PROPOSED AMENDMENT AND CHANGE OF
ZONING ORDINANCE N0. #478
Public hearing held at Utah Power & Light Auditorium, Rexburg, Idaho,
Friday the 16th day of March 1973, at 7:30 o'clock P. M.
President of the City Council Albert Pieper presiding.
Council present Barton Jensen, Richard Davis, Warren Porter, and Ru~1~h
Smith. Also present City Clerk and Treasurer Beulah Johnson.
Members of the Rexburg Planning Board present, Larry Perkins, B-air
Manwaring, Max Brinton, Lenore Passey, Mrs. Loren Weber and Wood
Miller.
Attending were Mr. & Mrs. Ken Bird, Dean Birch, Bob Purrington,
~-~- Mrs. Emma Williams & Daughter, and Cleo Browning.
PROPERTY OWNERS PROTEST, BUT N0 PETITIONS PRESENTED
Mrs. Williams and daughter, Cleo Browning adjoining property owners
were protesting against zoning this area R3, and asking for complete
finished plans before decision is made. However parties against
presented no signed petitions, as as ordinance asks for. Richard L.
Davis moved that legal regular proceedings be presented before -the
Council could vote on same. Seconded by Jensen.

MEETING OF THE CITY Of REXBURG, IDAHO
Regular City Council held April 4, 1973, at City Hall, at 7:30 P. M.
Present and presiding Mayor Henry Shirley.
Council present Ruth Smith, Warren Porter, Richard L. Davis, Barton
Jensen, and Albert Pieper. Absent and excused Glenn Peterson.
City attorney Mary Smith, City Clerk & Treasurer Beulah Johnson.
Reporters Rod Clifford, and Rick Ripley.
IRE: CITY ATTORNEY TO PREPARE AMMENDMENT TO EXISTING BEER ORDINANCE
Harvey Summers again appeared requesting a change in the beer ordinance
requiring him to close his business at midnite. He asked the hour
be extended to comply with the State code governing the sale of
alcoholic beverages, which allows the establishments to remain open
until I:00 A. M. Jensen moved that the City Attorney prepare an
ammendment to the existing ordinance which will conform with the
State code, which has to be read three consecutive council meetings
before it becomes law and opposition may be voiced at that time.
Seconded by Pieper.

ARE: STUDY TO BE MADE ON FUTURE ANNEXATION OF AREA SOUTH OF CITY LIMITS

Mayor Shirley appointed Davis as chairman, Jensen, Porter and any members
of the planning board to make recommendations and call meetings to study
the future annexation of various area immediately South of the present City
limits. The action resulted from a tentative decision at the last
counc i I meeting to annex the Anderson - Wi I I 1 ams prup~urty Wr~si~ c?f a i i~
West 5th West and adjoining 7th South. This will be postponed u,~1~11
study is completed on this area, as 7th South will eventually be a
Main traffic artery in the near future.
~E: JIM BARRETT & DEE FULLMER ASK THAT MANWARING CONSTRUCTION COMPLY WITH
ZONING ORDINANCES
Jim Barrett & Dee Fullmer met with the council concerning the building
recently placed in their area by Manwaring construction. Stating
that they didn't object to them being there, as Long as they complied
with the Zoning Ordinances, but if not in compliance they wanted proper
action taken. The council studied the governing ordinances and concluded
that the status of the property in question at the time the.. Zoning
Ordinance was passed is the way to solving the dispute. City Attorney
was instructed to research the details of this and report back.

Merrill .Rudd City Auditor presented copies of the 1972 audit to
all members. He gave a brief report and was asked to return to the
next council- meeting after the Council had, had time to study the audit.

Bills in the amount of $23,412.56 were read, moved by Jensen, seconded
by Pieper that same be paid.

