Erroneous report from March I, 1972 meeting published in Idaho Falls,
Post Register. The story in the Idaho Falls paper claimed that the
council had criticised the police department Beverly. Mayor Henry
Shirley said F'~e facts were extremely distorted and that the article
contained false statements. The resolution, signed by all council
members except Dick Davis, presently out of town, states:
"W1-iEREAS hhere appeared in the Post-Register of March 4 an account of
Rexburg City Council meeting of March I with the lead 'Rexburg police
criticized at city council meeting' and
"WHEREAS such account written by an obviously inexperienced and incompetent
correspondent who attended the meeting is entirely erroneous, both in
lead statements and in details and
"WHEREAS the mayor and city council feel that a grave injustice has been
done by publication of said article both to our police department and
to our council,
"THEREFORE by it resolved that we, the mayor and city council of Rexburg
to hereby affirm that we are pleased with and proud of the performance
of our police department and do offer them a vote of confidence.
"We especially commend our chief or police, Murray D. Ford, and assistant
chief, Blair Siepert, for the superb leadership they have shown and for
their skill in organizing and training of the officers.
"We feel that we have one of the most efficient police departments in
the state of Idaho."

CITY COUNCIL MEETING OF THE CITY OF
REXBURG, IDAHO
Regular City Council Meeting held March 15, 1972, at 7:30 P. M. a1 the
City Hall.
Present and Presiding Mayor Henry Shirley.
Council Present were Barton Jensen,. Richard L. Davis, Ruth Smith, Glenn
Peterson, Albert Pieper, and Warren Porter.
Others present were City Attorney Mary Smith, City Clerk & Treasurer
Beulah Johnson, Reporters David Bly & Steve Atherton.
Minutes were read and corrected, for the March I, 1972 meeting. Motioned
by Jensen, seconded by Davis. Minutes were read for the March 6, 1972
special meeting. Motioned by Jensen, seconded by Peterson that they
carry as corrected. All Aye.
Bills were presented. Motioned by Jensen, seconded by Pieper that same
be paid for $17,431.45.

CLAIM FROM MADISON MEMORIAL HOSPITAL PRESENTED FOR JACK WHITMORE
A claim from the Madison Memorial Hospital was
for payment for Jack Whitmore. The County had
claim, and Whitmore had refused to pay it, as
placed in jail. Porter suggested Attorney May
and talk to Bill Jones about the claim as they
pay it either.

The roll being called and all councilmen present voting "AYE" carried,
the Mayor declared that a majority of all the members of the City Council
had voted for the passage of said Ordinance and that said Ordinance
was duly and regularly passed. Mayor Shirley then declared the motion
carried.

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE OF THE CITY
OF REXBURG, IDAHO, FOR THE FISCAL YEAR 1972, AND APPROPRIATING TO
THE SEVERAL DEPARTMENTS, OFFICES AND FUNDS OF THE SAID CITY GOVERNMENT
FROM THE REVENUE DERIVED FROM TAXES LEVIED FOR SAID YEAR, AND ALL OTHER
SOURCES, SUCH SUMS AS MAY BE NECESSARY OR DEEMED NECESSARY BY THE MAYOR
AfJD CITY COUNCIL TO DEFRAY THE EXPENSES AND LIAQILITIES OF SAID CI-lY
FOR THE FISCAL YEAR 1972.

