BIDS FOR NEW TRUCK
Albert Pieper reported that he had opened the hi.ds for xh® now tt~u~~i4 which '
the flusher will be mounted on, the bid was awarded to Foxd Motor for $5013.00
It was moved by Albert Pieper, seconded by Richard Davis. The motion carried.',
DISCUSSION ON GARBAGE REMOVAL ~ CHARGES
There was a discussion on the garbage removal and the charges, the Mayor
stated that this would be looked into in the near future.

MINUTES OF THE REGULAR CITY COUNCIL
MEETING OF THE CITY OF REXBURG, IDAHO
Regular meeting of the City Council of the City of Rexburg, Madison
Idaho, was held Wednesday, September 16th, 1970, at the City Hall.

Mary Smith to take the minutes.

JESSE NEIDERER - PLANS FOR A MEDICAL BUILDING FOR DRS. MABEY
Jesse Neiderer presented plans to build a medical building for the use of Drs.
Mabey to be located on the corner of Main Street and Ash. The matter was
discussed and the council advised Mr. Neiderer to present the matter to the
Planning Board and that it would also be necessary for him to have the area
re-zoned.
FRANK JENKINS - PLANS TO BUILD EXTENSION AT 256 WEST 4th SOUTH
Frank Jenkins presented a plan to build an extension on the front of his
house located at 256 West 4th South using the extension as a commercial build-
ing for his carpet business, with an access road to the back and a parking
area on the west. Mr. Jenkins reported that he had attempted. to present his
plan to the Planning Board but was unable to do so as they only had two
members at their meeting. The matter was discussed and Mr. Jenkins was re-
guested to present his plans to the building inspector. ~

BOB RITCHINS, MANAGER OF CEDARS APARTMENTS DISCUSSED FENCING

The Mayor reported that Bob Ritchins, the Manager of the Cedars Apartment
buildings had discussed with him the requirement for a fence around the proj-
ect. The matter of a type of fence to be required was discussed by the
council and it was recommended that Mr. Ritchins contact the neighbors in the
area and determine from them the type of a fence that would best serve the
needs of the adjoining property owners.
~RE: GATE AT ENTRANCE TO PRINCETON COURT

Richard Davis brought to the attention o~ the council that the street pro-
viding an entrance to the Princeton Court apartment complex was a dead-end
street; that his apartments and the Kingsweod apartments in the area were
occupied by students; that he and the manager of the Kingswood apartments
had discussed the advisability of placing a gate at the entrance to the
apartment house complex on First South, such gate to be closed at certain
determined hours. The matter was discussed, moved by Barton Jensen
seconded by Wendell Ritchie and unanimously carried that the apartment
owners in the Princeton Court area be permitted to place a chain across the
access street to that area, closing the same during certain periods of
time at night.
Richard Davis also presented to the council the problem of garbage pick up
in that area and .that he felt inasmuch as the apartment owners were paying
a commercial rate'on water, sewer and garbage which amounted to more than
some downtown businesses were paying and that the downtown businesses were
receiving daily garbage pickup, that the Princeton Court area should be en-
titled to daily garbage pickup. The matter was discussed. Mr. Davis was
.asked to take the matter up with the garbage collectors and try to work out
a plan for garbage collection every other day.
ART PORTER - STUDENT HOUSING - Rl ZONE AREA
Mayor Shirley stated that the Planning Board was disturbed because Art
Porter was using his home located at 208 East 3rd South, which is located
in an R1 zone area, for student housing, which was against the zoning
ordinance. The matter was discussed and it was determined that the sit-
uation was only temporary as Mr. Porter had rermi.tted the missionary lang-
uage students to live there pending other housing arrangements.
~RE: MR. AND MRS. FLOYD BAGLEY - SORENSEN ADDITION AND NEVILLE PROPERTY
Mr, and Mrs. Floyd Bagley presented a proposed plat for the development
of additional building lots on the Sorensen addition and the adjoining
Neville property, which would necessitate the relocation of 5th South.
Mr. Bagley suggested he might sell the property adjacent to the former KRXK
property for apartment house complex which would eliminate Harvard Ave.
Councilman Davis suggested that the city should obtain and follow a master
street plan and that through streets should not be eliminated.
The matter was discussed at great length. The Mayor stated he would
appoint a committee to work on the matter with the Planning Board. The
Mayor appointed Richard Davis, Albert Pieper and Barton Jensen as members
of the committee.
Councilman Davis informed Mr. Bagley that the remaining undeveloped lots
in the Sorenson Addition were too high and that the City could not guarantee
water; that Mr. Bagley would have to put in pressure pumps and that Mr.
Bagley should so advise the people who purchase the property of this fact
so they would not come back on the City and that Mr. Bagley should have
pressure pumps for each property if needed to get the water to them. Mr.
Bagley stated he agreed with Mr. Davis' statement.

