Present and presiding, Mayor Henry Shirley. The foll~lring council members ' were present: Ruth Smith, Albert Pieper, Richard Davis, Bart~an Jensen, Wendell Ritchie. Absent, Glenn Peterson. In the excused absence of $eulah Johnson, City Clerk, The Mayor asked Mary Smith, City Attorney, to take the minutes. RE: LETTER FROM GARY BALL CONCERNING AIRPORT RUNWAY The Mayor read a letter from Gary Ball from the FAA. The letter indicated t the City wanted a 9000 foot runway. The Council was of the opinion they ha indicated that 6100 feet would be sufficient for the ultimate length. The matter was discussed. Moved by Richard Davis, seconded by Albert Pieper and unanimously carried that the Council hold a meeting with the Ilighway Board->,_ .Airport Board, Planning Board and County Commissioners preliminary to aski for a relocation of the proposed highway, which would be affected by the runway length. The Mayor asked Mr, Davis to assume the responsibility of arranging for the meeting. ZE: MINUTES Minutes of the regular meeting of the City Council held August 4,.1971 were read. The minutes were corrected. Moved by Ruth Smith, seconded by Albert Pieper, and unanimously carried that the corrected minutes be approved. tE: BRAD DALLING EXPLAINED THE MOTT FOUNDATION PROGRAM tE . Ruth Smith asked Brad Dolling to explain about the Mott Foundation Program,. the things he had been doing during the summer and what the plans were for winter. He presented an outline of Recreational Activities, which are attach- ed to the minutes. The matter was discussed at great length. The Mayor commented that the Mott Foundation Recreational Program if properly developed could be of great benefit to the community and that the activities this coming year would either prove or disprove its value.. CONCESSION STAND AT THE PARK The matter of Mr, Dolling operating the concession sand at the Park was. discussed. Mr. Dolling stated that if the Council determined he should not operate the stand, he would dispose of it. ,E: SPRAYING TREES AT THE PARIfS Ruth Smith stated that the trees at the parks needed: spraying. She suggested that the City should purchase the necessary spraying equipment. The P~9ayor suggested that she secure bids. from local merchants and discuss it further with the Council. Mrs, Smitli also stated that many trees at Porter Park needed trimming and that she would like to have Mr. Zundell do the work. Moved by Richard Davis seconded by Barton Jensen and unanimously carried that Mrs. Smith hire Mr. Zundell to trim the trees. Mrs.. Smith stated that the Parks Department needed a smaller mower in order to reach small, close areas. Moved by Barton Jensen, seconded by Albert Pieper and unanimously carried that she buy a smaller mower. 1`-1rs. Smith recommended t}iat the City hire someone to run the Merry-go-round and miniture golf course and remove the concession stand. The matter was discussed. ..., , , E: PETITION FOR A KINDERGA}Z'TEN BY Mk. MALSTROM OF 525 MAPLE DR~IVI: ~ ~~ Mr. Malstr~m~o $ }~~.~ ~ p~1e Drive, presented a petition signed by more than 80°; of the property owners within a radius of 300 feet of his property, requesting that Mrs. Malstrom be granted a Limited Commercial Permit to conduct a Kindergarten in her home. He said it would be limited to 20 students and operate betty-en the hours of 9 A.M, to 12 noon. Moved by Barton Jensen, seconded by Albert Pieper and unanimously carried that Mrs. Malstrom be given a Limited Commercial Permit for said kindergarten for a period of two years. BILLS 'The bills were read and after consideration and discussion it was moved by Barton Jensen, seconded by Richard Davis, and unanimously carried that bills i_n the amount of $11,325.89 be approved and paid. USE OF THE GARNER GRAVEL PIT T}ie matter of using the Garner gravel pit for dumping solid, inert material was discussed. Mr. Davis suggested that he thought a sign might be as good ~`~'~ as a fence for the time being. The Mayor stated he would check in to the matter further. F,Wendell 12itchie stated he had contacted County Commissioner Dean Ricks and that he would let the City use the County land fill equipment, and that ..Dan Moulton would use it two or three times a week down at the dump. RE: RALPH PRESTWICH ASK TO BE RELEASED FROM PLANNING BOARD The Mayor reported that Ralph Prestwich had requested he be released from serving on the Planning Board as it was impossible for him to attend the meetings during the summer. The Mayor presented the Name of Leonard Long- hurst to fill the vacancy. Moved by Barton Jensen, seconded by Albert Pieper that the appointment of Leonard Longhurst to the Planning Board be approved. Unanimously .carried. RE '. MAX BRINTON AS BUILDING INSPECTOR AND GAS INSPECTOR The Mayor stated that it had been agreed that Max Brinton would serve