Thei was discussed and tabled for further study. RE: IRRIGATION WATER TO CEASE Jensen announced that irrigation water was to cease as of this week. M. at the City Hall. Present & presiding Mayor Henry Shirley, Council present Barton Jensen, Richard L. Davis, Albert Pieper, Warren Porter, and Glenn Peterson. Absent Ruth Smith. Others present City Attorney Mary Smith, City Clerk and Treasurer Beulah Johnson. Mike Green, Roger Porter newspaper reportes. Minutes of September 19, 1973 were read. Motioned by Davis same be passed. Seconded by Pieper. Unanimously carried ~E: PRESIDENT OF WASHINGTON P T A REQUESTS GUARD POSED AT CROSSING ON I W 8 MAIN Max Brown president of Washington P. T. A., reported that parents wanted some kind of guard posted at .school crossing on Ist West and Main. The State recently removed the stop light replacing with flashing yellow caution lights and Brown expressed concern over the safety of children, .going and coming from school. Jensen moved we pursue getting someone to guard the intersection. Seconded by Pieper. Unanimously carried ~E: STEVE MURPHY & CHARLES CLARK ATTEND Steve Murphy attended the meeting. RE CITY TO OPERATE ON TAX ANTICIPATION NOTES ~ Discussion on money that is invested and the lower rate of interest that the City could operate on by using tax anticipation notes. That the City of Rexburg borrow money in the .sum of $42,000.00 and issue as evidence of such debt, a tax anticipation note, bearing interest at the rate of 4.75 per cent per annum from the date thereofi until paid, which said note shall mature January 31, 1974; that said sum be borrowed from, and said note be issued to the First Security Bank of Idaho, a National Banking Corporation, Rexburg, Idaho, with its office and place of business in Rexburg, Idaho; such money to be used for general expenses of the City in anticipation of the taxes levied for the year 1973 for general purposes. 2. That the tax levy for the 1973 fiscal year has been completed; that the amount ofi taxes levied for general purposes exclusive of taxes levied for outstanding bonded indebtedness and special purposes during 1973 is 21 mills on the dotlar of assessed valuation, which assessed valuation for the year 1973 was $6,721,775.00, making the total amount of taxes levied for said fiscal year, exclusive of those levied for outstanding bonded indebtedness and special purposes, the sum of $140,000.00, of which sum none has yet been collected; that this proposed tax anticipation note does not exceed 75 per cent of the taxes levied by said taxing district in the year 1973, and the proceeds therefrom have not yet been paid. to the City of Rexburg by Madison County. ~. 3. That such tax anticipation note shall be a negotiable instrument, and shall pledge the full faith, credit and resources of the City for the payment of the same, and shall be substantially in the following form: RE: TAX Anticipation NEGOTIABLE NOTE Tax Anticipation negotiable Note Rexburg, Madison County, Idaho October 3,, 1973. For value received, the City of Rexburg, Madison County, ,State of Idaha, promises to pay to the First Security Bank of Idaho, N.A., a National Banking Corporation, with its office .and place of business at Rexburg, Idaho, or its order, on the 31st day of January, 1974, the sum of Forty-Two Thousand ($42,000.00) Dollars, lawful money of the United States of America, with interest from the date of .this Hate at the rate of four and seventy-five hundredths percentum (4.75) per annum until paid. l ~~~ ` ,, This note is issued in pursuance of a Resolution duly adopted by the City of Rexburg, Madison County, State of Idaho, on the 3rd. day. of October, 1973. That such tax anticipation note be sold at private sale to the First Security Bank of Idaho, N.A., Rexburg, Idaho, aforesaid, by the Mayor of the City forthwith, and that he be hereby authorized to make such sale and to receive the proceeds therefrom and deposit them to the credit of said City. 5. To provide for the payment of said tax anticipation note at maturity, a special fund is hereby created to be known as TAX ANTICIPATION OR NOTE REDEMPTION FUND, and it is hereby provided that all taxes hereafter collected or received from the general tax Levy for