RE: PURCIif~~E OF A RADAR UNIT FOR THE POLICE DEPARTMENTDISCUSSED The purchase of a radar unit for the police department was discussed. Rental Lease basis with complete warranty until unit was paid for. This was decided to be a very reasonable plan, and to go ahead. RE: MAYOR ASK CITY TO WAIVE DELLA PARKfNSON SEWER HOOKUP FEE Mayor Shirley ask that the City waive Della Parkinson the sewer hookup fee on West Main. Explaining the County and City would ali .participate in .getting this service to her, residence as it was a necessity due to conditions and age of this lady. Pieper moved that the fee be waived and necessary, steps be taken for this situation.: Seconded by Smith. All Aye. ~RE: MAYOR READ LETTER RECOMMENDING AMENDING ZONING IN THE BUILDING CODE Mayor read a letter from Max Brunton recommending amending Zoning in the building Code. This was discussed. Mary was to take it under advisement. RE: MARY SMITH INSTRUCTED TO PREPARE ORDINANCE COVERING GLUE-SNIFFING & INHALANTS Mary Smith was instructed to prepare an Ordinance covering glue-sniffing and other inhalants for September 20th meeting. RE: DAVIS TOLD OF MEETING WITH NELSON RICKS REPRESENATIVES Davis told of the meeting with Nelson Ricks represenatives. Explained the gallons of whey per day, made it prohibitive to the City of Rexburg~& Nelson Ricks to use our sewer facilities. The usage from the Creamery would be equivalent of 35,000 population. Jensen moved -that meeting adjourn at 11:07. Seconded by Smith. All Ay . M yor ity Clerk MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO Regular meeting of the Rexburg City Council held 6:30 P. M. September 20, 1972, at the City Hall. Present and presiding Mayor Henry Shirley. Council present Glenn Peterson, Warren Porter, Albdrt Pieper, and Richard L. Davis. Absent Ruth Smith. Passage of bills in the amount of $27,819.54. Barton Jensen came at 7:15 P. M. Others present pity Clerk R Treasurer Beulah Johnson and reporter from Rexburg Standard David Bly. RE: R'wVISED PLANS FOR THE (5TEINER) REXBURG ACRE5 SUgpIVISfON ~EVIEWEt) The revised plans for the (Steiner) Rexburg Acres subdivision were reviewed after being presented by the Mayor for approval. Moved by Davis, seconded by Peterson that the plat be approved. All Aye RE: PLANS FOR THE L. D. S. SEMINARY BUILDING PRESENTED The plans for the L. D. S. Seminary building near the new High School were also presented. A waiver was asked to the building ordinance concerning parking lots. Motioned by Peterson seconded by Pieper this be granted. All Aye R~ DAMS ASK PERMISSION FOR ARMSTRONG & BRIAN TO GO TO CONVENTION Davis ask permission for D. Le Roy Armstrong and Jerry Brian be allowed to go to Burley for a water works convention. Moved by Davis, seconded by Pieper. Unanimously Carried RE: PIEPER HAS FOUND STUDENT TO PAINT SLOGANS ON GARBAGE RECEPTACLES Pieper announced that he had found a college student to paint decal slogans on the new street garbage receptacles. MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, 1DAH0 Regular City Council held 7:30 October 4, 1972 at the City Hall.. Present and presiding Mayor Henry Shirley. Council present Barton Jensen, Albert Pieper, Warren Porter, Glenn Peterson and Richard L. Davis. Absent Ruth Smith. Others present City Attorney Mary Smith, City Clerk and Treasurer Beulah Johnson, reporters David Bly and Rick Ripley. RE: COMPLAINT FILED AGAINST COUNCIL & MAYOR RE: PROFESSIONAL PLAZA ~7~ 1 City Attorney presented each of the Council and Mayor with a ~~ complaint filed against them, Professional Plaza Inc, Mountain. States Telephone, Peterson Enterprises, Golden Living Center for violation of Zoning Ordinances of the City of Rexburg. Planintiff being residents in the block surrounding the Professional Plaza. After some discussion Mayor Shirley ask the attorney to study and report at the next Council meeting. RE LETTER FROM PLANNING BOARD & ALSO