A discussion by the council showed some expectation that because of fuel shortage, there might be further requests for aboveground fuel tanks and that in most cases such installation would not be permitted by our fire codes. It was moved by Smith and seconded by Petersen that the building inspector be instructed to refuse to issue a permit for any aboveground fuel tank without a review and reccmmendation from the Council and that a favorable recommendation now be given to the building inspector for the installation at Rexburg Lumber Company. All voted aye. It was moved by Porter, seconded by Davis to adjourn. All voted Aye. Meeting was adjourned at 4:.40 P. Present and presiding Mayor Henry Shirley. Council present Ruth Smith, Barton Jensen, Albert Pieper, Warren Porter with Glenn Peterson arriving at 8:30 P. M. Absent was Dick Davis. Others present City attorney Mary Smith, Clerk & Treasurer Beulah Johnson. Reporters Mike Green from the Post Registar of Idaho Falls. 3E: MINUTES OF OCTOBER 17, 1973, WERE AMENDED r Minutes of October 17, 1973, .were amended. Smith moved that the trailer Ordinance be revised according to planning boards recommendations and to be submitted at next council meeting for approval. To be read at three separate meetings. Once by length, and twice title for passage. Seconded by Peterson. Unamimously Carried. Pieper motioned we accept amended changes. Seconded by Jensen. Unanimously Carried 2E: PASSAGE OF TRAILER ORDINANCE POSTPONED UNTIL NEW ADMINISTRATIVE TAKE OFFICE. Discussion on new trailer Ordinance and it passage. Porter motioned that we postpone first reading until new administrative members take: office in January. Moved by Pieper, seconded by Porter that they be accepted as read. Unanimously Carried RE: JOHN MOORE ASKS TO USE THE STREET FOR PARKING John Moore from 75 East Ist North met with the council, asking permission to use the street parking for his extra vehicles. He in turn would remove the snow and haul it away from the area. After discussion on the Ordinance controlling. this from November I to March I. Peterson motioned permission be denied. Seconded by Pieper. Unanimously Carried RE=., BEER LICENSES ISSUED AND B J BAR DISCUSSED Mayor Shirley stated that Blair Rich was registering a complaint against B. J. Bar and the violations of several items in the beer Ordinance. Other council members spoke of several complaints that had been expressed to them. Applications presented were IGA #I and #2 $50.00 Romrelis Food 25.00 Johnson Grocery 25.00 Mighty Mite #1 & #2 50.00 Circle K 25.00 Harvey's Beer 100.00 J B Bar 100.00 Jensen moved we approve all with exception of B. J. Bar, that will be held until investigation of complaints can be made. Seconded by Smith. All Aye 2E: UTAH POWER & LIGHT REMOVED ONE 7000 LUMEN BY IGA #2 Mayor reported that Clyde Johnson from Utah Power and Light,-that the Utah Power and Light had removed one 7000 lumen by IGA #2. After discussion on placement. Smith motioned we have it placed north of new seminary building near the new school.. Seconded by Pieper. `•, ~, A l l A y e ~~ ,. '.m ::.~ ~- -,..... ~,,,.~ 2f~ : ORDINANCE 5.4{4 ~~~ '~~ ~, AN ORDINANCE AMENDING ORDINANCE N0. 469 OF THE CITY OF REXBURG, IDAHO, REGULATING ELECTRICAL WIRING AND EQUIPMENT BY THE ADDITION THERETO OF SECTIONS )4 AND 15 PROVIDING FOR THE CREATION OF A BOARD OF REGISTRATION AND REVIEW AND PROVIDING FOR THE DUTIES AND AUTHORITY OF THE BOARD OF REGISTRATION AND REVIEW, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE. A motion was made by Barton Jensen, seconded by Ruth Smith to suspend the rules and have said Ordinance placed upon its final passage. The . Mayor ordered the roll call. of the Council called, and the roll being called by the City Clerk for the suspension of the rules was as follows: Those voting "AYE" Ruth Smith Barton Jensen Albert Pieper Warren Porter Glenn Peterson The roll being called and all Councilmen present voting "AYE" carried. The Mayor then called for the voting for final passage of the Ordinance, the motion was made by Glenn Peterson seconded by Warren Porter. The Mayor ordered the roll call of the council called, and the roll being called by the City Clerk for the final passage of the Ordinance was as follows: Those voting "AYE" Ruth Smith Barton Jensen Albert Pieper Warren Porter Glenn Peterson ~~ The roll being called and. all councilmen present voting "AYE" carriE~d, the Mayor declared that a majority of all the members of the City Council had voted for the passage of said Ordinance and that said Ordinance was duly and regularly passed. Mayor Shirley then Declared the motion carried. RE: BILLS PASSED RE: RE: RE: Bilis were read in the maount of $35,029,05 motioned by Jensen, seconded by Peterson that same be paid. Unanimously carried RESIGNATION OF CITY CLERK AND TREASURER BEULAH JOHNSON Resignation of City Clerk and Treasurer Beulah Johnson was accepted with Mayor Shirley and Council expressing their appreciation for the job that had been accomplished during her years at City Fiall Mayor Shirley ask that Afton Anderson be appointed to fill the vacancy as City Clerk and Treasurer. Pieper motioned we accept Afton Anderson as new City Clerk and Treasurer. Seconded by Smith. Unanimously carried APPLICATION READ FOR ADMINSITRATIVE POSITION WITH CITY Mayor Shirley read letter of application from a man who was interested in an administrative position with the City. Mayor Shirley said he would pass this immediately over to Mayor Elect Porter. JAYCEES ASK FOR APPROVAL TO ESTABLISH AND MAINTAIN ICE SKATING RINKS Four Jaycees representives met with Council and asked that they be given approval to help City establish and maintain ice skating rinks in the City. They were commended and were requested to work with streets Supt. Moulton on this project. Motioned by Peterson that we adjourn at 9:55 P. M. Seconded by Smith. City Jerk Unanimously carried a or MINUTES FOR DECEMBER 13, 1973 on PAGE 247 MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO HELD DECEMBER 19, 1973 RE: Mayor Henry Shirley was present and presided. Also present were Barton Jensen, Richard Davis, Albert Pieper, and Ruth Smith. The Mayor asked Mary Smith to take the minutes. LETTER FROM STATE RETIREMENT SYSTEM EXPRESSING THANKS TO BEULAH .JOHNSON The Mayor read a letter from the field representative of the State Retirement System, James M. Collins, expressing his thanks to Beulah Johnson for her cooperation in the audit and the fine manner in which her records had been kept. ~E: DEATH OF BEULAH JOHNSON 1 The Mayor stated he was especially pleased in view of the unexpected and untimely death of our city clerk, Beulah Johnson, that the council and Mary had expressed to her their appreciation at the last council meeting, for the fine work she had done.
