MINUTES OF THE REGULAR CITY COUNCIL
MEETTNG OF THE CITY OF REXBURG, IDAHO

daho, was held Wednesday, June 16, 1971, at 7:30, at City hall.
RESENT AND PRESIDING: Mayor Henry Shirley

lso present: City Attorney Mary Smith, City Clerk, Beulah Johnson, David Bly
epresenting Rexburg Standard and Jourlan, and Don Ellis from KRXK Radio.
INUTES
Minutes of June 2, 1971 were read, corrected, motioned by Glenn Peterson,
seconded by Wendell Ritchie that they be passed. Motion carried.
ARE: NEW SANITARY LAND FILL
Mayor Shirley told of the meeting with the County Commissioners on the new
sanitary land fill, stating that the old Garner gravel pit in the north east
section of town is the site selected. This will be operated jointly by the
county and city, in accordance with state regulations and recommendations. A
state engineer sent by the state Department of Health previously approved and
recommended the site. Use of the landfill will be in 15 or 20 days with the
refuse being packed and covered daily. No burning will be allowed, and the
disposal of trees, tires and auto bodies will not be allowed. A special pit
will be provided for the disposal of animal carcasses. He also stated that the
unty had two other sites for solid waste, one at Archer and one at Plano.
iNT JOLLL'Y - ASKING TO HAVE ITEM 110 IN L ID 18 SEGREGATED INTO 'T'WO PIECES
Kent Jolley met with the council, asking to have Item #110 in LID #18 segregated
into two pieces, as Remco is buying 145 feet to build The Villager, a student
housing complex. Motioned by Barton Jensen, seconded by Glenn Peterson that
the City Clerk be instructed to do so.

LACK OF WATER PRESSURE IN POWELL ADDITION
Edward Malstrom, Robert Schwartz, Vance Hendricks and Don Ellis from the Powell
Addition, met with the council and reported on the conditions of water pressure
in their area. They stated that it was always low and sometimes non-existent,
that the peak periods in afternoon was expecially bad. Mayor Shirley instruc-
d Councilman Dick Davis to take the necessary steps and see if the problem
uldn't be solved, by a booster pump and having the town using alternate days
r watering to alleviate the problem all over town.
JUN RAY - WHOOPEE DAYS CELEBRATION
Jon Ray, chairman of the Whoopee Days celebration for July 2nd and 3rd reques-
ted approval from the council for a parade route and for the re-routing of
traffic through the city. Mayor Shirley stated that he would check with the
State and condirm the route, and secure a route for highway re-routing. Also
a request was made for the swimming pool and the merry-go-round to be open free
to the public from 1:00 to 3:30 P.M. The council approved his plans and
commended him for his efforts in planning the celebration.

given the task of taking care of this problem.

was given the plans to review, get extimates and finalize the costs, contract
with Dr. Stegelmier, on whose property the pound will be built and proceed
after the next meeting.

Permission for Explorer Post 48 to sell fireworks from

Dear Ms. Smith:
This will acknowledge. receipt of your letter of June 4, 1971.
in which you requested that this office render an opinion regarding
the proper construction to be given Section 50-lull, Idaho Code, as it p
provides: "In addition to the minimum requirements as~ie e n provided,
all cities with ten thousand five hundred (10,500) population or less
shall publish a list of warrants issued and such other financial data
as may, by ordinance, Hie.provided."
Specifically, you wished to know whether the statute would
include the listing of checks as well as warrants within its purview.
The statute is silent with regard to checks, and it. is certain that
checks and warrants are not orre and the same.
Thus it is the opinion of this author that the statute commands the
publication of a list of warrants issued if there are any from which a list
can be made. Therefore unless the City of Rexburg has an ordinance which
requires the publication of a list of checks drawn, nothing in the statute
would require the publication of them.

Motioned by Richard Davis, Seconded by Glenn Peterson that Edna Villella be
allowed $15.00 a day for expenses at the meter school she is going to attend
in Los Angeles, Calif. next week.

