RE: R1OTT FOUNDATION PROGRARI EXPLAINED
Councilwoman Ruth Smith, explained tl~e Mott Foundation program. St.at ink;
that the school board had endorsed the program, that Federal funds wore
available for three. years. The Cities participation would be sending Brad
Dalling for the training that is necessary for the operation in running
this recreation facilitie, and being responsible for ascertaining the
federal grants connected with the Mott Foundation. It was motioned by -1
Barton Jensen that the city participate, seconded by Ruth Smith.

;E: SPIZiNKLER SYSTEM FOR SMITEI PARK
The sprinkler system was discussed for Smith Park ball diamonds. After
discussing the cost, it was decided that the budget wouldn't permit this
in 1971.
,E; CONCESSION STANll IN PARK
Ruth Smith ask about the PTA having a concession stand in the park for the
summer months. Permission was given for one year only.
RE: AIC ANNUAL CONVENTION
The 24th AIC Annual Convention was discussed. The Mayor encouraged all to
attend all or parts. The convention is to be held in Burley at the Ponderosa
June 17-19.
RE: LIGHTING IN SMITH PARK
Barton Jensen presented plans for lighting the east diamond in Smith Park,
which will be given further consideration when the bids are. received.
KE: J.L.CLARK DAY EXPENSES
It was motioned by Glenn Peterson, seconded by Ruth Smith that the City pay
$110.00 for their share of the expenses for J.L. Clark day
RE; BILLS
Bills in the amount of $18,484.80 were read. It w<is motioned. by Barton Jensen,
that they be paid, seconded by Glen Peterson.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF TI-IE CITY OF REXBURG, IDAIiO
Regular meeting of the City Council of the City of Rexburg, Madison, County,
Idaho, was held Wednesday, May 19, 1971, at 7:30 P.M. at the City hall.
Present and presiding; Mayor Henry Shirley.
The following Council members were present: Barton Jensen, Richard Davis,
Albert Pieper, Ruth Smith, Wendell Ritchie and Glen Peterson. Also present

IRE: BIDS FOR TRUCK FOR GARBAGE PACKER
After checking and considering the bids previously receeved and opened for
a truck for garbage packer, Wendell Ritchie reported that the 'I"ri-c:ounty
bid in the amount of $7250.00 was the lowest and best bid receeved, and
recommended its acceptance by the city with an additional $75.00 for frame
reinforcement. Moved by Barton Jensen, seconded by Ruth Smith and unanimously
carried that the Tri-County bid be accepted as recommended by Wendell Ritchie..
IRI: GARBAGE CONTAINERS
The matter of garbage containers was discussed. The Mayor suggested that a
survey be made to determine how many were needed.

Albert Pieper opened street paint bids which were as follows:
Ards Glass i:, Paint $3.74 a gal for white; $3.99 for yellow
Anderson Paint 4.16 ' white; $4.30 yellow
Flamms 4.29 ' white; $4.49 ' yellow
Moved by Wendell Ritchie, seconded by Albert Pieper, and unanimously .carried
that Ard's bid be accaepted.
DITCH WATER
The Mayor asked Councilman Jensen to read a letter he had received from
Clarence G. (Bernie) Jensen, regarding the covering of the ditch in back of
his residence, and also presented a petition signed by 1000 of the property
owners between lst and 2nd South, requesting that the ditch be eliminated.
The matter was discussed and it was pointed out that the ditch was a nec-
essary spring run-off and storm drain. Moved by Dick Davis, seconded by
Barton Jensen and unanimously carried that Mr. Jensen be given permission
to cover the ditch as it goes through his property with snow fence or
similar cover, providing Mr. Jensen assumes all responsibility and liability.
RE: ORDINANCE 518
'i'he Mayor reported that it was the date and time to consider the rezoning
of the North half of Block 48 and the No. 5 rods of Lot 4, Block 48. Iie
asked if there were any protests or opposition to the re-zoning. No one
appeared in opposition thereto.
AN ORDINANCE AMENDING AND CHANGING THE ZONING P~IAP OF THE CITY OF REXBURG,
IDAHO, TO PROVIDE THAT CERTAIN PROPERTY IN BLOCK 48 OF THE CITY OF REXBURG,
MADISON COUNTY, STATE OF IDAHO, HEREIN~FTRR DESCRIBED, BE ZONED COMMERCIAL.
A motion was made by Barton Jensen, seconded by Ruth Smith to suspend the
rules and have said Ordinance placed upon its final passage. The Mayor
ordered the roll call of the Council called, and the roll being called by
the City Clerk for the suspension of the rules was as follows;

The roll being called and all Councilmen present voting AYE carried. The
Mayor then called for the voting for final passage of the Ordinance, the
motion was made by Glen Peterson, seconded by Barton Jensen The Mayor
ordered the roll call of the council called, and the roll being called by
the City Clerk for the final passage of the Ordinance was as follows:

