It was suggested that the Ricks College take it on as a Project, and na~t involve the City. Davis is get~l~ing specs from police, fire, contractors and notify Cramer, then we will proceed with the dernolishion of all buildings. DAVIS REPORTS NELSON & BR{NTON ARE BUSY ON REGIONAL PLANNING COMMISSION Davis reporied that Arlo Nelson and Max Brinton are busy on Regional Planning Commission. M. at City Hall. Present & Presiding Mayor Henry Shirley. Council Present Barton Jensen, Richard Davis, Albert Pieper, Ruth Smith, Warren Porter, and Glenn Peterson. Others present were City Attorney Mary Smith, City Clerk Beulah Johnson, and reporter David Bly, and D. Le Roy Armstrong from the water & sewer Department. Minutes of March 15 were read and corrected. Motioned by Uavis, seconded by Pieper. All Aye. RE: -MARY SMITH REPORTS ON WHITMORE CLAIM Attorney Mary Smith reports that Bill Jones was investigating the Whitmore Claim. RE: CITY ENGINEER D{SCUSSES NEEDED ITEMS FOR THIS YEARS PROJECTS. Clayter Forsgren, City engineer, discussed with the City, showed maps for needed storm drains, sewer, LID projects and other needed items - for this years projects. RE SEWER JET TYPE CLEANER 81DS OPENED Sewer Jet type cleaner bids were opened with men from several companies. Attending the meeting was as follows. Flerible Pipe & Tool $10,866.73 Western Road Mack 9,258.00 John Bean Co. 9,156.00 O'Brien Company 9,795.00 Motioned by Smith, Seconded by Porter that Davis and Armstrong study and evaluate the bids and award it to their choice. RE: ORDINANCE 526 City Attorney read Ordinance 526 THE ORDINANCE N0. 526 A motion was made by Barton Jensen, seconded by Richard Davis to suspend the rules and have said Ordinance placed upon its final I,zssage. The Mayor ordered the roll call of the Council called, and the roll being called by the City Clerk for the suspension of the rules ~~~ was as follows: Those voting "AYE" Barton Jensen Richard Davis Albert Pieper Ruth Smith Warren Porter Glenn Peterson The roll being called and all Councilmen present voting "AYE" carried. The Mayor then called for the voting for final passage of the Ordinance, the motion was made by Barton Jensen seconded by Richard Davis. E: ROGER MC PHETERS ASKS FOR ENFORCEMENT OF CITY'S DOG ORDINANCE Roger Mc Pheters appeared to the meeting to compain about the lack of Police action when he was recently biten by a dog owned by Roger Fergerson. Also he ask for enforcement of the City's dog Ordinance and displayed a color photo of his injury. E: SUPERINTENDENT CATMULL PRESENTS PLANS FOR SCHOOL AND DISCUSSED IRRIGATION DEVIRSION George Catmull, superintendent of Schools District 321, met with the Council and expressed his appreciation of the Mayors and Council. He .presented plans for the new school anal discussed the irrigation devirsion for the plans on the new school. This was discussed and tabled unti I new r~~eeting. _. ORDINANCE 527 Councilman Davis questioned the deletion of the appendix to the code adopting the following Ordinance which called for certain safety standards, but some seemed impractical of the City. They agreed upon passage and to make amendments later as need arose. y, ~~~ ~~, City Attorney read Ordinance 527. THE ORDINANCE # 527 AN ORDIi`dANCE REPEALING SECTION 7 OF ORDNANCE N0. 358 AND ALL AMENDMENTS TO SAID SECTION 7, AND REPEALING SECTION 2 OF ORDINANCE N0. 473 OF THE CITY OF REXBURG, IDAHO, AND ADOPTING VOLUME I OF THE UNIFIED BUILDING CODE, 1970 EDITION, WITH CERTAIN AMENDMENTS, FOR THE CITY OF REXBURG, IDAHO; SETTING FORTH SAID AMENDMENTS TO SAID CODE; FIXING BUILDING PERMIT FEES FOR PERMITS ISSUED PURSUANT TO SAID CODE; REPEALING ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT .HEREWITH; PROVIDING WHEN THE ORDINANCE SHALL BECOME EFFECTIVE. RF~ AUDIT REPORT PRESENTED Merrill Rudd presented the audit report and reviewed it with the Council Motioned by Jensen, seconded by Smith that it is to be accepted. All Aye. RE MERRILL RUDD SUBMITS BUILDING PERMIT AND A PETITION Merrill Rudd submitted a building permit for his house with a petition as follows, and papers signed by Jack Randall, the owner of property stating that he wouldn't interfer with the limited communical that Mr. Rudd was asking for. Motioned by Peterson that the building permit be granted and the limited commercial permit be granted and the limited commercial permit be withheld pending adjustment with Randall protective covenants. Seconded by Smith. All Aye. RE: PETITION MERRILL RUDU PROPERTY Vde, the undersigned owners of real property within 300 feet of the lot on the east side of Apache Avenue. and at the corner of Apache Avenue and Second South that is owned by Merrill and J'Lene Rudd, give our permission for. Mrs. Rudd to have a beauty shop in her basement, providing it meets all building and licensing qualifications and that there be no outside lights or signs to indicate a business location. ALL AYE RE: AGREED TO DEDICATE STEINER AVE AND ACCEPT AS STREET It was agreed to dedicate Steiner Ave and accept it as a City Street. Seconded by Porter. TENNIS COURTS DISCUSSED Unanimously carried Tennis Courts for the City was discussed. Brad balling is to investigate school participation, State, and Federal Aid and review it in the future date. PIEPER GRANTED PERMISSION TO PURCHASE STRIPER, MOWER, AND PICKUP Pieper was. granted permission to purchase striper, mower for weeds, and a used pickup for the Street Department. Unanimously carried Ruth Srnith was excused for a Red Iross meeting. `~~L~' ~ RE: R. L. CRAMER PROTESTS CITY .ACTION FOR DEMOLITION OF HIS WIFES PROPERTY R. L._ Cramer appeared to protest City action for demolition on his wifes property at South at South 2nd East. He agreed that he had ,,.., contacted Mary .Smith several years ago about burning, but the Fire Chief 1 felt this would endanger his and other properties in the area. Woolf ` Motioned by Davis that the City table any decision on these bids until May 3, to give the owner time to propose any alternate method of demolition or make a counter proposal. All Aye ~ [~r; CITIZENS GROUP MEETS TO SEE WHAT IS BEING DONE ABOUT THE IRRIGATION WATER Kenneth, Russell, and Jimmie Flamm, Don Parker, Victor Chandler, and Orson Smith met to see what is being done about the irrigation water. Jensen explained the proposals he had been looking into, in order for the school to proceed.
