A1~lU Regular meeting of the Rexburg City Council held Septenib~;r 6, i°i72 at 7:30 P. M. at the City Hall. RE: RE: RE: Present and persiding Mayor Henry Shirley. Council present Ruth Smith, Albert Pieper, Richard L. Davis, Barton Jensen, Warren Porter. Absent was Glenn Peterson. Others present were City Attorney Mary Smith, City. Clerk & Treasurer Beulah Johnson, also present reporters David Bly & Rick Ripley. Minutes of August 16, 1972 were read, corrected, moved by Davis seconded by Porter that they be passed. Ally Aye. GARY WILLIS AND LARRY WOOLF ASKS PERMISSION TO OPERATE ENTERTAINMENT ESTABLISHMENT. Gary Willis and Larry Woolf from Idaho Falls met with the Council asking for a license to operate an entertainment establishment for the youth. They stated hours for being open starting October I, with closing at 10:00 Pm on week nights and 12:00 midnight on Saturdays, at 49 College Ave recently vacated by the Lolly Shop. Council discussed & there was no objections ifi all laws and ordi'r~ances were followed. RICKS FiOMECOMING PARADE TO BE SEPTEMBER 23 Lynn Anderson, alumuni chairman of Homecoming parade for Ricks College, ask that cars be cleared from Main Street for the parade, that will be held September 23 this year. Porter moved -that the police keep the cars off the street of the parade route until after the parade. Seconded by Smith. All Aye. Anderson thanked the council and stated that Glen Erickson be contacted for further information to help the city police. VOLUNTEER FIREMAN PRESENT LETTER Richard Luke and Blaine Bake volunteer fireman representing the fire department, presented a letter to all members, which they had submitted to Fire Chief Clements in July. July 26, 1972 Fire Chief Silas Clements Rexburg, Idaho Dear Chief Clements, As taxpayers and residents of the City of Rexburg, we would like to make some suggestions for the improvement of fire protection in the city. Since we are volunteer firemen, we feel we can make suggestions more knowledgeably than the average citizen. We are aware of the financial problems of city government but feel our suggestions are not out of line for a city the size of Rexburg. I. At present, we have 14 volunteers with about half that number coming to most fires. At a large fire, 8 or 10 men would not be adequate manpower. We suggest that a total of 20 volunteers be obtained and put on the telephone alarm system immediately. 2. Fire meetings are held to Lain the volunteers. Better use of time and money would be gained by using these meetings to have drills which include the extensive use of all equipment and the practice of modern techniques. Films and other visual aids can also help make practical experience more meaningful. In a fire situation where lives and property are involved, practical experience and automatic responses are vital for all firefighters. 3. Currently all hose the department has is on the truck. For a large business, such as the grain elevators, this is not enough hose to fight the fire and prevent it from spreading. Within the next two years 1000 feet of 2 I/2 inch hose and 1000 feet of i I/2 inch hose should be purchased. J ,~ 4. Also ih the next two years four more air masks need to be obtainod in order to provide more protection in smoky buildings. 5. It is our understanding that money has been appropriated 'I~o equip the rescue van. Therefore, we suggest the following tools be purchased •X71' immediately. I K-12 portable power saw I bolt cutter 3 crow bars 4 drop cloths 3 pinchbars mop and bucket I tin snip 2 shovels I wire cutter rope 2 hatchets 6. Two-way radio communication between the ambulance and fire station is becoming vatal tq fast dispatching of the ambulance. As the money is availabel this should be taken care of imediately. 7. We feel it important in future work to establish a line of command to be followed at all fires. One person should be responsible for organizing, making decisions, and giving orders, with all others abiding by his decisions. ` We are proud to be volunteer fireman and would like to take pride in the department. We want to be well trained in the latest, most efficient methods of fire fighting and in techniques for using our equipment. We want to be of service to the community. We feel the implementation of the above mentioned suggestions would help maintain ..our current fire insurance rating and also help make us more efficient. It would give the City a department in which they could take pride. We are presenting copies of this letter to the Mayor and City Council in order to obtain their support in helping implement these suggestions. Respectfully, Richard Luke, Jim Gordon, N. R. Luke stated that volunteer fireman served because of <a sense of community pride, not pay. The situation was discussed