The Police Chief met with the council, explained L~!AA l~rogr~m, which is to
increase police force and covexage for the City. This is to be funded by
state, government, and local monies over a three year period. Motioned by
Barton Jensen, seconded by Ruth Smith that we apply. Also Chief Ford dis-
cussed the pay scale of the police department, explaining the problems he `
was having with training and keeping trained personal, asking for considera-
tion in giving him something concrete to offer the men as to wages and
increases periodicly. Also he ask for a wage increase for the Office girl
in the Police Department. Motioned by Albert Pieper that a salary of $300.00
per month be established. Seconded by Glenn Peterson.
The motion carried.

INDEXING THE MINUTE BOOKS.
Discussion on indexing the minute books. Gaylen Fuller from Ricks College,
had suggested th~.t we hire Ruby Woodward to help set up the proper indexing
and Summary indexing to get it started properly, he stated that she had
passed a course in library science and was a fast experienced worker.
Motioned by Albert Pieper, seconded by Ruth Smith that her services be
secured on part time basis, and that the pay be $2.25 per hour as s}ie
requested. They felt that this was a very important item in the city function

MAYOR SHIRLEY TO AIC CONVENTION
Mayor Shirley announced that he was going to the AIC Convention in Burley,
asking Wendell Ritchie to attend with him. Stating that he would leave
Thursday afternoon.
RE PRESENT STREET PROJECT
Discussion on present street project, Albert ask if they could asphalt other
streets than ones included in bid project. Mayor Shirley instructed him to
talk to the contractors, to see the cost of continuing asphalting on newly
curbed streets.
ARE: ELMO MOCK ON LEAVE
Wendell Ritchie informed the City Clerk., that Elmo Mock was on leave at the
present time. He would keep her informed as to his progress.

Bills in-the amount of $19,307.74 were motioned by Barton ,Jensen to pay.

Motioned by Glenn Peterson, seconded by Ruth Smith that Chief 1~Iurray For
order the necessary ec{uipment for the new police car, from Star-line Equ'
ment. Motion Carried.
RE • DR. E}tYING TO BF. AT JULY 7, 1971 .MEETING
Mayor Shirley announced that Dr. Hess will introduce Dr. Erying, new
Ricks Colleg President, at the July 7, 1971 Council meeting.

MEETING OF THE CITY OF REXBURG, IDAHO
Regular meeting of the City Council of the City of Rexburg, Madison, County,
Idaho, was held Wednesday,July 7, 1971 at 7:30, at City Hall.
PRESENT AND PRESIDING: Mayor Henry Shirley
COUNCIL T~IEMBERS PRESENT: Barton Jensen, Wendell Ritchie, Albert Pieper, Richard)
Davis, Ruth Smith. Absent and excused was Glenn Peterson.
RE: DR. HENRY B. EYRING INTRODUCED (.New Ricks College President)
Dr. Hess from Ricks College introduced the New President, Dr. Henry B. Iiyrins;,
who in turn expressed his hope, feelings, and gratitude for ;~exbu;~g and }ticks
College together-ness and his being a part of our continued growth. Dr. I}ess
reported on the growth of Ricks, past, present, and projected.
MIKE MULCADY, student body president from Ricks College also was present and
he in turn expressed the agreement and support of the student body to work
together with all willingness, to be part of the town and school.
Councilwoman Ruth Smith, presented Dr. Dyring with a key to the City, with the
council and Mayor all expressing its welcome and willingness to work with the
school in any way.
RE: ALLEN WINTERS RETIRES
Allen "Shorty" Winters was presented a key to the city from Councilman
Albert Pieper. "I'd rather give than receive.", was }lis reply to the tribu
paid by the Mayor-and council, }}e retired July 1st, after 25 (twenty five)
years on the street department. Jensen personally expressed his appreciati
for all the late nights, Sundays, and Holidays and early emergency risings
that Shorty had put in.
RE: CITY DITCH ON THE SCHOOL PROPERTY
George Catmull and Clayter Forsgren met with the Council to discuss the
problem arising from the City ditch on the school. property, stating that the
Architect, Sunberg had informed him earlier and ask him to meet with the
Council. Albert Pieper motioned that the problem be studied for the best
possible solution, and that they would do waht was necessary to alleviate the
problem for the school. Seconded by Richard Davis. `The motion carried. Mayor
Shirley told Barton Jensen that he was to head the committee and take care of
this.