~E: MR & MRS JACK RANDALL ASK FOR PERMISSION TO NOT TO BE PART OF NE4V LID
Mayor Shirley read a letter from Mr. and Mrs. Jack Randall asking for
permission to pay the contractor separate from the up coming LID
rather rather than being part of the LID. The request was denied and
the Mayor stated he would inform him of their decision.
~E: INSURANCE PREMIUMS HAVE RAISED ON EMPLOYEE HEALTH COVERAGE
Mayor announced that the insurance premiums had raised again for
the Health Coverage that we carry on employees. Ask that notes to
all employees be attached to their checks so that they would be aware
of it, amount being $42.10.
tE: .AGREEMENT READ FOR REX CATMULL ON HIS GUEST PARKING
Pieper read the agreement he had prepared for Rex Catmull on his
guest parking. It was agreed to the changes and ask that when
completed it be returned, signed by Catmull and be on file in the
police department and City Hall.
;E: CITY TO REMOVE OLD SIDEWALKS & DRIVEWAYS
Davis moved that the City will remove old sidewalks (and driveways
between sidewalks and streets where requested) and will pay ,20~
per square feet toward replacement of new walks provided:
(a) The sidewalks to be removed and replaced are first approved by
the proper City official. +
(b) The new concrete walks be of no less than 5 I/2 bag mix and be I
installed on a compacted fill and by a skilled and competent workman.
(c) The new walks be 5~ 0 wide and 4 inches thick, unless the
City Council approves a different width.
The City wi11 not turnish or install any gravel fill nor will they
share in the cost of driveways. The total City funds allocated ~'
to this program for the calendar year 1973 shall not exceed $5000.00.
In case requested replacements exceed these funds the City shall determine
where the funds should be spent,
BUSINESS MEN WANT CITY PARTICIPATION ON CONNECTING ALLEY TO DRAIN
Business men Johnson, Graver, & Vern & Ferrets want city participation
on connecting alley area to the drain near center street to take
care of the drain off. Pieper to investigate and report back.
ARCHITECT GIVEN TENATIVE GO AHEAD TO PREPARE COST ESTIMATE ON NEW FIRE STATION
Mayor Shirley stated that architect. Merlin Anderson, had been given
tenative go ahead to prepare initial cost estimate on the new fire
station, which the civil defense will participate in building costs,
as it will house the civil defense..

The new county-city jail contract was read. Jensen moved we accept
County agreement with the exception-of insurance. If they would include
this in the $400.00 a month costs. Seconded by Smi7~h.

~E NEW AMBULANCE MAN CHOSEPJ, NEED FOR TWO MORE FIREMAN
/' Mayor stated that a new ambulance man had been chosen, and that the
need for training two more fireman was now,as Clements and Kington
would be retiring in 1974. Clements ask that the City pay his
Social Security for 1973 to build up his credits for retirement.
Motioned by Smith, seconded by Pieper that they pay this.

RE: SMITE-I ASK PERMISSION TO HAVE TREE STUMPS REMOVED
Smith ask permission to have trees stumps removed by Zundel Tree
Service with the street crews cleaning up debris.
RE: DISCUSSION ON CONDITIONS ON EAST 2nd SOUTH
Discussion on conditions on East 2nd South and what plan needed for
improvement. Davis has the map of same. Tabled
Porter moved that meeting adjourn at II:10. Seconded by Smith.

Present and presiding Mayor Henry Shirley. Council present Ruth

Johnson, Reporters Rod Clifford, & Rick Ripley. D. Le Roy Armstrong
Water Sewer Superentendent, and Clayter Forsgren, City Engineer.

Zt: FIRST READING OF ORDINANCE 535
-first reading of Ordinance 535 - Beer. Mary excused.
~E: TOWARD L. BURKHARDT, REGIONAL ENVIORMENTAL DIRECTOR MEETS ABOUT SEWAGE
OVERLOAD
Howard L. Burkhardt, Regional Enviornmental Director from Pocatello
met with the Council, to report on the Citys overloaded sewage lagoons.
Armstrong challenged Burkhart's statement of sewage treatment being
inadequate, as the lagoons at present were operating above standard.
Davis ask if overload problems were the same in all Cities. Burkhart
stated that increase in Federal restrictions and standards was more
stringent. He stated 'snfiitration was most immediate problem, which
pushes sewage through the sewage lagoons faster than it can be treated.
This happens during irrigation months, when water table is high.
Armstrong stated that there are about 5 or 6 blocks in the system
