tenative go ahead to prepare initial cost estimate on the new fire
station, which the civil defense will participate in building costs,
as it will house the civil defense.

The new county-city jail contract was read. Jensen moved we accept
County agreement with the exception-of insurance. If they would include
this in the $400.00 a month costs. Seconded by Smith.

~E NEW AMBULANCE MAN CHOSEtJ, NEED FOR TWO MORE FIREMAN
~ Mayor stated that a new ambulance man had been chosen, and that the
need for training two more fireman was now,as Clements and Kington
would be refiring in f974. Clements ask that the City pay his
Social Security for 1973 to bui{d up his credits for retirement.
Motioned by Smith, seconded by Pieper that they pay this.

RE: SMITI-i ASK PERMISSION TO HAVE TREE STUMPS REMOVED
Smith ask permission to have trees stumps removed by Zundel Tree
Service with the street crews cleaning up debris.
RE: DISCUSSION ON CONDITIONS ON EAST 2nd SOUTH
Discussion on conditions on East 2nd South and what plan needed for
improvement. Davis has the map of same. Tabled
Porter moved that meeting adjourn at II:10. Seconded by Smith.

Regular City Council meeting held April 18th at City Hall at 7:30 P. M.
Present and presiding Mayor Henry Shirley. Council present Ruth
Smith, Albert Pieper, Richard L. Davis, Glenn Peterson, Warren Porter
& Barton Jensen.

Zt: FIRST READING OF ORDINANCE 535
-first reading of Ordinance 535 - Beer. Mary excused.
ZE: TOWARD L. BURKHARDT, REGIONAL ENVIORMENTAL DIRECTOR MEETS ABOUT SEWAGE
OVERLOAD
Howard L. Burkhardt, Regiona4 Enviornmental Director from Pocatello
met with the Council, to report on the Citys overloaded sewage lagoons.
Armstrong challenged Burkhart's statement of sewage treatment being
inadequate, as the lagoons at present were operating above standard.
Davis ask if overload problems were the same in all Cities. Burkhart
stated that increase in Federal restrictions and standards was more
stringent. He stated infiltration was most immediate problem, which
pushes sewage through the sewage lagoons faster than it can be treated.
This happens during irrigation months, when water table is high.
Armstrong stated that there are about 5 or 6 blocks in the system

when ground water is entering. Several methods were discussed, ~~II
seemed temporary. Measurers,. as increasingly Federal requirements
mandating low levels of nutrients and chlorination of effluent are
making sewage treatment standards harder to meet. Also no EPA grants
will be issued for municipal sewer improvements as long. infiltration
water is in your system and under federal laws expansions of water &
sewer systems fines have to be approved by the State before construction
begins.
;E; ARMSTRONG ASK TO INVESTIGATE SOLUTIONS TO THE INFILTRATION OF SEWERS
Mayor Shirley ask Armstrong to investigate solutions to the infiltration
of City sewers. Forsgren to consider alternatives to obtain the
periodic continious 24 hour sampling information from the lagoons.
Forsgren stated someone who had been in his firm waswriting a master
thesis on Rexburg lagoons and felt this would be valuable information .~.~
for the City.
tE: BLAIR C RICH DISAPPROVES BEER ORDINANCE 535
Dr. Blair C. Rich ask to have it on record in the minutes that he
heatedly disapproves the Beer Ordinance 535 amending closing hours
to 1:00 A. M. Closing time. The Mayor informed Dr. Rich that this
would be considered and other comments that come up before the
third and final reading.
ZE: JENSEN ASK FOR PROJECTS FOR HIS SCOUT TROOP
Jensen ask for projects for his Scout troop. To do cleanup at
Library was suggested.
2E: MINUTES OF PUBLIC HEARING READ
Minutes of Public Hearing held 3/16/73 were read corrected. Motioned
by Jensen seconded by Davis that they be passed.

2E: CLEAN.TIP WEEK
Mayor appointed Smith and Pieper to organize Clean Up Week for the
City. They announced to press the first two weeks in May would be
designated as clean up time with some burning allowed.
;E: PETERSON PRESENTED A FIRE DISTRICT MAP
Peterson presented a fire district map which the Panning Board had
drawn up. Jensen moved that Mary draw up an Ordinance accepting
this. Seconded by Pieper.

E: NEED OF HIRING MORE MEN FOR FIRE AND AMBULANCE
Peterson discussed the need of hiring more men for fire and ambulance f
department. Tabled.
:E: ROTARY CLUB TO BUILD A SHELTER AT PORTER PARK r ~,
Smith reported that the Rotary Club wants permission to build
a shelter on the North side of Porter Park. All agreed that this
would be a great addition to Park facilities.
E: BILLS READ
Bills in the amount of $17,633.41 were read. Moved by Jensen,
seconded by Smith that they be paid.
E: CITY CONSIDERING WIDENING $ REPLACING CURBS AND GUTTERS ON 2ND SOUTH
DRAINAGE PROBLEM BEHIND JOHNSON DRUG TO KINGS
Pieper reported that 2nd South between Ist_and 2nd East the City was
considering widening two feet on each side, and replacement of curb
and gutters. Brinton was assigned to direct a survey of the residence
to see if they wanted an LID ~:~r to pay separately on the project.
Also the drainage behind Johnson Drug to Kings was discussed.
The City would do the sump to sewer and the businesses would pay accordingly
to benefits received to complete the underground drainage.
RE: NO IRRIGATION WATER IN 1974
Jensen announced that as of 1974 there would be no irrigation water.
Pieper moved adjournment 10:35. Smith seconded.

secended by Pieper that they be passed.

RE: REPRESENITIVES FROM COLLEEGE MEET TO DISCUSS WATER STUDY & MAKE PROPOSALS
President of Ricks College, Dr. Henry L. Eyring and Dean of Administration,
M. Rex Bennion met with Council to discuss the water study made by City
Engineer Clayter Forsgren and make proposals. Stated water deficiencies
for fire protection, sprinkling and the the future expansion of the
College.
a- Water study proposed $350,000 from College toward project which they
felt was high.
b. Separate systems - College Building and maintaning own.
c. Joint system with College paying $267,000 toward project which they
felt was high.
d. Commercial rate exclusive City paying all costs or with independent
auditor determining the costs per gallon at the end of each year
to dete,~~ui ne the cost for Co I I ege.
Before leaving Bennion & Eyring thanked the Council for the time and
iopportunity to be heard.
RE jCOLLEGE SEWER RATES
~In discussion on sewer rates received from College, it was brougi~t
out that College paid $200.00 monthly but probably uses 15 per cent of
lagoon capacity.
~E: MR & MRS TED GARNER PROTEST INSTALLING SEWER LINES ON NORTH Ist EAST
Mr. & Mrs. Ted Garner met protesting installing sewer lines on North
Ist East. Stating that they would have no use or need for the sewer in
their concrete mix business. Also they stated curbs and gutters installed
in the area, ~:~hich they recently completed payment on a 10 year LID,
were broken and no benefits yet received as street had never been paved
and City crews had used it for dumping dirt from sweeper and picking
it up again. Mayor Shirley said that the sewer installation would
increase the value of all the four pieces of property and following the..
installation and settling of trenches the street would be surfa~ed.
Owners of the lots in the area would be assessed by benefits to ederived