the year 1973 shall be placed- immediately in suc"h fund until such time as the funds accumu- lated therein shall be sufflicient to pay the hereinabove mentioned ~, tax anticipation note, together with interest thereon at maturity,. and the funds so accumulated in the said fund are hereby appropriated and set apart for such purpose only and shall be used for no other purpose; providing, however, that this shall not Limit the payment of said Hots to the said taxes collected, but such note shall be the direct and general obligation of the City of Rexburg. it was moved by Glenn Peterson, and. seconded by Albert Pieper that such Resolution be adopted, and the proper officers directed to proceed accordingly, and that the Resolution be spread on the minutes. Upon call for question, the vote was taken as: For 5, Against 0. Whereupon the Mayor declared the Resolution duly adopted and directed that the proper papers be executed and that the Mayor proceed to negotiate the loan,. as authorized in the Resolution and directed the Clerk to spread the Resolution upon the minutes of the Council. E: MAYOR TOLD OF FEDERAL URBAN ~i1NDS Mayor Shirley told of Federal Urban funds that the City would receive next year in sum of $100,000, This is for 10 largest Cities in Idaho for street construction in City. Also City would have to budget $30,000 to have this fund allocated to City. RE DRAINAGE PROBLEMS IN CITY all councilmen present voting majority of all the members of passage of said Ordinance and gulariy passed, Mayor Shirley DISCUSSED "AYE" carried, the City that said then declared Drainage problems in Ci-~y discussed. Arrial phgto taken for the purpose was discussed. Pieper motioned that Forsgren be given permission to proceed with this study and proposal. Seconded by Davis. Unanimously carried IRE: GOLF ASSOCIATION NEED $600 Mayor stated Golf Association needed $600 more to meet their bills this year. Jensen moved that this be allowed. Seconded by Pieper. Unanimously carried IRE: BILLS Bills in amount of $47,112.96 were read. Motioned by Jensen, ~^ seconded by Porter that same be paid. j . Unanimously carried. RE- 6VAYNE EGAN ASKS THAT SPEED LIMIT BE REDUCED ON SOUTH HIGHWAY Glenn Peterson stated that Wayne Egan called and ask that the speed limit from Mobile Home Trailer Sales on South Highway be reduced, this has been annexed into City and proven a very dangerous area, with many accidents happening all the time at the businesses on the right side of highway. .Mayor ask Glenn to call Captain May and have him get in „iu~h with the State Highway Dept. in Rigby to see if they couldn t ee the spe,e~d limit. ~'°~'~ RE; NEW GARBAGE TRUCK DISCUSSED Porter discussed the need of new garbage truck. RE: NEW CITY SHOP DISCUSSED Pieper discussed the size needed for a new city shop and money that was available for project. The need for truck and blade for winter months. ~E: DAVIS WILL NOT RUN FOR COMING ELECTION Richard L. Davis announced that he would not be running for any spot in the forth coming election. ~E: CHRISTMAS DECORATIONS DISCUSSED Jensen led discussion of Christmas decorations and need. Small lights for trees on main street, seemed to meet the approval of all. Jensen is to get price and idea on wiring for such a project. Also shortage of electricity should be considered. Also Jensen is to salvage pump and pipe from irrigation system that has been abandoned. Porter moved we :adjourn at 10:35. Present & presiding Mayor Henry Shirley. Council present Warren Porter, Barton Jensen, Richard L. Davis, Albert Pieper, Glenn Peterson and Ruth Smith. Also present Ken Newman fiscal agent from Burroughs Smith and Company of Salt Lake City, Utah. ;E: AMOUNTS THAT COULD AND SHOULD BE BONDED Discussion on amounts that could and should be bonded. Revenue $500,000.00 GOB 500,000.00 Mr. Newman ask that this go on record as being a figure higher than orginal $400,000.00, for GOB but with rising costs for construction and materials to complete project, he felt this amount would be advisable and needed. A water rate increase was advisable. E: RESOLUTIO N ADOPTING REVENUE BONDING Resolution adopting revenue bonding in the amount of $500,000.00 and GOB bonding for $500,00.00. Motioned by Ruth Smith.
