Unanimo sly carried ~ May r ,~~i City Clerk f~ MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO Regular City Council convened May 2, 1973, held at City Hall at 7:30 P. M. Present and presiding Mayor Henry Shirley. Council present Glenn Peterson, Albert Pieper, Richard L. Davis, Barton Jensen, and Warren Porter. Ruth Smith absent and excused. Also present City Attorney Mary Smith, Clerk and Treasurer Beulah Johnson, reporters Rod Clifford and Rick Ripley, D Le Roy Armstrong Water & Sewer Superentendent, Clayter Forsgren City Engineer. Minutes of April 18, 1973, were read corredted. Motioned by Davis, secended by Pieper that they be passed. Unanimously Carried. RE: REPRESENITIVES FROM COLLEEGE MEET TO DISCUSS WATER STUDY & MAKE PROPOSALS President of Ricks College, Dr. Henry L. Eyring and Dean of Administration, M. Rex Bennion met with Council to discuss the water study made by City Engineer Clayter Forsgren and make proposals. Stated water deficiencies for fire protection, sprinkling and the the future expansion of the College. a- Water study proposed $350,000 from College toward project which they felt was high. b. Separate systems - College Building and maintaning own. c. Joint system with College paying $267,000 toward project which they felt was high. d. Commercial .rate exclusive City paying all costs or with independent auditor determining the costs per gallon at the end of each year to deter:~~ine the cost for College. Before leaving Bennion & Eyring thanked the Council for the time and ~fopportunity to be heard. RE jffCOLLEGE SEWER RATES Jln discussion on sewer rates received from College, it was brought out that College paid $200.00 monthly-but probably uses 15 per cent of lagoon capacity. RE: MR & MRS TED GARNER PROTEST INSTALLING SEWER .LINES ON NORTH Ist EAST Mr. & Mrs. Ted Garner met protesting installing sewer lines on North Ist East. Stating that they would have no use or need for the sewer in their concrete mix business. Also they stated curbs and gutters installed in the area, ~:~hich they recently completed payment on a 10 year LID, were broken and no benefits yet received as street had never been paved and City crews had used it for dumping dirt from sweeper and picking it up again. Mayor Shirley said that the sewer installation would increase the value of all the four pieces of property and following the.. installation and settling of trenches the street would be surfa~ed. Owners of the lots in the area would be assessed by benefits to derived and it must go in as .there is ~ health h~za~~d rrvolved'inop;en c~~sp~~r~~ ~~ presently used. RE: FORSGREN DISPLAYS MAPS ON LiD PROJECTS Clayter Forsgren displayed maps on LID projects for this year and figures of same. Mayor Shirley is to contact people on North 2nd East as to the sewer project in that area and EPA participation and approval on such. Clayter and Mary were instructed to proceed with the project. RE: BIDS OPENED FOR NEW PICKUP FOR WATER AND SEWER DEPARTMENT Davis opened bids for new pickup truck for Water and Sewer department. Tri Co. $2500.00 Taylor Chev. $2438.00 Stone Town & Country .$2949.00 Ford Motor $2837.00 Dick moved Taylor's bid be accepted, subject to specifications checked by Armstrong who would made the final decision. Seconded by Pieper. Unanimously carried RE: BIDS OPENED FOR IMPOUNDED CARS Bids for all impoundedcars were opened, and reviewed. Mayor ask that they be given to Chief Siepert to honor the high bidders. ~E: MEYERS FOR GOLF ASSOCIATION REPORTS ON REMODELING 8. TRACTOR Evan Meyers of Golf Association met and reported that the remodeling was completed and new mower and tractor purchased on a 5 year contract with bank. He ask for permission to sell used mower and tractor to Sugar City for $500.00 and money be applied to bank contract on mower equipment. It was brought out that the equipment was owned by the Golf Association and all agreed it was permissible. ~E: SAM GRAY WOULD BE IN AREA TO