M. ~~: Present and presiding Mayor Henry Shirley. Council members present Barton Jensen, Richard Davis, Albert Pieper, Ruth 'smith, Warren Porter, and Glenn Peterson. Others present were City Attorney Mary Oldham, David Bly Rexburg Standard & Journal Reporter, and Beulah Johnson City Clerk. Minurtes of April 17 regular meeting were. read & corrected. Motioned by Davis, seconded by Smith that they be approved. Unanimously. Carried ~: REMOVAL OF LETTER BOX BETWEEN POST OFFICE & FIREHALL DISCUSSED Removal of the letter box between the Post Office and the Firehall was discussed and tabled as the .need didn't seem as critical, as the employees were again parking on the lot South of the City Hall. ~: PROBLEMS CONCERNING ZONING & CONSTRUCTION IN PROFESSIONAL PLAZA Problems concerning Zoning and Construction in the Professional Plaza were cJiscussed. It was reported that a sign had been installed partly on City property with no permit issued. Also the type of business permissible were defined as Professional. Offices only. MINUTES READ Minutes of regular meeting held May 3 were read. Motioned by Jensen seconded by Porter same be passed. Le Roy Armstrong Water Superintendent met with the Council and explained the water increase that is needed at the present time, and that by enlarging the capacity at Porter Park and pu~1-ting a shallow well for irrigation for Porter Park would greatly increase the pressure and help the City. He reported many areas already having pressure problems. He also stated that alternate days will have to be established when condi-~ions warrant such. Smith motioned that the Mayor declare this an emergency and necessary steps be taken to alleviate the situation. Seconded by Davis. All Aye i-. DISCUSSION ON COLLEGE USE OF WATER ~. Discussed was the College and their excess use and waste of the water. Davis is to contact Charles Frost and report back. R DISCUSSION ON SEWER FOR THE NEW HIGH SCHOOL ~, Discussion on sewer for the New High School. Armstrong reported the best plan for their benefit and that the architect had plans for a lift station which i5 not necessary. This was tabled. RE: DISCUSSION ON BOB ERICKSON & RALPH RINGLE SEWER CONNECTS Discussion on-Bob Erickson and Ralph Ringle sewer connects West of City limits, stated that they had been charged a $200 hook-up at the time and that the State Health Department had forced them to use other means for disposing of this sewage because this connection wasn't going 10 the lagoon treatment plant, and they had stopped using the old sewer line. Davis ask that .the City refund them both their installation fee. :k RE: DON RICKS IS INSTALLING A SIGN TO DIRECT TRAFFIC Don Ricks reported that he was installing a sign to direct traffic on Highway 88 to the right for motels, cafes and ask the City to participate with advertizing the Swimming Pool and Parks. They i were in agreement that this shouldn't be done. The council felt that; it would be unfair to the other merchants. He thanked them and left. RE: BILLS PASSED Sills in the amount of $22,766.97 were read. Moved by Jensen, seconded, by Davis that same be paid. Unanimously Carried RE: JAYCEE'S OFFER SERVICES ON VARIOUS PROJECTS ~ l~ ._,; _ Members of Rexburg Jaycee's met with the Council and offered their services on various projects. The Council thanked them and will discuss the matter with them further. PETITION PRESENTED FOR MERRILL RUDD IN BEHALF OF HIS WIFE Mayor Shirley presented the following Petition for Merrill Rudd in behalf of his wife J'lene Rudd. Jensen moved that a variance for limited commercial permit be granted for one year only for 351 East 3rd South. Seconded by Davis. The Mayor ordered the roll call of the council called, and the roll being called by the City Clerk for the final passage of the Ordinance was as follows: Those voting "AYE" Barton Jensen Richard Davis Albert Pieper Ruth Smith Warren Porter Glenn Peterson The roll bing called and all councilmen present voting "AYE" carried, the Mayor declared that a ma-jority of all the members of the City Council had voted for the passage of said Ordinance and that said Ordinance was duly and regularly passed. Mayor Shirley then declared the motion carried. ORDINANCE 529 AN ORDINANCE AMENDING AND CHANGING THE ZOfJING MAP OF THE CITY OF REXBURG, IDAHO, TO PROVIDE THAT CERTAIN PROPERTY HEREINAFTER DESCRIBED IN REXBURG, MADISON County, Idaho, be changed from R3 ZONE TO COMMERCIAL. A motion was made by Richard Davis, seconded by Barton Jensen to suspend the rules and have said Ordinance placed upon its final passage. The Mayor ordered the roll. call of .the Council called, and the roll being called by the City Clerk for the suspension of the rules was as follows: Those voting "AYE: Barton Jensen Richard Davis Albert Pieper Ruth Smith Warren Porter Glenn Peterson The roll being. called and all councilmen present voting "AYE"carried. I RE; ORDINANCE NO 530 AN ORDINANCE REQUIRING A PERMIT BEFORE MAKING AN EXCAVATIO~d IN ANY STREET, ALLEY OR EASEMENT OF THE CITY OF REXBURG, IDAHO, AND REQUIRING THE FOLLOWING: A CERTIFICATE OF PUBLIC LIABILITY INSURANCE, APPLICATION FOR AND NOTICE OF EXCAVATION, BACK-FILLING AND REPAIR OF STREET, ALLEY OR EASEMENT, AND THE MAINTENANCE OF PROPER SAFEGUARDS. MAYOR & PORTER MET WITH THE COUNTY COMMISSIONERS The Mayor reported that Porter and himself met with the County Commissioners on: ~,,., (I) Taxes charged to the City and tabled for Attorney General's opinion. (2) Dispatch moneys owed the City. (3) County landfill. Zero with progress. City discussed possibilities. ,.~. VAL DIETRICH WANTS CITYS OLD FIRE TRUCK The Mayor stated that Val Dietrich wanted the Citys old fire Truck to maintain, clean, polish, and store for parades and various advertising purposes. Mary was instructed to draw up a lease and check legality of same. IRE: MAYOR ASKS FOR APPROVAL TO GET~BIDS FOR FURNACE Mayor ask for the Council approval to get bids for a gas furnace for the present City Hall. ~~ ZE: MAYOR ORDERED GARBAGE CONTAINERS Mayor stated he had ordered 10 more garbage containers at $178 a piece.. Unanimously Carried ~E: REPRESENATIVE FROM RICKS COLLEGE EXPLAINED EXCESSIVE WATER USE Davis reported that Charles Frost from Ricks College had explained excessive water use, the time switch had stuck. Reporting what they would be careful and cooperate, even watering at odd times if nece~.'>s~~ry. ZE: CRAMER DEMOLlS10N COMPLETED PAYMENT TO BE MADE TO J. D. WOOLF Davis also reported that the Cramer demotision was completed, except some till needed. Recommended that payment be made, on inspection, to J, D. Woolf, Mary stated that if A. L. Cramer didn't pay it would be given to the County to add to the tax on Cramer Property. zE: BILLS READ Bills in the amount of $44,297.79 were read..