with the two, and funds paid to the department was under investigation. Mayor stated that a study would be made and improvements made. R-: CORDON THATCHER PRESENTS PETITION SIGNED BY RESIDENTS WHO LIVE NEAR PROFESSIONAL PLAZA, DISCUSS INTERPRETATION OF EXCLUSIVELY PROFESSIONAL. Gordon Thatcher, local attorney, met with the Council to present a petition signed by 40 residents who live near Professional Plaza, stating he was retained by them to investigate the matter. Stating that they oppose the relaxing of the exclusively Professional clause of the orginal limited commercial permit granted to the builders of the Plaza. Thatcher said his research showed that exclusively professional interpreted as physicians, denists, optometrists, and attorneys; and excludes such businesses as real estate, insurance, photo and beauty shops. Mayor Shirley read a letter from the Planning board. RE: LETTER FROM PLANNING BOARD RELATIVE TO PROFESSIONAL PLAZA August 28, 1972 _~ Mayor and City Council City of Rexburg Rexburg City Building Rexburg, Idaho 83440 Gentlemen:. Re: Professional Plaza Mr. Kent Jolley, Dr. Lester Petersen, and Mr. Brent Eames of the Professional Plaza development and Mr. Clyde Anderson of Mountain States Telephone Company met with the Rexburg Planning Board on August 23, 1972, and presented their proposal for further building construction in the plaza. There was some discussion as to what constitutes a professional office, what requirements and controls the city should impose on the area, the need of restrictive covenants to be established by the owners, etc. The representatives of the Professional Plaza agreed that, when the zoning variance was made to establish a limited commercial zone ~ d for their development, the intention was that they would mr~r~1 thc~ bu i I d i ng requirements of the R- I zone which surrounds tiresrn. 1 i~,: zoning ordinance is not clear in this regard, and the Planning Board agrees that in some instances this imposes unreasonable setbacks, etc. for this type of development. The following action was taken by the Planning Board: I. The vote of the Board was unanimous to recommend to the City Council that approval be given for the Telephone Company to establish their business offices in the Professional Plaza. This .action was made with the understanding that there will be no major telephone equipment in the building and no maintenance trucks or equipment stored or dispatched there. This seems to the Board to not depart from the initial intention of the city or from the petions signed by the area residents at the time the action was taken. 2. Because of the indefinite nature of the zoning ordinance with regard to the requirements for limited commercial zones, the Board recommends that all future requests for development and for building permits in the Professional Plaza be presented before the Planning Board for approval... Any variance from R-I zone requirements that the Board feels are justified will then be presented to the City Council for approval prior to the issuance of a building permit. The Board believes this will be a protection for the developer as well as for the city. It is the intention of the planning Board to present some revisions to the zoning ordinance for your consideration in the near future. Planning Board Members RE: REPORTED THAT OWNERS OF THE PLAZA NEGOTIATED WITH MOUNTAIN BELL It was reported that owners of the Plaza had negotiated with Mountain BeII Telephone and that there was some question. in the minds of adjacent property owners as to whether or not Mountain Bell was a professi-oval or busihess office. The Council decided that it was not up to them and thought that they must stand by their orginal action, which was accepted at the time by all parties concerned. RE: BILLS READ Bills in the amount of $22,562.68. were read. same by paid. Seconded by Smith. All Aye. RE: DOG COMPLAINTS, POUND NEEDED Moved by Pieper Dog complaints were heard. Need of place for a pound was discussed. Tabled for further investigation. RE: ELDON BRIGGS EXPRESSES APPROVAL OF WATER DEPARTMENT INSTALLATION OF WATER 1 I NFL Eldon Briggs, former Rexburg plumber now of Salt Lake City, sat in on the meeting for a tew minutes and expressed his approval of Mr. Armstrong's water department, in the installation of water lines this past season. He stated that he felt it was a great savings to the City, and the department was to be commended for a job well done. RE: LETTER AND CHECK FROM REX T. V. Mayor Shirley read a letter from Rex T. V. and presented a check for $400.07 on the franchise tax. RE: LETTER ~~~ 1 September 6, 1972 Mr. Henry Shirley, Mayor City Hall Rexburg, Idaho Dear Henry: Enclosed is a check in the amount of $400.07 which represents franchise fee payment as