LETTER AND PROPOSAL PROTECTIVE COVENANTS FOR PROFESSIONAL PLAZA Mayor read a letter from the Planning Board dated August 28th, 1972, he also read a letter and proposal protective covenants for this above area. Glen moved that this be tabled for further study. IRE: MINUTES READ Minutes of September 6, 1972 wera read corrected moved by Jensen, seconded by Pieper that they stand as read. E: CRAMER~S LAWYER INFORMED ATTORNEY TO ADD BILL FOR DEMOLISION TO TAXES Attorney Smith reported that Cramer~s lawyer had infiormed her to add the bill for demolision of the property at 125 South 2nd East to the taxes at County tax roll. ~E: STATE HIGHWAY REPRESENITIVE MEETS TO DISCUSS IMPROVEMENT OF TRAFFIC SIGNALS Clyde Gillespie traffic engineer of the State Highway met with the Council to discuss the previous agreement between the City and State for the irnprovernent of traffic signals in Rexburg. Jensen Moved that Mayor sign the resolution for the department of the State of Idaho Traffic signal irnprovements. Seconded by Uaivs. All Aye 2E; MINUTES READ FOR SEPTEMBER 20 Minutes of September 20, 1972 were read. Moved by Porter, seconded by Davis that they be passed. Unanimousley Carried 2E: BILLS ROAD E3ills in the amount of $25,247.57 were read. Moved by Davis, seconded by Jensen that same be paid. Unanimousley Carried ZE: ORDINANCE 532 AN ORDINANCE PROHIBITING THE SALE, INGESTION OR INHALATION OF CHEMICAL SUBSTANCES FOR THE PURPOSE OF CAUSING A CONDITION OF INTOXICATION INEBRIATION, EXCITEMENT, STRPEFACTION OR DULLING OF THE BRAIN OR NERVOUS SYSTEM. A motion was made by Barton Jensen, seconded by Glenn Peterson to suspend the rules and have said Ordinance placed upon its final passage. The Mayor ordered the roll call of the council called, and the roll being called by the City Clerk for the suspension of the rules was as follows: Those voting "AYE" Barton Jensen Albert Pieper Warren Porter Glenn Peterson Richard Davis The roll being called and all Councilmen present voting "AYE" carried. The Mayor then called for the voting for final passage of the Ordinance, the motion was made by Richard L. Davis, seconded by Albert Pieper. The Mayor ordered the roll call of the council called,. and the roll being called by the City Clerk for the final passage of the Ordinance was as follows: Those voting "AYE" Barton Jensen Albert Pieper Warren Porter Glenn Peterson Richard Davis The roll being called and all councilmen present voting "AYE" carried, the Mayor declared that a majority of all the members of the City Council had voted for the passage of said Ordinance and that said Ordinance was duly and regularly passed. Mayor Shirley then declared the motion carried. E: CONVEYING SALEM AVE TO THE CITY OF REXBURG THAT IT BECOME PART OF THE CITY STREET SYSTEM Jensen moved we accept the deeds from the property owners conveying Salem Ave to the City of Rexburg, Idaho and that it become a part of the City street system, and recommended that aturn around be establisf~ed on the east end. Seconded by Peterson. All Aye RE: SUIT FILED WITH SEVERAL OTHER CITIES AGI~INST AMERICAN OIt~ CCJ: Mary explained the suit filed with several other cities against the American Oi{ Company for asphalt price fixing. RE: RES~I_UTION [1 Whereas, the City of Rexburg, Idaho, joined with the State of Idaho in a court ac-i-ion against the American Oil Company et al, and Whereas, the attorney General's office of the State of Idaho is negotiating a settlement of said action with the defendents, and, Whereas,'the City of Rexburg deems it advisable that .said action be settled. Now therefore be it resolved that the office of the Attorney General of the State of Idaho be, and it is hereby authorized to negotiate and enter into a settlement with the defendants in said matter. DISCUSSION ON LEASE WITH VAL DIETRICH ON 1913. FIRE ENGINE Discussion on the recently written lease with Val Dietrich. Mary stated Dietrich