Williams from Standard F~ Journal MINUTES.: Minutes of October 7, 1970 were read, corrected, motioned by Glenn Peterson °F seconded by Barton Jensen that the minutes stand as corrected. ~ RE: BROKEN BRIDGE ON W, 1st N Mayor Shirley told of the bridge that is broken on W. 1st N. It was decided to have it repaired temporarily until after the sewer line is in- stalled. ARE: HARVEY TAYLOR DAY The Mayor told of ~iarvey Taylor and the help he had given in the growth of Ricks College and that he wanted to declare October 27,"Harvey Taylor Day", it was motioned by Barton Jensen, seconded by Albert Pieper that Oct. 27, be named "Harvey Taylor I`ay". Those voting Aye Richard Davis. Barton Jensen Albert Pidper Wendell Ritchie Glenn Peterson Ruth Smith Those voting Nay None IRE: LETTER FROM GEORGE PATTERSON CONCERNING ADJUSTMENT ON LID # 19 IRE: A letter was read from George Patterson concerning an adjustment on his property on 5th West which is in LID #19. pick Davis and Albert Pieper are to investigate. SUMP INSTALLATION AT TWIN PINES MANOR Discussion on Twin Pines T.ianor and installation of a sump which was needed due to the development of this area; they will put in the curb and gutter and the City will see to the installing of the sump. .Albert Pieper is to follow thru with Clayter FQrsgren to see that it is done. NEW BRIDGE ON WEST 3rd NORTH Ilarvey Walters is to oversee and build a new bridge on West 3rd North, using his men and the City will pay for it. RE DF..CISION ON NEW CITY PARK It was motioned by Barton Jansen, seconded by Ruth Smith that the decision on the new City Park be delayed for further study. Those voting Aye F . The motion was made by Councilman Ruth Smith and seconded by Councilman Glenn Peterson, that the rule requiring ordinances of a general and perma- nent nature to be fully and distinctly read on t}iree different days be dispensed with and that said Ordinance numbered 510 be read in full and at length and placed upon it final passage. i Thereupon, the Clerk was ordered to call the roll on said motion and the roll call upon said motion was as follower Those voting Aye: Albert Pieper Ruth Smith Barton Jensen Glenn Peterson Wendell Ritchie Richard Davis Those voting Nay: None The Mayor thereupon declared that the motion, having been passed by not less than three-fourths of the Council, had been duly carried.. Ordinance No. 510 was then read by the Clerk in full and at length. Councilman Albert Pieper moved the adoption of said ordinance, whic}1 motio was seconded by Councilman Glenn Peterson. The Clerk was then instructed to call the roll on the passage of the ordinance and the roll call on said passage of Ordinance No. 510 resulted as follows: Those voting Aye: Albert Pieper Ruth Smith Wendell Ritchie Glenn Peterson Barton .Jensen Richard Davis Those voting Nay: None The ordinance was thereupon, by the Mayor, declared to have been duly passed,. and the Clerk of the City was directed to publish said Ordinance No. 510 in full immediately in at least one issue of the Rexburg Standard- Journal, a newspaper published in the City of Rexburg, Madison County, Idaho. ItE: PARKING METERS DISCUSSED Barton Jensen brought up not straight some taller it would be checked and the matter of the parking meters, that some were th.a~~ others, it was discussed and the Mayor said corrected. RE: J.D. D. ~iancock, Mary Smit ~ Attorney. The Council FIXING THE DAM AND REPAIRING $ CLEANING THE DITCHES. Barton Jensen reported that they are working on fixing the dam and repair ing and cleaning the ditches. BILLS Bills in the amount of $.11,932.71 . were read. None : RE: SIDEWALKS ON COLLEGE AVE. AT BUD ARMSTRONGS PROPERTY Dick Davis reported that he investigated the sidewalks on College Ave. at Bud Armstrongs Wroperty and felt that he should try them for one winter to see if any damage occurs. RE REPORT FROM POLICE CHIEF, MURRAY FORD ,~~ Department Bead, Police Chief, Murray T'ord reported on the progress the ' '; Police Department has made in the last ten months. The Mayor commended and complimented him on their progress. ? RE: RESOLUTION The following resolution was read: Whereas, the city has just completed an extensive improvement program which includes a new storm se~-er, new water mains, new curb and gutter, new side- walks, and Whereas, the City Council intends that this be a new beginning on a cont- inuing program for beautification of the city and for orderly growth, and Whereas there has existed for several years a permissiveness on the part of the city toward the parking of vehicles on sidewalks and on city "Right of Way" anc~,, t ~_ se of sidewalks to display merchandise for sale, and, said act~~~~;, i tion of city ordinances,- Whereas ~.t is now e be a most appropriate time to bring an end to `a ions whic have been allowed to persist heretofore, and, these viol t Whereas the city now affirms that sidewalks are for people to walk on and that the city Right of Way between sidewalk and curb is for beautification, and safety, and therefore, Be It Resolved that our police department be instructed to enforce our ordinances pertaining to parking on the sidewalk or in driveways, or the use of sidewalks for displaying merchandise for sale, and the parking of vehicles or placing ,signs ox any other objects on the "Right of Way" between sidewalk and curb. The 1950 Pickup was sold for $10.00 The 1953 Truck was sold. for $75.00 BUILDING REPORT: Building permits with corresponding building value of $27,101.0 and $48.00 permit fed charged for the month. r~E : RE SOLUT . ; ~~:~ Councilman Glenn Pe~rsan i:ntraduced and' moved ttie adoption of the following °]iI~~RL'AS,, on the 17th day of June, 1970, the City Council of the City of Rexburg, Idaho, adopted and the Mayor of said City approved Ordinance No. 508 of said City, creating Local Improvement District No. 1J for the Wurnose of improving and constructing certain streets and alleys, construc- ting a.nd insta l.irg sanztar'y sewer laterals, constructing and reconstructing curbs, gutters and sidewalks, and constructing drainage works incidental to said improvements within said district, and WHEREAS, the City proposes to issue Local Improvement District Bonds to pay the cost of such improvements, and, WHEREAS, it is considered necessary and advisable that provision be made. for the issuance of interim warrants of the City Wending the receipt of the proceeds of the bonds so to be authorized; ~cJ THEREFORE, BE IT RESOLVED by the Mayer and City Council of the ~'~~~ of Rexburg, Idaho,. that for the- purpose ~~ tne~tn~ the co5t.s ~~1€} `' `r't''i `'s of construct~,ng said imnro~rements in Loo~l Tmnrovement }~.~tN~f~?t ~,,dc~. li?, the City shall issue its interim warrants drawn against said J-o cal }mr~rc~ve~- ment District No. 19 funds upon estimates submitted by the city }:ngneer approved by the City Council, such warrants to bear interest at the rate of six ner centum (60) per annum, to be registered and to be retixed from the proceeds of bonds to be issued for said District, such warrants to be in substantially the following form: R};X BURG, IDAl1O INTERIM_WARRANT The Treasurer of the City of Rexburg, Idaho, will pay to First Secur Bank of Idaho, N.