SEAL THE SEWER LINES Armstrong reported that Sam Gray from a Utah firm would be in the area to seal the sewer lines that were needed. Cost being 40 linear feet for inspection. Sealing and inspection at 1.50 a lenear feet. Cost being nearly $5000.00 for the 3 I/2 .blocks that needed the. sealing. That irrigation season would determine the time to fix the infiltration. ZE: CHECK FROM REX T V Mayor Shirley stated that Rex T. V. had given the City a check for $297.00 franchise tax. A study was tabled as to users and percentage of tax. ~E: POLICE CHIEF ASKS TO ATTEND POLICE CONVENTION & TAKE TWO OFFICERS Mayor read a letter from police chief asking to attend police convention and take two officers representing the City of Rexburg in the shooting matches. Also that their wives wish to attend as they had formed a police womens organization as other cities. Registration being $50 per person and $10.00 each for men in pistol shoot. Peterson moved that $350.00 be for this convention and spend as they see fit. Seconded by Pieper. Unanimously carried 2E: MAYOR ASK PERMISSION FOR DON RICKS TO ADVERTIZE ON CITY OWNED SIGNS Mayor ask permission for Don Ricks to advertize on portion of sign for his Art Gallery on City owned signs entering town to South and ' North, he would paint and maintain signs. All were in favor. 2E: BEER ORDINANCE 535 READ 1 II t Mary read Beer Ordinance 535 for second time. RE: PROPOSAL STATING CITY JOIN IN A MApISON COUNTY WIDE ~IF~E nISTI~ICT Stating the City join in a Madison County wide fire district, establishin the fire Zones for all the area. Council present Ruth '.Smith, Albert Pieper, Glenn Peterson, Barton Jensen, Warren Porter. sAbsent Richard L. Davis. Others present City Attorney Mary Smith, City Clerk and Treasurer Beulah Johnson, press Roger Porter, DAvid Wilson, and Don Ellis from Radio Station. County Commissioners Keith Walker, Mark Peterson, Chamber of Commerce Max Brinton, and Mike Bingham. State Highway Hary Day and Gene Burbridge, and Roy Stroshien. ~RE:FIVE PROPOSED ROUTES OF HIGHWAY THROUGH REXBURG DISCUSSED ~~ t g Meeting with State Department of Highway representatives for first hour. Five proposed ro+~tes were discussed through Rexburg for Highways 191 and 20. Mr. Day explained the proposed routes and costs involved ask for opinions on alternatives before public hearing to be held later this year. Day explained changes for route had been dictated by Environmental Protection Act of 1969, forcing reconsideration of alternatives, stating West route would be less costly and Environmental Protection Act had chosen it. Tabled at 8:30. ~E: ORDINANCE 535 Regular meeting was opened by City Attorney reading Ordinance 535 for third and final reading. Pieper stated that President Eyring of (?icks College had expressed disapproval of changing closing hours because of lowered age limits. AN ORDINANCE AMENDING SECTION I OF ORDINANCE N0. 343, ALSO KNOWN AS SECTION 16 OF ORDIANNCE N0. 341, AND SECTION i OF ORDINANCE N0. 445., PROHIBITING THE SALE OF BEER ON SUNDAYS AND HOLIDAYS AND REGULATING THE DAYS AND HOURS FOR THE SALE OF BEER, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFL-CT THEREWITH. The roll being called and all councilmen present "AYE" one voting "NAY" carried. The Mayor then called for the voting for final passage of the Ordinance, the motion was made by Glenn Peterson seconded by Ruth Smith. The Mayor ordered the roll call of the council called, and the roll being called by the City Clerk for the final passage of the Ordinance was as follows: ~ Those voting "AYE" Ruth Smith Glenn Peterson Barton Jensen Warren Porter Those voting "NAY" Albert Pieper The roll being called. and all councilmen present voting "AYE" one voting "NYE" carried, the Mayor declared that a majority of all the membF~rs of the City Council had voted for the passage of said Ordinance and ti~at said Ordinance was duly and regularly passed. Mayor Shirley then declared the motion carried.