STOP LIGHT AT INTERSECTION OF MAIN ST. AND FIRST WEST
Kimber Ricks Stated that he was representing the Washington PTA; that they
were vitally concerned regarding the decision of the State Highway to re-
move the stop light at the intersection of Main Street and First West; That
the three schools, Madison High, the Jr. High and Washington, were located
on the north of this intersection and that from 1400 to 1500 students were
using the intersection every day during the school term; that his organiza-
tion and others thought that the traffic light should be retained at that
. intersection.. The matter was discussed. The Mayor and Council determined
that they would again take this matter up with the State Highway Board.
NEW WATER MAIN
The Mayor reported that the new water main was being extended a block past
the intersection of Main street and 2nd. West and that the homes will have
to be hooked up to the new line; that in order to save tearing up the street
Mr, Armstronehad suggested the new lines should be put in by the property
owners; that the cost would be approximately $100 for each connection. The
matter was discussed.. Councilman Davis stated he would talk to Mr. Armstrong
about it and see what could be worked. out.
PARKING SPOT FOR VAL BRIGGS
Mayor Shirley reported that Val Briggs-who had an upholstery shoe in the

The matter of planting trees on Main Street was discussed. It was moved
by Albert Pieper, seconded by Ruth Smith, and unanimously carried, that
space be provided in the new sidewalks for the planting of trees and that
the trees be planted in such spaces.
RE: REPAIR OF DISTURBED AREAS BETWEEN PROPERTY LINES AND NEW SIDEWALKS.
Mayor Shirley reported he had been requested by property owners that th
city repair the. disturbed areas between the property lines and the new
sidewalks. The matter was discussed. Councilman Pieper stated he woul
check into the matter and see what was needed and how it could be handl
RE: JUDGE HACKING"S SALARY
The matter of paying Judge Hacking's salary as City Police Judge in the
absence of Gray Clawson was discussed. Glenn Peterson said he would
check into the matter.
RE:
POLE FOR FLASHING LIGHT AT SCHOOL INTERSECTION
Councilman Peterson reported that the Power Company would put in a wooden
pole for $32.00 for the flashing light at the school intersection at 1s t
West. and Main and the cost of the cable and flashing light would be $201.00.
The matter of one way alleys was discussed..
RE: DISCUSSION OF CITY PARK
Councilwoman Ruth Smith reported that a representative from the State Parks
Department had called on her at her request to consider participation in
a plan to make the area immediately south of the City Hall into a City
Park; that the City would likely have an opportunity to get 50o Federal aid
for the project; that a meeting was being held October 22nd and someone.

participate in the development. The Mayor asked Councilwoman Smith and
her committee to work out the details.
Mrs. Smith reported that she had talked to superintendent Catmull about
running the school busses out of First North Street, unloading in front of
the Washington building; that Mr. Catmull said he thought it was a good idea
and they would consider the matter. The Mayor asked Mrs. Smith to continue
to work on it.
REPORTS FROM COUNCILMEMBERS
Richard Davis reported that American Water Works Assn. was holding a con-
vention at Burley from the 23rd to the 25th of September. That Mr. Armstrong
would like permission to attend; that his estimated expense would be $134.26
It was moved by Albert Pieper, seconded by Barton Jensen, and unanimously
carried that Mr. Armstrong attend the meeting; that his expenses in that
amount be allowed.
Mrs. Lewis who lives on the Mill Hallow Read, reported that a lot of ,~,
dirt had washed against the curb and there was a big dip there which made
it impossible for the mail to be delivered on the west side. The Mayor
referred the matter to Councilman Albert Pieper..
Councilman Davis reported that the construction of a shelter in the
Smith Park had. been started and that it would be advisable to dig out t
sod, before the roof was put on. The Mayor referred the matter to Counc -
man Pieper.
Councilman Barton Jensen brought up the matter of insurance on the
building at the airport. The matter was discussed, also the matter of
getting some revenue from those who use the airport to help defray the ex-
penses of operating and maintaining the same. Mr. Jensen suggested that
the Council should have a meeting with the Airport Board and go into the
matter.
Mayor Shirley reported that he had carried a he<~.th and accident
insurance policy with the school which terminates in September and he would
like to carry his health and accident insurance with the City, paying the
share of the premium for both the employer and employee. It was moved by
Ruth Smith, seconded by Glenn Peterson and unanimously carried, that Mayor
Shirley be included in the City health and accident insurance program and
that the. City pay the .employers share of the premium.

payment of the same .approved. Seconded by Ruth Smith and unanimously
carried.

Minutes of the regular meeting held September 16, 1970 were read, corrected,
moved by Barton Jensen, seconded by Richard L. Davis, and unanimously carried
that the same be approved as corrected.
CITY PARK - SOUTH OF PRESENT CITY HALL
Mr. Ellis, representing the State Parks Department met with the Council,
to discuss the proposed park, south of the present City Hall. If the City
decides to build the park, applications well be made to the state parks
department for funds from the "Land Water Conservation Fund Act of 1965.'
If approved, the state would share the cast of the park on a SO-50 basis. The •
Council approved that Mayor Shirley attend the next board meeting that is
to be held in Couer d'Alene on October 23, 1970. Mr. Ellis stated that he
would set his appointment for that time. Mayor Shirley stated that the
approval of all businessmen and the Chamber of Commerce would be very vital
to this project and felt they should be consulted and get their reaction to
such.
JESSE NIEDERER - FOR APPROVAL ON NEW PROPOSED MEDICAL BUILDING
Sesse Niederer presented his petition, asking the council for their approval
on his new proposed Medical Building, stating that the planning Board had
,'' given their approval and that he had over 800 of the adjacent property
owners sign the petition. Barton Jensen motioned that we accept Niederer's
design for this property, giving limited professional building according to
plans. Seconded by Albert Pieper, Unanimously carried.
D. LEROY ARMSTRONG TO CHANGE SIDEWALK AND DRIVEWAY ON COLLEGE AVE.
D. Leroy Armstrong ask permission to change his sidewalk and driveway on
College Ave.., explaining that the run-off on the recently installed ones
would cause damage in the winter. Motioned by Barton Jensen, seconded by
Ruth Smith that Richard Davis investigate and authorize the change, if
desirable. Unanimously carried.
CLAYTER FORSGREN - PROGRESS OF MAIN STREET IMPROVEMENT
