MINUTES OF THE REGULAR CITY CO NCIL
MEETING OF THE CITY OF REXBURG, IDAHO
.Regular City Council held May 16, 1973, at 7:30 at City Hall.
'Present and presiding, Mayor Henry Shirley. Council present Ruth
Smith, Albert Pieper, Glenn Peterson, Barton Jensen, Warren Porter.
`Absent Richard L. Davis.
Others present City Attorney Mary Smith, City Clerk and Treasurer
Beulah Johnson, press Roger Porter, DAvid Wilson, and Don Ellis from
Radio Station. County .Commissioners Keith Walker, Mark Peterson,
Chamber of Commerce Max Brinton, and Mike Bingham. State Highway
Hary Day and Gene Burbridge, and Roy Stroshien.
~RE:FIVE PROPOSED ROUTES OF HIGHWAY THROUGH REXBURG DISCUSSED
Meeting with State Department of Highway representatives for first
hour. Five proposed routes were discussed through Rexburg for
Highways 191 and 20. Mr. Day explained the proposed routes and
costs involved ask for opinions on alternatives before public hearing
to be held later this year. Day explained changes for route had been
dictated by Environmental Protection Act of 1969, forcing reconsideration
of alternatives, stating West route would be less costly and Environmental
Protection Act had chosen it. Tabled at 8:30.

Regular meeting was opened by City Attorney reading Ordinance 535
for third and final reading. Pieper stated that President Eyring of
F?icks College had expressed disapproval of changing closing hours
because of Lowered age Limits.
AN ORDINANCE AMENDING SECTION I OF ORDINANCE N0. 343, ALSO KNOWN
AS SECTION 16 OF ORDIAANCE N0. 341,. AND SECTION i OF ORDINANCE N0.
445, PROHIBITING THE SALE OF BEER ON SUNDAYS AND HOLIDAYS AND REGULATING
THE DAYS AND HOURS FOR THE SALE OF BEER, AND REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.
The roll being called and all councilmen present "AYE" one voting
"NAY" carried. The Mayor then called for the voting for final passage
of the Ordinance, the motion was made by Glenn Peterson seconded by
Ruth Smith. The Mayor ordered the roll call of the council called,
and the roll being called by the City Clerk for the final passage

The roll being called. and all councilmen present voting "AYE" one
voting "NYE" carried, the Mayor declared that a majority of all the
members of the City Council had voted for the passage of said Ordinance
and ii~at said Ordinance was duly and regularly passed. Mayor Shirley
then declared the motion carried.

RE: EXTENSION OF SEWER TO ANNEXED NORTH 51DE AREA I~ISCUS5E1)
Extension of sewer to newly annexed North Side area was discussed.
Harvey Summers being present at meeting was asked if he could
manage his problem of sewage until moneys from HUD or EPA becam e
available, possibly next year as cost to North Side Trailer Court
was prohibitive without some help from some Government Agency.
Summers felt that he could.
~E: PROPOSAL FOR PARKING METERS TO BE REMOVED
Steve Meyers, Paul Carver, Jim_Spencer, Ross Reese, representing
the merchants Committee presented-.the following to Council.
Proposal for Six Months Trial Period of Meterless Parking
To: The Rexburg City Council
For: Parking Meter Committee of the Chamber of Commerce Merchants
Committee
Gentlemen:
The Rexburg Merchant's Committee of .the Rexburg Chamber of Commerce,
concerned that parking fees may be detrimental to business, has drafted
and carried the following petition to merchants who have parking
meters located in the immediate proximatey of their business establishments.
"We, the undersigned Merchants of Rexburg, hereby petition the Honorable
City Council of Rexburg to remove all parking meters for a six months
trial period. beginning July I, 1973 and ending December 31, 1973"
The committee has made a conscientious effort to contact all merchants
affected. We have determined 85 merchants are so affected.. Representatives
from 78 of these firms have signed the petition: or 91~. The other
seven proprietors either declined to sign the petition or could not be
contacted. (Please note the total signatures to this petition are 91.
The discrepancy is a result of inadvertantly collecting more than one
signature in some business establishments.)
The Merchants Committee was motivated to draft and carry the petition
in order to make it easier for Rexburg and Rexburg-Area shoppers to
make purchases locally. The Merchants Committee feels increased
shopping opportunities in neighboring communities oblige Rexburg
Merchants to become ever more progressive and aggressive in stimulating
local commerce.
The Committee seeks to convey to the Council its concern for providing a
workable alternative to metered parking. The Committee feels the
City Council should take into consideration the following suggestions
in drafting a new parking ordinance.
I. Two hour parking should be enforced.
11.Fines of $2.00 for overtime parking violations should be imposed,
with additonalfines of $I.00 per hour for each additional hour
of overtime parking.
~11f Parking meter heads should be removed and signs advising parkers
of the new regulations should be placed at suitable locations in
the restricted areas.
IV The City Council should work closely with the Rexburg Chief of
Police and representatives of the Merchants Committee in drafting the
new ordinance.
V The Merchants Committee recommends personnel) presently employed
in regulating meter parking be employed in regulating parking under
the new plan.
VI Two hour parking should be posted to be effiective between the
hours of 8 A. M. and 6 P. M, with citations issued beginning at 10 A. M.
Flexibility of patro- patterns should be retained.
VI. The restricted areas should include those areas now controlled
by meters. However, the Merchants Committee wishes to convey to
the Council that other areas may need to be controlled in the future
For example, major private parking lots in the downtown area may
become jammed with overtime parkers. The city, for its own maximum

