RE: REPORT ON PROBLEM AT THE CITY DUMP Wendell Ritchie reported that persons had been dumping refuse near and on the road at the city dump, and the practice cost the city considerable money and effort to-take care of. The county land fill was discussed for the coming year. R OVERTIME PAY FOR STREET DEPT. Albert Pieper discussed the street department and their overtime pay. He will ;~ meet with the crew and make some disposition. g ~1BILLS .'Bills from each department were read in the amount of $44,192.59. Motioned y Dick Davis, seconded by Ruth Smith, unanimously carried that same be paid. ARE: BLEACHERS FOR THE PARKS It was motioned by Ruth Smith that two new bleachers be purchased for the parks next year. Seconded by Richard L. Davis.. Unanimously carried. RE: PURCHASE OF BURROUGH5 CALCULATOR It was motioned b~r.~Ruth Smith and Seconded, by Glenn Peterson that the City Clerk be allowed to purchase the Burroughs Calculator. Unanimously carried. Mayor City Clerk MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF REXBURG, IDAHO Regular meeting of the City Council of the City of Rexburg, Madison County, Idaho was held January 20, 1971, at 7:30 P.M. at the City Hall. Present and presiding; Mayor Henry Shirley Council members present; Albert Pieper, Ruth Smith, Glenn Peterson, Wendell Ritchie, Richard L. Davis, Barton Jensen. Also present; City Attorney, Mary Smith, City Clerk and Treasurer, Beulah Johnson. r• MINUTES The minutes of January ~, 1971 were .read, corrected, moved by Glenn Peterson seconded by Richard Davis, that same be passed,unanimously carried. CO. COMMISSIONERS, KENT JOLLEY, GARY BALL - AIRPORT-SALARY, MAGISTRATE CLERK ounty Commissioners, Dean Ricks, Lea Smith, Morgan Garner met with the ouncil also Gary Ball representing the Airport Board and Kent Jolley, ounty Attorney. County Commissioner, Dean Ricks ask that the City pay the salary for the new Clerk, which would serve the Magistrate court. After some discussion it was decided to review the situation at a later date, after the new Court feform has been in operation. LETTER FROM J. KENT JOLLEY The following letter was sent to Gary Ball, Mayor and Rexburg City Council, Madison County Commissioners. r i~ 2 r, Gentlemen: I am enclosing herewith a photocopy of a letter which I recently r`e- ceived from Mr. Ray W, Rigby, of the firm of Rigby f, Thatcher, who is repres- enting the above referenced individuals conserving the cleax zone question. which has been dicussed by all of you in the past with these genelemen, Mr. ~' Rigby is proposing, in behalf of his clients, that we have qualified appraisers; make a determination as to whether or not Dr. Rigby and Dr. Morrell have suff-' ered any damages as a result of the airport zoning which was recently accomplished and the use of the air space above the property in question by airplanes which land and take off at the Rexburg-Madison .County Airport. I would suggest that you study their proposal carefully and then have a joint meeting and determine whether or not you desire to follow the approach whit they recommended. Davis Baxton Jensen Dean Ricks Leo Smith Morgan Garner done RE: DISCUSSION ON ZONING PROPERTY FROM 1st North to 3rd North Dear Kent: In behalf of Dr. Rigby and Dr. Morrell I propose that the question of damages, if any, to their property, as a result of the proposed clear zone be determined by appraisers, one selected by Dr. Rigby and Dr. Morrell, and one selected by the City and County. If those two can't arrive. at a decision, they shall appoint a third appraiser, and the three appraisers would then make a determination of the damages to the two doctors, if any, to their property,. with all parti,,e~, agreeing to be bound by the determination of tha arbitration board. Surely this is a fair way to approach it. The doctors. would appoint Gene EJ,Kelley. Please let me know as soon as possible. Gary Ball rieported that the F. A. A. would accept the Clear Zone ordi a passed by the City and County with a stipulation that if ever proven ~nc stitutional, we will: 1. Bring zoning into compliance. 2. Condemnr ~~ preceedings 3. Arbitration. Kent Jolley said he would prepare a letter to the F. F. A. stating, _ opinion the Airport. Zoning was constitutional. Christopherson, owner of KRXK property at 2:30 P.M., January 21, 1971 at City Mall, with Building Inspec~ tor, Tom Mathews, DeWayne Wilding, planning Board, Barton Jensen and Larry Perkins. - RE: DISCUSSEll NEED OF A NEW STREET SWEEPER Albert Pieper discussed the need of a new street sweeper, stating that the old one would need extensive repairs. He would like permission to secure information on purchasing a new one. Mayor Shirley agreed it whould be looked into. Dick Davis motioned we adjourn at 11:30, seconded by Wendell Ritchie. RE : PURC[IASIi OF NEW STREET SWEEPER Albert Pieper reported the City needs to replace the street sweeper. 1Ir 13c representing the Starline Equipment explained a new sweeper, how it operates and a plan to purchase same. No action was taken on the sweeper; thc> Council. decided to wait until the budget was further along.
