Present and presiding Mayor Henry Shritey. Council present Albert Pieper, Glenn Peterson, Ruth Smith, Barton Jensen, Richard L. Davis and Warren Porter arriving at 9:25 P. M. Others present City attorney Mary Smith, City Clerk and Treasurer Beulah Johnson, Mike Green and Roger Porter news reporters. RE: JERRY BRIAN AWARDED CERTIFICATE ~~ Jerry Brian from Waterworks Department was present. Mayor Shirley r` awarded him his certificate from State Department of Health designating him a Third Class Waterworks and. Sewage plant operator, from his completion of a recent school he attended. All present expressed their congradulations to Mr. Brian. RE: MINUTES OF SEPTEMBER 5, 1973 Minutes of September 5, .1973 were read. be passed. Seconded by Pieper. Motioned by Davis that same Unanimously carried 1 RE: MINUTES OF SPECIAL MEETING Minutes of Special meeting held September 18 at 8:00 were read by Mary Smith. RE: ORDINANCE 539 AN ORDINANCE CREATING LOCAL IMPROVEMENT DISTRICT N0. 20 IN REXBURG, IDAHO, FOR THE PURPOSE OF CAUSING CERTAIN STREETS AND ALLEYS AND PARTS TEREOF WITHIN THE CORPORATE LIMITS OF SAID CITY, TO BE GRADED, GRAVLED, PRIME COATED, PAVED, CURBED, GUTTERED, SURFACE DRAINED, SIDEWALKS, SEWERS AND WATER LINES CONSTRUCTED THEREON WITHIN SAID DISTRICT: PROVIDING FOR TM,lr LEVY. The Mayor ordered the roll call of the Council called, and the roll being called by the City Clerk for the suspension of the rules was as follows: Those voting "AYE" Albert Pieper Glenn Peterson Ruth Smith Barton Jensen Richard L. Davis i The roll being called and aI1 Councilmen present voting "AYE" carried. The Mayor then called for the voting for final passage of the .Ordinance,. the motion was made by Glenn Peterson seconded by Barton Jensen. RED`'` SPECIAL MEETING ON BONDING, PUBLIC HEARING FOR DEAN RICKS PROPERTY I Special meeting is to.be held September 28 at 6:00, Friday on Bonding with. Ken Newman. Public hearing for Dean Ricks property for annexating and zoning to be held Oct 3, 1973, Jensen reported Randall Didn't want to be included in this transaction at this time. ~ -. RE; FIRE CODE DISCUSSED Mayor read a letter from fire district and planning board and fire code was discussed. ~RE: ORDINANCE 540 AN ORDINANCE CREATING AND ESTABLISHING FIRE ZONES IN THE CITY OF REXBURG, IDAHO, AND REPEALING ORDINANCES N0. 157, 195, 209, 299, 340, AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONVLICT HEREWITH: PROVIDING FOR AN EFFECTIVE DATE. A motion was made by Barton Jensen, seconded by Glenn Peterson to suspend the rules and have said Ordinance placed upon its final passage. The Mayor ordered the roll call of the Council called, and the roll being called by the City Clerk for the Suspension of the rules was as follows: Those voting "AYE" Albert Pieper Glenn Peterson Ruth Smith Barton Jensen Richard L. Davis The roll being called and all Councilmen present voting."AYE" carried. The Mayor then called for the voting for final passage of the Ordinance, the motion was made by Ruth Smith, seconded by Glenn Peterson. Mayor Shirley then declared the motion carried. ARE: MIKE ADAMS ASKS TO OPERATE HAUNTED HDUS-E Letter read from Mike Adams asking permission to operate a haunted house for two days prior to Halloween night. Assuring safety and fun for all. Jensen motioned that permission be granted, licenses waivered, in Ii•eu of certificate of insurance for same be brought to City Clerk. Seconded by Smith • Unanimously carried ~~~~ ,~ ~E: DAVIS REVIEWED PRE5ENT WATER RATES AND ALTERNATfVE INCREASE Davis reviewed present water rates and alternative increase with all paying same rate, with examples given. Thei was discussed and tabled for further study. RE: IRRIGATION WATER TO CEASE Jensen announced that irrigation water was to cease as of this week. RE: BILLS Bi11s in the amount of $20,287.04 were read. Moved by Jensen, seconded by Davis same be paid. Unanimously carried Peterson motioned adjournment at 9:30.. Seconded by Porter. M. at the City Hall. Present & presiding Mayor Henry Shirley, Council present Barton Jensen, Richard L. Davis, Albert Pieper, Warren Porter, and Glenn Peterson. Absent Ruth Smith. Others present City Attorney Mary Smith, City Clerk and Treasurer Beulah Johnson. Mike Green, Roger Porter newspaper reportes. Minutes of September 19, 1973 were read, Motioned by Davis same be passed. Seconded by Pieper. Unanimously carried RE: PRESIDENT OF WASHINGTON P T A REQUESTS GUARD POSED AT CROSSING ON f W & MAIN Max Brown president of Washington P. T. A., reported that parents wanted some kind of guard posted at school crossing on Ist West and Main. The State recently removed the stop light replacing with flashing yellow caution fights and Brown expressed concern over the safety of children, going and coming from school. Jensen moved we pursue getting someone _ to guard the intersection. Seconded by Pieper. ~~' Unanimously carried ' !' 4 I RE: STEVE MURPHY & CHARLES CLARK ATTEND .Steve Murphy attended the meeting, Charles Clark, Ricks student came for short time. RE: SUPERINTENDENT OF SCHOOLS MET TO DISCUSS LID PROJECT IN CONJUNCTION WITH SCHOOL WOr2K Dr. Waite, superintendent of schools, met with council to discuss the LID project in conjunction with school work to be~done, projects that have first priority were discussed and decision made that work would be completed in certain areas weather permitting. I, roadway curb and gutter,. sidewalks sewer and water lines along Ist North adjacent to school and paving of new road on high school grounds.