benefit may need to assume some responsibility for. maintaining traffic
flow in those areas. In time, additonal public streets may need to
be controlled.
VIII.The Merchants Committee recognizes a two-hour parking plan is
not a panacea for parking problems. Ultimately parking problems can
be solved only by increasing available parking in the downtown area.
The Committee suggests the Council actively investigate aquiring new
parking areas.
IX. The Merchants Committee believes the July first date mentioned
in the petition provides an unrealisticaly short time to make preparations
for beginning the new program. It, does, however, desire the council
to proceed to institute the new program as quickly as possible. It
is suggested the six-month trial ordinances be so drafted as to
facilitate making it permanent at the end of the trial period if a
,majority of the merchants are in agreement.
The Merchants Committee recognizes the proposed change will not be
simple to achieve, that it will present many challenging problems.
On the other hand, more than 90~ of the downtown merchants are convinced
that it is necessary to make the effort.
Jensen moved that we remove the meter heads on the trial bases as
soon as Attorney could draw up an Ordinance allowing this. Seconded
by Peterson.

~RE: BINGI-{AM & SONS REQUEST PERMISSION TO BUILD STEEL CONSTRUCTION WAREHOUSE
Fay Bingham representing Bingham & Sons on West Main ask for permis s ion
to build a steel construction warehouse to rear of his present store
adjacent to alley. Being within City Fire District, Code prohibits
steel structures. His request was denied.
RE: UPDATING ELECTRICAL CODE
Updating electrical code was discussed. Porter moved that this be
taken under advisement. Seconded by Ruth.

Peterson moved we accept Starline Equipment Agreement on purchase of
the new fire truck. Payment of $10,508.00 made at present. Payments
due.

PIEPER SUGGESTED THAT CITY ACCEPT 4th EAST & NEW SCHOOL
Pieper suggested that the City accept street between 4th East and
new school if school district would deed the land to city, and then
this could be put under LID and help the school with the needed
improvements.

_. LETTER FROM MAGISTRATE FORBUSH ABOUT CURFEW ANp POI.fCING PARKS
Letter from Magistrate Forbush was read and discussed. Curfew and
policing Parks for the youth that roam and asking that the council
purpose an Ordinance as such. Not action was taken.

Uear Madame Clerk:
The office of Magistrate of Madison. County holds membership in the
above committee. A sub-committee has hertofore asked for and received
an appointment to meet with the Rexburg City Council concerning some
specific suggestions to be made to the Council per'l~ining to the operation
of the two Rexburg city parks and concerning proposals that would. 1
effect the youth generally in our community. However, because of l
inadequate full preparation for presentation of a program, it is
suggested that anything pending with the city council be postponed.

Nevertheless, at this time I wish to personally make known my feelings
and recommend to the City Council a proposed course of action for its
consideration and evaluation.
I. It is my opinion that a night curfew should be instituted
by authority of an ordinance and enforced withing the confines of
the city, particularly during the summer months, fixing a curfew time
when youth should be off the public streets and parks.
2, Based on a sampling of public opinion, it is my feeling that
our city parks are inadequately illuminated at night and therefore
this matter should receive appropriate attention. Further, it is
believed that the parks should be patrolled and police regulated to
a greater extent than has been apparent in past summers. It is
suggested that civic organizations might very well initiate programs
to make available assigned volunteer personnel to cooperate with
and be under the spervision of the Rexburg Police Department to achieve
more effective regulation of the parks. It is my considered opinion
that our parks should be vacated of all persons by midnight ( or a
definite time fixed by the Council ).
f realize that to strictly enforce the foregoing would not, in itself,
solve the problems that our community has during the summer with
reference to roaming youth, but to inaugurate such, to my thinking,
would be helpful. Perhaps a supervised center where entertainment
and refreshments are made available for youth after a nightly curfew
goes into effect is a matter that is essential to be considered with
the above suggestions. Again, our community civic organizations.

P. S. Since January t0 of this year, the Court has filed and adjudicate'
29 juvenile cases in Madison County, and at this time four additional
cases are pending. The Court is deeply concerned for the youth of
our community and the causes which are contributing to delinquency.
The record evidences that juveni4e filings are increasing.
Smith moved meeting adjourn 11:00. Peterson seconded.