RE: BIDS FOR 2-TON TRUCKFORSEWER CLEANING EQUIPMENT
Present was Phil Garn representing College Motors and Jay Willmore
representing Erickson Pontiac for opening of bids for 2-ton truck for
sewer cleaning equipment were as follows: College Motors, $4063.70;
Erickson Pontiac-GMC, $5700.00; Tri-County Equiptment, $5531.70;
and Rexburg Motor Co. $5198.00. There was discussion on the
necessity of a cab-over-axle truck or whether a cheaper type would be
sufficient. Bud Armstrong, head of water and sewer department, stated
he needed the cab-over-axle truck for be"t"ter maneuverability to bell
suit the job. Councilwoman Smith asked the minutes from previous meetings
be read to discover when authoriz~:,tion for purchase of new truck was
made. Councilman Jensen motioned to authorize the purchase of -the
new truck. Seconded by Porter. (Nay Pieper, Smith, Peterson) Aye
Porter, Jensen, Davis. Motioned by Jensen seconded by Davis.
RE: WATER ANL7 SEWER COMMITTEE GIVEN AUTHORITY TO AWARD BID
Motion was made that the Water and Sewer Committee be given authority
to award the bid on the bases of those bids received tonight; or if
they decided to recommend a different type of truck, they should get
a coplete new set of bids. Motioned by Jensen, Seconded by Porter
Unanimously Carried
RE: GAS. BID FROM CONTINENTAL OIL COMP~!.NY ACCEPTED
Phillips Petroleum bid $.287 per gallon was presented. "Che ryas bid
from Continental Oil Company for $30,000 gallons of premium gas at
$.2409 per gallon was accepted, being the low bid. Motioned by
Smith, Seconded by Peterson. All Aye.
RE: ZONING ORDINANCES DISCUSSED
Zoning Ordinance which will cone areas of the City missed by previous
zoning Ordinances was discu~~~sed. it was moved by Peterson, and
seconded by Jensen, and unanimously carried, that the City Attorney
make the correction of the proposed supplement to zoning Ordinance No.
478 leaving the hospital property unzoned, and with that correction
the notice of hearing be published as corrected,. setting the hearing
for April 5, 1972
RE: FREE CABLE TV SERVICE GIVEN TO FIRE DEPARTMENT
Mayor Shirley reported that free Cable T.V. service had been given to
the Fire Department, and he publicly thanked them.
'.RE: DALE THURMAN & MR KNUTSEN MEET WITH COUNCIL, LID PROJECTS DISCUSSED
Dale Thurman & Mr. Knutsen of Northside of town was present on sewer
project. Mr. Thurman stating that the state was forcing Thurman for
action on sewer. A letter was requested from the City to state'
inspector Arnell, that LID proceedings were going to be started in
1972 for the area. Davis was in favor of annexing beyond Miliholiow and
include it in LID. Committee was appointed to study it. Clayter
Forsgreen presented maps on LID and future water projects and
improvements in City. Motioned by Davis and seconded by Jen,~en that
forsgren and Perkins proceed with improvements with approval for
securing HUD, State, and EPA funds, subject to revision as project
progresses. Seconded by Jensen. All Aye.

RE: DICUSSION OIV RESTRICTED PARKING OF SUNRISE PROPERTY
Discussion on restricted parking of Sunrise Property east of present
City Hall. Tabled until next meeting.

RE: MAYOR REPORTS RICKS COLLEGE PLANS & ECOLOGY MEETING & PLAN STflEET DANCE.

Mayor reported Ricks College plans and ecology meeting even better
than last year. This year they plan to charge fior the service, charges
of which will go into a fund to the Civic Club for the beautification
of Rexburg. They also plan to have a street dance for the' closing of
Ricks. Everyone invited. It was suggested that ehey obtain permi=>sion
from the residents in the area where the street dance would be held.
RE: PREMISSION REQUESTED FOR GLEN PETERSON & SILAS CLEMENTS TO GO TO BOISE
Glen Peterson requested permission for himself and Silas Clements to
go to Boise to look at fire trucks as it take~.~ a year for delivery.
Star Line would pay expenses while in Boise. Motioned by Pieper
for Peterson to proceed. Seconded by Smith. ALL AYE
RE: DISCUSSION ON NO PARKING ON 2nd EAST AND 4th SOUTH
Discussion on No Parking on 2nd East and 4th South was tabled until
next meeting.
'RE: DAVIS REPORTS THAT THERE WAS A SALE ON GSL POSTAL VANS
Davis reported that there was a sale on GSL Postal Vans. i1e suggF>sted
that one of these vans would be excellent for carrying equipment to
a fire. He suggested Glen Peterson check .into the pruchase of one of
these for our fire Department.

DISCUSSION ON THE CRAMER BUILDING
There was a discussion on the Cramer Building which ~^ras car,demned, It
was suggested that the Ricks College take it on as a Projects and na-t
involve the City. Davis is get~i-ing specs from police, fire, contractors
and notify Cramer, then we will proceed with the dernolishion of all
buildings.
DAVIS REPORTS NELSON & BRINTON ARE BUSY ON REGIONAL PLANNING COMMISSION
Davis reported that Arlo Nelson and Max Brinton are busy on Regional
Planning Commission. The next meeting will be March 29, 1972.

RE: -MARY SMITH REPORTS ON WHITMORE CLAIM
Attorney Mary Smith reports that Bill Jones was investigating the
• Whitmore Claim.
RE: CITY ENGIPJEER DISCUSSES NEEDED ITEMS FOR THIS YEARS PROJECTS.
Clayter Forsgren, City engineer, discussed with the City, showed maps
for needed storm drains, sewer, LID projects and other needed items
_- for this years projects.
RE SEWER JET TYPE CLEANER BIDS OPENED
Sewer Jet type cleaner bids were opened with men from several companies.
Attending the meeting was as follows.

Motioned by Smith, Seconded by Porter that Davis and Armstrong study