as Building and Gas Inspector and perform other duties for a monthly salary of $400.00 and milage; that he had been thinking it over and he just couldn't get by on $400 a month. The Mayor stated the Commissioners said they would pay $150 a month and 10¢ a mile and the City could pay $300 a month and fringe benefits; that more than 2/3 ds of his time would be City work. The Mayor stated Mr. Brinton thought the City should furnish him with a used car. The matter was discussed. Moved by Albert Pieper, seconded by Ruth Smith and unanimously carried, that the City employ Max Brinton for $450 a month. Moved by Albert Pieper, seconded by Wendell Ritchie, and unanimously carried that the Council investigate the feasibility of using the police car and if we can not that they look around for a used car for the use of P~}r. Brinton, all subject to the approval of the Council at a later date. ~ RE: GARBAGE CONTAINERS - CHARGE FOR PICKING THEM UP AND DUMPING -The Mayor reported that Wendell Ritchie had all of the garbage containers distributed and more coming in, and that the Council should arrive at a fair charge for picking them up and dumping; that they had been studying rates and tenatively determined that a charge of $1.OO per 2 yd. or 1 yd, dump . should be made, based on a four week month. ~ RF DOG POUND AT THE LAND FILL The Mayor stated he thought the place fill. The Council members agreed. Rh. PRUBTEMAT THE LAGOONS for the dog pound would be at the land' .. ~. The Mayor said that Bud had a problem at the lagoon; that the College heating plant was washed down with water and the fly `ash goes into the sewer and builds up and provides nutrient for the bacteria and other things to grow; that he had discussed the matter with the College several times and would like Mr. Davis to go with him again and see what can be done. 'The Mayor said another problem - a few years ago when the City built the lagoons the two creameries paid $10.00 a month for sewer charges a.nd that Mr. Armstrong said that what the two creameries dump into the lagoons amounts to almost as heavy a load as the rest of the town - that it takes that much oxygen to consume what they put in there (whey), and that the rates should be adjusted. Mr. Davis said he would check rota it. ., ~, Mr. Davis stated he had been checking into the c~ua"lity k~uck's u:;c:~ oll Its sdtt- ling ponds. `RE: DUMPING NEW GARBAGE CONTAINERS DISCUSSED AGAIN The matter of dumping the new garbage containers was again discussed. A4oved ~ ~ by Wendell Ritchie, seconded by Albert Pieper, that a charge of $1 per 2 yd I~ or lyd be made for each dump, which should be two or three times a week on a sc}iedule set by his committee. ~I2E: REXBURG LUMBER CO. INTERESTED IN LEASING THE OLD DUMP PROPERTY '* The Mayor reported that the Rexburg Lumber Co. was in terested in leasing buying the property across the railroad track which w as the old dump and. f was being used by :Myron Lewis;. that Myron Lewis.was supposed to have it all cleared off this fall; that the Lumber Company wanted to use it in connection with its barking operation. The matter wasdiscussed and the Mayor asked the Finance Committee to check into the matter. KE: WORK NEEDING TO BE DONE ON THE RESERVOIR r { Richard Davis reported that the tap and sides of the reservoir- were spauling and suggested that it could be sprayed with urathane which would cost in the neighborhood of $2,000.00, and also that the area sho uld be fenced, which would cost about $1000.00; that he would like to inve stigate the -natter .f further. Moved by Barton Jensen, seconded by Albert Pieper, and unanimously carried that Mr. Davis be authorized and. directed to proceed with is roves- ; tigation. RE: DEE SELLERS - GOLF ASSOCIATION T'he Mayor reported that Dee Sellers said the Golf Assn. wanted to buy some mowers and would like to have their $1000.00. The matter was discussed. Moved by Rich~.rd Davis, seconded by Wendell Ritchie and unanimously carried that the matter be postponed until the next meeting so it could be checked as to what the City was committed to do. ARE: LAUNDRY ROOM AT THE TWO WESTWOOD APTS. The Mayor reported that a laundry room was being built, joining t}ie two Westwood apartments together and that others in that area wanted to use the facility, and that the Planning Board told him they couldn`t see letting a commercial establishment go in that area. The matter was discussed, and it was finally determined that Mr. Westwood should secure and present a petition. for Limited Commercial. RE: $IDS FOR HEATING THE SHOP Albert Pieper presented bids for heating the shop, which were as follows: Thompson Plumbing - - - - - - - - Holley Plumbing - - (4 units) Briggs Plumbing - - (4 units) $1895.00 (same for both units) $2332.00 ( 3 units $2186.) $2393.00 ( 3 units $2185.))