RE: SEWER LINE NEED ON WEST FIRST NORTH
Bud Armstrong reported that a garage was being constructed on tlie.5 r~ortli
side, in the 200 block of West First North, and that a sewer line was i>ad7~A
needed.. The matter was discussed at length and the Mayor asked Mr. Armstrong
to see what he could work out with the people on the North side of the block
to put in their own sewer.
The matter of numbering Sunset Drive in the Taylor Addition was discussed
with f~1r. Armstrong..` Councilman Davis suggested that the street could be
designated last and West Sunset.
G : QUAL I'1'Y PAC - SEWER PROBLEMS
Wendell Ritchie reported that the Quality Pac had been having some trouble
with a plugged sewer line. Mr. Armstrong said he had suggested to them tha
they build another catch basis as a secondary treatment pond so that the
muddy water could get a chance to settle. Mr. Armstrong said he would see.
if something could be worked out this summer while the use was not so
great.
The matter of the watering of and caring for the trees and flowers on
Main Street was discussed.
The matter of .the school intersection at Main and First West was discussed.
Also the matter of speed limits on First North was discussed.
The Mayor reported that the Planning Board met on May 12, 1971, and had
given him a copy of their minutes. which he read.
The Mayor further reported that a representative of the Surveying and
Rating Bureau had been in Rexburg and told him that the City should start
thinking of ways to increase pumping capacity, that is, the purchase of
another fire truck. It was the opinion of the Council that the City should
have credit for the County Fire Truck. The Mayor said he caould check into
it.
DOOR IN THE OLD CITY HALL BUILDING
Glenn Peterson reported that he was going to get estimates on the cost of
putting a door in the back of the old City Hall building; that by putting
a door there the ambulance could be moved over and there would be space for
another fire truck.
TRANS AMERICA INSURANCE
The Mayor reported he had a request from Trans America Insurance, requiring
that certain things be done. The matter was discussed. Moved by Albert
Pieper, seconded by Richard Davis, and unanimously carried that the Fire
Chief follow up on the requirements and see that they were met.
DON ELLIS - CABLE TV
Don Ellis reported that the property on the hill was not of sufficient size
to meet his cable TV requirements and he would therefore be unable to use it.
He thanked the City for its consideration.
FLOOR IN THE SHELTER IN SMITH PARK
Councilman Davis reported that the Kiwanis Club was going to put a floor
in the shelter in the Smith Park. The matter of putting a colored cement
(green) or painting it after it was poured was discussed. Moved by Barton
Jensen, seconded by Glen Peterson and unanimously carried that it be poured
without color.
RESOLUTION - CONSTRUCTION OF `1'1lE TETON DAM
Mary Smith presented a resolution for the-consideration of the Council, re-
questing the early funding and construction of the Teton Dam.
RESOLUTION
WHEREAS, the Congress of the United States has passed legislation auth-
prizing the construction of a dam on the Lower 1'e ton River; and
WHEREAS, the construction of the Lower Teton Dam would be beneficial. to
the citizens of this community and the surrounding area;

Regular meeting of the City Council of the City of Rexburg, Aladison, County
Idaho, was held Wednesday, June 2, 1971, at 7:30 at City Hall.
Present and presiding: Mayor Henry Shirley.

at 8:30. Also present City attorney Mary Smith, Beulah Johnson, City Clerk

BIDS FOR 1971 CITY_PROJECT
Bids for the 1971 City project was submitted by Clayter Forsgren for
Kennady Paving. 'The amount being $85,790.50. After discussion on the all
over project, it was motioned by Glenn Peterson, seconded by Barton Jensen
that it be awarded, contingent upon the City Engineers study and approval.

RE: 6 INCH water LINES - NEED FOR CITY 'I'0 GO 'I'0 THE 8 INCH WATER LINES
Clayter Forsgren explained the installing of 6 inch water lines in the var-
ious areas in the city-and stated the need for the city to go to the 8 inch
water lines for the furture growth of the new developments. Also that this
is the policy set forth in the Sub-division Ordinance. It was agreed to
follow this policy and that the engineer was to keep the Council informed
as these areas developed.
'E: MAYOR SHIRLEY - CONTRACTOR AND ENGINEERS FAILURE TO COMPLETE JOB IN CITY
Mayor Shirley talked to the Kennaday Paving representative and Clayter
Forsgren on the last project done in the city. I-Ie stated that several things
that had been brought to his attention of The Contractor and engineer
neglecting to full fill their obligations to the people, where the work was
being done. They assured him that they would try to satisfy everyone as
they appreciated the work and would like to continue working with the city.
~~RI DISCUSSION ON THE PROBLEMS OF ALL UNDERGROUND LINES
A1r. Byrne and Mr. Martindale representing Mountain Bell Company of Idaho
Falls, explained the policy of excavating that was used in Idaho balls.
After discussion on the problems of all underground lines and damage to
them, the Mayor as+Mary Smith, City attorney, to study the Ordinance used
in Idaho Falls, and report back the possibility of adopting the same permit
and Ordinance.