outlined below. As I mentioned in an earlier letter we would like to pay the fee for the four months December, 1972 to March, 1972 and the three month fee from April to dune. Then, according to the franchise, every three months thereafter. Receipts from. service charges for the. first period were $11,074.37 and $8928.88 for the second period for a total of $20,003.25. As per the franchise the fee is 2~ up to 750 subcribers and beyond that the fee goes to 3~ of the complete total. On March 31st we had 483 subscribers. As of the 30th of June that total was depleted by approximately 50 due to college students disconnecting and. a few Summer disconnects. However the total to today is 583 since we are now beginning to get some action on those who disconnected because of vacation, etc. Also college students are now beginning to sign up. We contracted with a marketing firm this past Summer for a certain amount of sales promotion and they did bring in some new customers. The organization will return to Rexburg next month for a complete, thorough promotion and its reasonable to assume that with the new television season upon us along with the imminent addition of channel II, BYU, the subscriber count will begin to jump. We remain very optimistic over the success of the CATV system in Rexburg. We have recieved a certificate of compliance from the FCC for the BYU channel and now all we are waiting for is the micro wave link to be completed. They promise me it will be in in time for the October LDS conference. It may be ready to offer subscribers by the 25th of this month but we will have to wait before we can be certain. The application for the certificate of compliance for the Denver Station, KWGN, will be delayed according to word from the FCC. Even if it were not delayed it would likely be 60 to 90 days before we would put that one on. Right now it looks like about the first of the year for Denver. The BYU station, which isKBYU, channel II, will be very attaractive to the Morman Population in town...and also to college students. I am sorry we are a little late with our franchise fee payment. We have experienced some additional capital expenditures which were not planned originally. Best Regards. Don RE: LETTER FROM VERN LILJENQUIST `-' Mayor Henry Shirley City Hall Rexburg, Idaho Dear Hank: August 5, 1972 I'd like to take just a minute of councilmen (and council-woman) for are conducting the City's affairs. your time to commend you and your the efficient way in which you I just had the occasion to replace the sidewalk in front of any house. Mr. Moulton and his crew were most punctual and co-operative and my wife and I especially appreciated the care they used when near and around our sensitive curb trees. As a businessman, I am extremely proud of our fine-looking main street, by far the prettiest and best-kept in this part of the couhtry. I also appreciate the stand you are taking in keeping these same sidewalks free of distractions. So-here's one citizen and businessman who's proud of Rexburg and its administration. 1 ~ `~ Sincerely, Vern Liljenquist P. S. RE: LETTER SIDEWALK August 9, 1972 The Honorable Mayor & Council City of Rexburg Rexburg, Idaho Gentlemen: Approximately two years ago, an article was published in the Rexburg paper, changing the City ordinahce on sidewalks from four feet to five feet in width. We thought the four foot sidewalks were wide enough, since two people can comfortably walk side by side on them, and too, they are cheaper to install, which means a great deal to most people. But now, what has happened to the Rexburg City Ordinance on sidewalks? Since our town has changed from a small one info a fairly large one at a rapid rate, it seems that this ordinance has been completely ignored by the city officials and also the Planning Board, as well as a great number of the people who have been building homes, apartment houses, etc., and sidewalks have been omitted in many instances. This is indeed a bad situation, since sidewalks are very important to any city's physical beauty, as welt as to its citizens' physical safety. It may be true that people do not walk as much as they used to, but our children and the Ricks College students do, and their welfare should be our first concern. .With the great number of automobiles being driven, sidewalks are very cheap life insurance; and also, pedestrians on the icy streets in the winter are a hazard to drivers. Are we, the people of Rexburg, turning our backs on this important ordinance in our city's growth? Are we planning just for today, and not thinking of the furture? Why is this ordinance not being enforced? !f this is allowed to continue, it will not be too many years until one day the people of Rexburg will wake up and wonder how such a