MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Regular City Council meeting held March I, 1972, at 7:30 P. M, at
the City Hall.
Present and presiding Mayor hlenry Shirley.
Council present were Barton Jensen, Richard L. Davis, Ruth Smith,
Glenn Peterson, Albert Pieper, and Warren Porter arrived at
8:00 P. M.
Others present were City Attorney Mary Srnith, City Clerk & Treasurer
Beulah Johnson, Reporters David Bly, Dennis May, and Steve Atterton.
Minutes were read and corrected. Motioned by Jensen, seconded by
Davis that they carry as corrected. All Aye.
E: BILLS PRESENTED
Bills were presented. Motioned by Jensen, seconded by Pieper that
same be paid for $12,511.35.
Unanimously carried
E: ORDINANCE 524
THE ORDINANCE #524
A motion was made by Barton Jensen, seconded by seconded by Albert
Pieper to suspend the rules and have said Ordinance placed upon its
final passage. The Mayor ordered the roll call of the Council called,
and the roll being called by the City Clerk for the suspension of
the rules was as follows:

Glenn Peterson
Albert Pieper
Warren Porter
The roll being called and all councilmen present voting "AYE"
carried. The Mayor then called for the voting for final passage of
the Ordinance, the motion was made by Barton Jensen,, seconded by

The roll being called and all councilmen present voting "AYE:
carried, the Mayor declared that a majority of all the members
of the City Council had voted for the passage of said Ordinance and that
said Ordinance was duly and regularly passed. Mayor Shirley then declared the
motion carried.
ORDINANCE N0. 524
AN ORDINANCE AMENDING AND CHANGING SUB-DIVISION (c) OF SECTION 2, AND
SUB-SECTION (2) SUB-DIVISION (a) OF SECTION 4 OF ORDINANCE N0. 455 OF
THE CITY OF REXBURG, IDAHO AND REPEALING ALL ORDINANCES OR PARTS OF
--~ ORDINANCES IN CONFLICT .THEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
REXBURG, IDAHO:
Passage moved by Glenn Peterson seconded by Barton Jensen. ALL AYE
RE: DEE SELLERS REPRESENTING GOLF COURSE ASKS FOR $1000
Dee Sellers representing the Municipal Golf Course asking for $1000 to
help with the needed equipment to run the Course this year. The Council
agreed to include it in the budget.
RE: KENNY NORRIS ASKS FOR SICK PAY
Kenny Norris from Ambulance Department was present and Glenn Peterson
explained his absence from work. Asking his standing on sick pay.
It was agreed that he should have one week at 100 pay and two weeks at
50~ pay, as the council had adopted previously fior all employees.
RE: REPORT ON APPROXIMATE COST OF IRRIGATION WELL AT PORTER PARK
Davis reported approximate cost of irrigation well at Porter Perk, being
$3,500. Plans to install, if the need was apparent when water usage
warranted such.
RE: MEETINGS OF REGIONAL PLANNING COUNCIL PLANNED $ ARLO NELSON HIRED
Davis explained the meetings of the Regional Planning Council, the
committees to be set up and the progress to be made. He presented an
agreement for the Mayor to sign and the hiring of Arlo Nelson on per
drem basis at $15.00 per hour, to direct and complete the plans. Motioned
by Jensen, seconded by Pieper that Mayor Shirley sign said agreement
with Madison Regional Planning Council and City of Rexburg.
RE ORDINANCE ON ONE WAY ALLEY PARKING DISCUSSED
The Ordinance for one way alley parking was again discussed. Council
decided to make the south alley of Main Street open to one way traffic
only from Center Street East of First East. Effective March 6. This
will be on trial basis until Apri! 5th, giving the Council time to
study and observe the plan on parking and unloading.
RE: DISCUSSION ON ADOPTING 1970 UNIFORM BUILDING CODE
Discussion on adopting 1970 uniform building code, with the exception
of the permit fee schedule which would be replaced by fees suggested
by the Planning Board. The City Attorney was instructed to prepare the
ordinance.
RE: DISCUSSION ON THE POLICE DEPARTMENT AND COLLEGE SECURITY
Discussion on the Police Department and College Security. Mayor Shirley
had an agreement signed with College Security Department Head, Dan Hess,
which he felt c{arified past misunderstandings.

E: DISCUSSION ON THE CHANGE OF CITY IRRIGATION DITCH
Discussion on the change of City Irrigation ditch for new high school
building. No decision at this time. Tabled.

RE: Parking South of City Hall -- Sunrise Properties
Gentlemen:
The Board of Directors of Sunrise Properties, Inc. has decided to
proceed with a plan to develop or dispose of the property just south
of City Hall, the north half of which has been used by City employees
for parking for well over a year now. The Board feels that .the parking
privileges granted City employees have been adequate consideration
for the easement granted at the Northeast corner of the property.
Accordingly, this property will be barricaded as of midnight, Friday,
March 3, 1972, and no further parking .will be permitted. You
should advise your employees accordingly.