reported it impossible to secure fire and theft on the 1913 fire engine. Peterson moved we eliminate the clause in the lease. Seconded by Jensen. "~ k' 1 ~ ~I i All Aye RE: SALE OF CITY PROPERTIES EXPLAINED & LAW SUITE PERTAINING TO ALLEY IN BLOCK 39 Sale of City properties was explained by by City Attorney, she also stated that the City had no involement in the law suite pertaining to the alley in block 39. RE: CITY TO RECEIVE $68,755.00 for 1972 REVENUE SHARING Mayor reported that the City would be receiving $68,755.00 for 1972 revenue sharing, with first portion being sent in October per letter from Orval Hansen. RE: MAYOR TO BE INTERVIEWED ON OCTOBER 19 ON THE MAGISTRATE COURT Mayor announced that he was going to be interviewed on October, 19, on the magistrate court and its workablity. RE: LETTER FROM EXECUTIVE SEC. OF ALUMINI ASSOC1ATfON GLEN ERICKSON Mayor read a letter from Executive Secretary of Alumini Association, Glen Erickson of Ricks College thanking the City for help in the recent homecoming parade. RE: DISCUSSION ON RAILROAD CROSSING ON 4th So 5th West & Crossing on WEST MAIN The council discussed widening of i'he railroad crossing on 4th South. and 5th West, reading a letter that Forsgren and Perkins had received from the railroad stating they would widen it for $835.00. West Main crossing was also discussed for fixing. Moved by Pieper, seconded by Davis that this be done and the matter of West Main crossing be given consideration for fixing. Unanimousley Carried RE NDFILL DISCUSSED Lanfill discussed. RE; COMPLAINTS ON TO MANY NO PARKING SIGNS ON Ist EAST Porter reported 15 No Parking signs on Ist East. People were complaining and he wanted to know if this many was necessary. ICE: HOUSING FOR SEWER CLEANER & NEW FIRE TRUCK DISCUSSED Housing for the Sewer Cleaner and the New fire Truck was discussed. Possible use of the County Building, or Burtenshaw Building. Council present Ruth Smith, Richard L. Davis, Glenn Peterson, Warren Porter, Barton Jensen, and Albert Pieper. Others present City attorney Mary Smith, City Clerk & Treasurer Beulah Johnson and Post Register Reporter Rick Ripley. RE: GOLF ASSOCIATION ASKS FOR $2,000 Dee Sellers, member of the board of directors. of the Rexburg Golf Association met with-~-he Council, asking for $2,000 to keep the Course in the black. He explained that they over estimated the take this year and over spent in remodeling. Porter moved that , $1,000 be allowed at this time. Seconded by Davis. All Aye RE: MINUTES READ Minutes of October 4 were read. Corrected. Motioned by Smith, seconded by Pieper that they be passed. Unanimously carried RE: DISCUSSION ON HOUSING OF THE NEW FIRE TRUCK AND COUNTY AMBULANCE Glenn Peterson led the discussion on housing of the new fire truck and county ambulance. He stated that Ricks College, County & Civil Defense would participate. He is to pursue all possibilities .and report back. The college paying I/3 of 50~ and Civil Defense would pay 50~ if built to Civil Defense specifications. RE: DISCUSSION ON LAW SUIT PENDING OCTOBER 30 Discussion on the law suit pending on October 30. Attorney Smith advised the mayor and council that they were bound to enforce the Zoning Ordinance. Mayor stated negotiations looked promising. RE: STATE HIGHWAY ASKS TO MEET WITH COUNCIL Mayor stated that Harry Day, State Highway Sixth District engineer, had called asking for a time to have a meeting with Council, County, Golf Association and Airport. Stating that the federal enviroment group were contemplating a study on our proposal highway 191'20. This meeting was to be an advisement meeting. Shirley said that final accumulation of study data is still several months away. RE: CIVIC CLUB ASK ABOUT PLANTING TREES ON EAST MAIN Civic Club ask advise about planting trees at East Main. Discussion on future traffic hazards and conditions. Council agreed that this sl~ou I d ~e d i scouraged.