sad mistake could have been made before their very eyes! Rexburg has had a Building Inspector for many years. Should it not be one of his duties to see that a sidewalk is installed in front of every new building? It has been proven~in the new Starlight Addition, for example, that everyone buying a new home is willing to pay for a sidewalk in front of it. Anything less than this is nothing but poor planning. Now that we have a full-time Building Inspector, it would seem the proper time for him and the city officials to notify all property owners that within a reasonable time, perhaps one year, sidewalks must be installed on all streets with homes or other buildings, and also, buildings, and also, that all fences built out to the curbe be removed and put back on personal property. We should not leave this situation any longer or it wit{ just become more difficult to overcome. We are writing this letter only as a suggestion for the betterment of the City of Rexburg, and not in criticism of the excellent job being done by you people. Actually this condition began same years ago approximately at the time the first homes were built on Ash Avenue. However, we feel that now. is the time to rectifyit before it becomes more difficult. Therefore, we respectfully request that you present this problem at your next meeting and take action on it at this time. We enc{ose a partial list of the Rexburg streets having no sidewalks. None on Harvard Avenue South of Third South to Fourth South. Throughout Bagley Addition, just one home has sidewalks. North side of Third South between Third and Fourth East, only one home has sidewalks. North side of Second South between Ash and Birch. All of Ash Avenue between Main S-treet and First South. None on either side of Main Street between the Hospital and Third East except at the former Flamm Funeral Home. South side of Linden to Elm, and Linden to Maple o~n Second South. Maple Street fromSecond South to Oak. Finced to curb at the second house from Second South, North on Mill Hollow Road. Mill Hollow Road on both sides. Fenced to curb on Reed Street, and no sidewalks on part of Reed Street. East side of Fourth East between the Hospital and First North. This is important because students will be walking to the new High School along this street. ~RE: MARY TO CHECK AND STUDY FOR SIDEWALK ORDINANCE Mary to check and study for sidewalk ordinance. IRE: DISCUSSION ON THE PAST DEMOLISION OF CRAMER PROPERTY. Discussion on the past demolision of Cramer property. Mary stated she was to meet with their lawyer in the near future, as Cramers were contemplating a law suit. RE: COMPLAINT FILED BY LARRY THOMPSON Larry Thompson filed a complaint on the accumulation of junk and .general condition ofi the yard at 207 North 2nd West, residence being that of Don Wylie. Mayor Shirley stated- he would contact Mr. Wylie on the matter. RE GARY BALL REPORTED AIRPORT RUNWAY COMPLETED & MR ARMSTRONG CROSSING RUNWAY FOR .LAGOON INSPECTION PROHIBITED Gary mall reported airport runway was completed and said that Mr. Armstrong was crossing the runway for lagoon inspection which was prohibited. Davis stated that the lagoons had to be inspected and that it would inconvenience Armstrong to drive clear around the golf course and airport to get to the other lagoons. Stated he would .look into situation. RE; DISCUSSION ON (TIRING A DECA STUDENT FROM HIGFI SCHOOL Discussion on hiring a DECA student from High School at minimum wage of $•1.60 per hour. Rental lease basis with complete warranty until unit was paid for. This was decided to be a very reasonable plan, and to go ahead. RE; MAYOR ASK CITY TO WAIVE DELLA PARKINSON SEWER HOOKUP FEE Mayor Shirley ask that the City waive Della Parkinson the sewer hookup fee on West Main. Explaining the County and City would all participate in getting this service to her, residence as it was a .necessity due to conditions and age of this lady. Pieper moved that the fee be waived and necessary steps be taken for this situation.: Seconded by Smith. All Aye. ~RE: MAYOR READ LETTER RECOMMENDING AMENDING ZONING IN THE BUILDING CODE Mayor read a letter from Max Brinton recommending amending Zoning in the building Code. This was discussed. Mary was to take it under advisement. RE: MARY SMITH INSTRUCTED TO PREPARE ORDINANCE COVERING GLUE-SNIFFING & INHALANTS Mary Smith was instructed to prepare an Ordinance covering. glue-sniffing and other inhalants for September 20th meeting. RE: DAVIS TOLD OF MEETING WITH NELSON RICKS REPRESENATIVES Davis told of the meeting with Nelson Ricks represenatives. Explained the gallons of whey per day, made it prohibitive to the City of Rexburg~8 Nelson Ricks to use our sewer facilities. The usage from the Creamery would be equivalent of 35,000 population.
