Regular Meeting of Rexburg City Council held at 6:00 P. M. at City
Hall. June 6, 1973.
Present and presiding Mayor Henry Shirley. Council present Ruth
Smith, Albert Pieper, Barton Jensen, Glenn Peterson, absent Richard
L. Davis, Warren C. Porter.
Others present City Attorney Mary Smith, City Clerk Beulah Johnson.
Reporters Roger Porter and Mike Green.
Minutes of 5/2/73 were read corrected motioned by Jensen, moved they
pass as corrected, Smith seconded.
Unanimously Carried

by Jensen they be passed.

REQUEST ON BINGHAMS STEEL WAREHOUSE DENIED
Discussion of the steel warehouse structure on block 39 on West
Main in Fire Zone I was further discussed this. This belongs to'
Faye Bingham and he wants a decision on building. Pieper moved the
request. be denied as the fire zone does not allow this type of building
in the zone. Peterson seconded.
Unanimously Carried
ARE: JIM SHIRLEY LOT ON SOUTH 3RD EAST DISCUSSED
Jim Shirley lot on South 3rd east was discussed for possible building
that would comply with size of lot. Tabled.

AN ORDINANCE OF THE CITY OF REXBURG, IDAHO, REPEALING ORDINANCES N0.
465 AND 479 OF THE CITY OF REXBURG, IDAHO, AND DECLARING THE INTENT
AND ADOPTING AND ENACTING THE IDAHO STATE FIREWORKS LAW AS THE LAWS
OF THE CITY OF REXBURG, IDAHO, FOR GOVERNING AND REGULATING THE SALE
AND USE OF FIREWORKS WITNIN THE CITY OF REXBURG, IDAHO, AND PROVIDING
THAT THREE COPIES OF THE IDAHO STATE FIREWORKS LAW BE ON FILE AT ALL
TIMES IN THE OFFICE OF THE CITY CLERK; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH: AND FIXING AN EFFECTIVE DATE.
A motion was made by Bart Jensen, seconded by Albert Pieper to suspend
the rules and have said Ordinance placed upon its final passage.
The Mayor ordered the roll call of the Council called, and the roll
being called by the City Clerk for the suspension of the rules was as
follows:
Those voting "AYE" Ruth Smith
Albert Pieper
Barton Jensen
Glenn Peterson

parried. The Mayor then called for the voting for final passage of
the Ordinance, the motion was made by Glenn Peterson seconded by
Ruth Smith. The Mayor ordered the roll call of the council called,
and the roll being called by the City Clerk for the final passage
of the Ordinance was as follows:

Theron being called and all councilmen present vating "AYE"
carried, the Mayor declared that a majority of all the members of the
City Council had voted for the passage of said Ordinance and that said
Ordinance was duly and regularly passed.. Mayor Shirley then declared
the motion carried.
~E: FIREWORKS PERMITS ISSUED
Permit from M. H. Kings was presented for selling fireworks at early
and later dated than Ordinance allows. Smith motioned permission
be denied and Kings should conform to selling designated dates.
Pieper seconded.

~E: MARY SMITH REPORTED ON NECESSARY CHANGES ON LID'S
Mary .Smith reported that Ralph Parker, & Clayter Forsgren, was making
the necessary changes on LID's that need to be made to start the
project for the needed. improvements.
ZE: CURfEW LAWS AND ORDINANCE DISCUSSED.
Curfew laws and ordinances were discussed. Council ask attorney to
draw up necessary ordinances after the motion from Jensen that parks
be closed and policed at 11:30. Seconded by Smitii.

Bilis in the amount of $20,775.26 were read motioned by Jensen,
Seconded. by Pieper that same be paid.
Unanimously carried
Smith moved meeting adjourn 7:30. Peterson seconded.

Regular City Council held June 20, 1973, at 6:00 at City Hall.
Present & presiding Mayor Henry Shirley. Council present Glenn Peterson,
Richard L. Davis, Barton Jensen, Warren Porter, Albert Pieper and Ruth
Smith arrived at 8:00 P. M.
Also present City Attorney Mary Smith, City Clerk and Treasurer
Beulah Johnson. Press Mike Green and Roger Porter.
Minutes of June 6, 1973 were read motioned by Albert Pieper same
be passed. Seconded by Barton Jensen.

GEORGE WILLMORE ASK FOR VARIANCE ON BUILDING PERMIT
George Wilimore met with group and ask for variance on building permit
for carport and storage on his residence, which he had purchased and
had had a stop work order on after starting building. Tabled
for further study.
_. COLLEGE WORKING WITH DAVIS & FORSGREN ON REPLACING WATER SYSTEM
Davis reported that the College is working with him and Forsgren on
replacing water system and increasing pressure for campus. Also
reported several calls from South East area residents of low pressure.
